TITLE FOR AGENDA ITEM:
Resolution declaring Whatcom County Flood Control Zone District personal property as surplus and
approve sale (Council acting as Flood Control Zone District Board of Supervisors)
SUMMARY STATEMENT OR LEGAL NOTICE LANGUAGE:
Per RCW and Whatcom County Code, the Public Works River and Flood Division recommends the
surplus and sale of Whatcom County Flood Control Zone District (FCZD) personal property, a
single-family house and four barn/storage buildings located at 8134 Northwood Road, Everson,
Washington (Whatcom County tax parcel number 400322 286030 0000). The house and other
buildings will be sold by sealed bid and the house will be required to be relocated off the FCZD real
property to a property that is located outside of frequently flooded and geohazard areas as defined by
Whatcom County Critical Areas Ordinance. A minimum bid of $500.00 is recommended due to the
complexity and high cost of the house move

RESOLUTION NO. 2026-016
DECLARING WHATCOM COUNTY FLOOD CONTROL ZONE DISTRICT
PERSONAL PROPERTY AS SURPLUS AND APPROVE SALE
WHEREAS, the Whatcom County Flood Control Zone District (FCZD) owns property located at 8134
Northwood Road, Everson, Washington, which was purchased in 2025; and
WHEREAS, the Public Works River and Flood Division recommends that the County Council declare
FCZD personal property, a single family house and four barn/storage buildings located at 8134 Northwood
Road, Everson, Washington (Whatcom County Tax Parcel Number 400322 286030 0000), to be surplus
personal property and that the house be sold and moved off of the real property; and
WHEREAS, Whatcom County has adopted comprehensive procedures for the management of personal
property as codified in Whatcom County Code (WCC), Chapter 1.10, which applies to the management of
personal property held by the County and its departments including the FCZD; and
WHEREAS, WCC 1.10.180 authorizes the Council to sell personal property following a public hearing by
resolution.
NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the FCZD to declare
Whatcom County personal property, a single family house and four barn/storage buildings located at 8134
Northwood Road, Everson, Washington (Whatcom County Tax Parcel Number 400322 286030 0000), to
be surplus and that the house be sold by sealed bid, subject to the successful bidder providing evidence
that they own or control real property located outside frequently flooded and geohazard areas, as defined
by Whatcom County Critical Areas Ordinance, to where they can legally relocate the house; and
BE IT FURTHER RESOLVED that the minimum bid for the property listed above shall be no less than
$500.00 (five hundred 00/100 dollars) and that buyer will pay all costs associated with the transaction; and
BE IT FURTHER RESOLVED that transfer of said personal property be by bill of sale and that Buyer
will represent and warrant in writing to the FCZD, that buyer has thoroughly inspected and evaluated the
personal property for sale, to buyer's complete satisfaction and buyer accepts the personal property. Buyer
agrees that it will be their responsibility to obtain all applicable, necessary, and proper permits for moving
the structure off the real property; and
BE IT FURTHER RESOLVED that Buyer agrees that the house must be removed from the real property
no later than one (1) year from contract execution unless the FCZD agrees to extend the deadline; and
BE IT FURTHER RESOLVED that said purchase of said personal property shall not be allowed under
contract and shall be paid either in cash, certified check or money order to the Whatcom County Treasurer;
and
BE IT FINALLY RESOLVED that the Whatcom County Finance Department is hereby directed to sell
said personal property by sealed bid at no less than the minimum bid of $500.00 (five hundred 00/100
dollars).
