THE EXECUTIVE TO HAVE PROPOSED LEGISLATION PREPARED AMENDING THE COMPREHENSIVE PLAN , . ZONING CODE AND MAPS TO ALTER THE DESIGNATIONS OF VARIOUS URBAN GROWTH AREAS WHEREAS, the Whatcom County Council adopted Ordinance 2009 - 071 to amend the Comprehensive Plan and Zoning ordinances to implement changes resulting from the completion of the required 10 . year review of the County's urban growth areas ; and . WHEREAS , several parties filed petitions for review of Ordinance 2009 - 071 before the Growth Management Hearings Board ; and WHEREAS , the Hearings Board subsequently granted motion allowing the parties until June 1 , 20.10 to attempt to reduce the number of issues or reach settlement of any or all of the petitions ; and WHEREAS, the Council held a settlement conference with all of the petitioners and intervenors on April 12 , 2010 to try to identify amendments that could be made in UGA designations to try to resolve the petitioners ' concerns with Ordinance 2009 - 071 ; and WHEREAS, during that meeting the Council took a series of straw votes to determine if there was sufficient interest on the part of a majority of the Council to pursue preparation and consideration of an ordinance amending one or more of the urban growth areas ; and WHEREAS , the results of several of those straw votes indicate sufficient interest on the part of a majority of the Council to revisit the designation of several urban growth areas ; and WHEREAS, the Whatcom County Code section 2 . 02 . 145 allows any member of the Council to forward a request to the Executive for the preparation of legislation for the consideration of the Council ; NOW THEREFORE BE IT RESOLVED that the Whatcom County Council requests the Executive to have proposed legislation and an accompanying staff report prepared for the consideration by the Council making the following changes to the county's urban growth areas , reflecting the results of the straw votes taken yesterday : 1 . Blaine UGA : Add Beachmont, Windward and Foster properties . 2 . Birch Bay UGA : Add Anchor Manor property 1 3 . Ferndale UGA : Restore Vista - Malloy area to UGA status ; add provisional UGA areas in north and south in accordance with map provided by the City at the conference on April 12 , 2010 4 . Nooksack UGA : Add area to east of City as shown on map provided by City at conference on April 12 , 2010 . 5 . Sumas : Add area to east of City on both sides of Hovel Road as depicted on map provided by the City at conference on April 12 , 2010 . 6 . Bellingham UGA : Restore Yew Street Road area to UGA status from UGA reserve . 7 . Bellingham UGA : Add entire Cordata North/CAITAC, USA property . EXHIBIT A : Maps showing proposed amendments .
