LUMMI NATION FERRY LEASE FUND-3901 AMENDMENT #1
WHEREAS, Whatcom County entered into a lease agreement with the Lummi Nation
for the continued usage of the Gooseberry Point ferry dock on October 11, 2011; and
WHEREAS, the County has committed to providing in excess of $6 million over the
term of the lease to perform improvements as outlined under Whatcom County contract
#201111024; and
WHEREAS, the Whatcom County Council created the Lummi Nation Lease
Fund-3901 through Ordinance 2011-049 to account for costs and revenues for construction
projects in compliance with the terms and conditions of the approved lease; and
WHEREAS, the final installment payment under the lease is due in 2026 and is
included on the 2026 Annual Road Program.
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that the
third installment of $2 million adjusted for inflation using December 2025 CPI-U is
calculated to be $2,871,903 is owed to the Lummi Nation; and
BE IT FINALLY ORDAINED by the Whatcom County Council that that Ordinance
2011-049 is hereby further amended adding $2,871,903 of expenditure authority to the
amended project budget for a total of $4,000,000 for a new total of $6,871,903.
