Filing a Proposed Ballot Measure for Inclusion in
Election
(AUDITOR'S OFFICE — Elections)
This procedure applies to Auditor's Staff, the Prosecuting Attorney, the Assessor's Office, and
representatives of the cities and districts submitting A proposed ballot measure.
Actions by Cities and Representative of Districts:
1. Submits proposed ballot measure (considered ballot title) together with an explanatory
statement prepared by legal counsel to Auditor's Office. Must be submitted at least 46 days
prior to the election date for a special election, no later than the Friday immediately before
the first day of regular candidate filing for the primary election, or no later than the day of the
primary for a general election.
Actions by Election Clerk:
2. If received by mail or courier (e.g., Fourth Corner Network), date stamps Ballot Measure
Cover Sheet and the first page of the resolution. Gives to Office Coordinator to complete
steps 3-7.
3. If received over the counter, date stamps Ballot Measure Cover Sheet and the first page of
the resolution.
4. Checks that:
• the Ballot Measure Cover Sheet (FRM #AU270090F) is attached and complete,
■ the resolution contains original signatures by a majority of commissioners or other
legislative body or is a certified copy by the clerk,
• the date of the election is stated in the resolution, and
• the explanatory statement is included if for a primary or general election.
4A. If packet not complete, returns packet to submitter to obtain missing information.
Process stops here.
5. Prepares Ballot Measure Receipt (See FRM #AU470090A). Makes a copy for file and
gives original to filer. (Note: Fill in ballot measure name only — no references to resolution
number.)
6. If for primary or general election, provides voter pamphlet information packet to submitter.
7. Gives all materials to Office Coordinator.
Actions by Office Coordinator:
�8r-Creates ballot measure file folder and staples this procedure to front of folder to be used as
a checklist.
Ensures front staff completed and applied initials for Steps 2-7 above.

23. Makes photocopy of resolution, validation " ures (if applicable), and ballot measure cover
sheet. Attaches to Prosecuting Attor s transmittal letter.
A NOTE: If ballot title submitted a city, no review by the Prosecuting Attorney is

24. Prepares transmittal le r to Assessor to review if there are taxing or funding implications,
allowing 7 days for cessing to obtain their review. (See FIRM #AU470090C — Assessor
Ballot Title Lette sends to Janice Judge)
25. Makes ph copy of resolution, validation figures (if applicable), and ballot measure cover
sheet. taches to Assessor's transmittal letter.
26. O ins signature on transmittal letters and puts copies in folder.

The undersigned, being the officers designated by law as constituting the Whatcom County
Canvassing Board, have completed the canvass of votes as it pertains to the General Election held
November 3, 2015, within the boundaries of Whatcom County, State of Washington.
Proposition 9, proposed by the Whatcom County Council, concerned the number of council districts
and at -large positions. The proposition would amend Whatcom County Charter Sections 2.11 and
2.12 to create five districts of equal population with one council position in each of the five districts
plus two at -large positions that would be nominated without regard to district.
Based on the criteria for passage which was supplied by the district, the measure Passed.

Initiative Measure No. 1366 concerns state taxes and
fees. This measure would decrease the sales tax rate
unless the legislature refers to voters a constitutional
amendment requiring two-thirds legislative approval or
voter approval to raise taxes, and legislative approval for
fee increases.

Initiative Measure No. 1401
Initiative Measure No. 1401 concerns trafficking of
animal species threatened with extinction. This measure
would make selling, purchasing, trading, or distributing
certain animal species threatened with extinction, and
products containing such species, a gross misdemeanor
or class-C felony, with exemptions for certain types of
transfers.

spill response and administration taxes to apply to crude

costing an estimated $3,707,000,000 in the first ten

Engrossed Substitute Senate Bill 6138
The legislature increased business and occupation tax
revenues and excluded certain software manufacturers
from a retail sales tax exemption, without a vote of the
people, costing $1,449,000,000 for government

County Measures
Proposition No. 2015-1
Jail Facilities Sales and Use Tax
The Whatcom County Council passed Resolution 2015-
024 concerning a proposition authorizing a sales and
use tax for jail facilities. This proposition would impose a
sales and use tax of two tenths of one percent (20 cents
for every $100) for constructing and operating jail
facilities for inmates charged or convicted of
misdemeanor and felony acts, and for other public safety
purposes, as authorized by RCW 82.14.450. Half of this
tax (10 cents for every $100) would expire upon
repayment of bonds issued to finance the facilities, no
later than 30 years after issuance. Should this

Proposition No. 1
Method of Electing Council Members
The Whatcom County Charter Review Commission has
proposed an amendment to the Whatcom County
Charter concerning the method of electing County
Council members. This measure would amend Charter
Section 2.13 to provide for election of County Council

Proposition No. 2
Limiting Power of Council to Amend Charter
The Whatcom County Charter Review Commission has
proposed an amendment to the Whatcom County
Charter limiting the power of the Council to propose
Charter amendments. This measure would amend
Charter Section 8.23 to prohibit the County Council from
proposing Charter amendments to previous Charter
amendments that have been approved by a 2/3 majority
of voters, except if the Council adopts a proposal for

Section 2.12 Nominations.
(a) Nominees by district.

of each district shall select two (2) candidates for each position to be filled from their

(b) Nominee at large.

county -wide at the primary election shall be certified as candidates for the position of

Transition language:
A Districting Committee shall be appointed by January 31 of 2016, as per Sections 4.40,
4.41, and 4.42 of the County Charter. The Committee shall draw a districting plan for five
Council Districts. The approximate geographic areas covered by each district are anticipated
to be:
District 1 - Central and South Bellingham
District 2 - North Bellingham
District 3 - Deming, Kendall, Acme, Sudden Valley, Lake Whatcom, Lake Samish and
Chuckanut
District 4 - Lynden, Sumas, Everson and surrounding farmland
District 5 - Lummi Reservation, Lummi Island, Ferndale, Birch Bay, Blaine and Point
Roberts.
Council positions 1A, 2A, 3A and the At -large Position shall become Council positions District
1, District 2, District 3 and At -large Position A, respectively. These positions will be elected
commencing in 2017. Council position 113, 2B and 3B shall become At -large Position B,
District 4 and District 5, respectively. These positions shall be elected commencing in 2019.
Explanatory Statement:
Under the current Whatcom County Charter, Whatcom County is required to be divided into
three districts of equal population. In each district, there are two council positions. There is
also currently one at -large council position which is nominated without regard to residence
in a particular district, resulting in a total of seven council positions. This amendment would
require that the county be divided into five districts of equal population. Each of these
districts would have one council position. In addition, this amendment would increase the
number of at -large positions to two, resulting in a total of seven council positions.

During the month of January, 1981, and by January 31 of each tenth year thereafter, a f+ve-

as the stated party of any candidate receiving at least 1511/0 of the vote in Whatcorn County
in the most recent gubernatorial primary or presidential election. Parties with a_candidate
receiving at least 3311/o of the vote in either of those elections will be provided a second
representative on the Districting Committee. If the number of total representatives is even,
the 8LIF to appeint, appointees will select afifth an additional member who shall be the
Chairman. If the total number is odd, the Committee will vote for and appoint a Chair
internally. The Districting Committee shall within thirty (30) days of its appointment meet
and appoint a Districting Master who shall be qualified by education, training and experience
to draw a districting plan. If the Districting Committee is unable to agree upon the
appointment of a Districting Master within thirty (30) days, the County Council shall appoint

LOWERING THE NUMBER OF SIGNATURES REQUIRED
FOR CITIZEN INITIATIVES TO AMEND CHARTER
The Whatcom County Charter Review Commission has proposed an amendment to the
Whatcom County Charter reducing signatures required to place citizen -proposed Charter
amendments on the ballot. This measure would amend Charter Section 8.22 to lower the
number of signatures required for placement upon the ballot of proposed Whatcom County
Charter changes by citizen initiative from 20% to 15% of the number of votes cast in the
County in the last gubernatorial election. Should this proposal be:

Section 8.22 Amendments by the Public.
The public may propose amendments to the Charter by registering with the Auditor an
initiative petition bearing the signatures of registered voters of the county equal in number
to, but not less than, twemot; (29) fifteen 15 percent of the number of votes cast in the
county in the last gubernatorial election. Signatures shall be registered not more than one
hundred twenty (120) days following filing of the petition with the Auditor, who shall submit
the amendments to the voters. The one hundred and twenty (120) day period shall begin
upon receipt of official notification to petitioner(s) by the Prosecuting Attorney's Office either
by certified mail or messenger. If the last day for collecting signatures falls on a weekend or
legal holiday, then the one hundred and twenty (120) day period shall extend to the end of

Explanatory Statement:
Presently the number of signatures of registered voters in the county that are required upon
a petition to place an initiative for County Charter amendments upon the ballot is 20% of
the votes cast in the county in the last regular gubernatorial election. This proposed
amendment, if adopted, would lower the number of signatures required to 15% of the
number of votes cast in the county in the last regular gubernatorial election.

TERM LIMITS FOR COUNTY EXECUTIVE AND COUNCIL MEMBERS
The Whatcom County Charter Review Commission has proposed an amendment to the
Whatcom County Charter to place term limits upon the County Executive and County
Council members. This measure would amend Charter Sections 2.14 and 3.21 to apply a
term limit of no more than three consecutive full terms to the County Executive and County
Council members, to be applied prospectively only, beginning with the 2017 and 2019
elections. Should this proposal be:

Text Amendment:
Section 2.14 Terms of Council Members.
The term of office of each elected councilmember shall be four (4) years commencing
with the second Monday in January following election, and until a successor has been
elected and has qualified. Elected councilmembers shall serve no more than three
consecutive full terms in office. Terms are considered consecutive unless they are at least
four ears apart. The limit in terms shall be applied prospectively only, beginning with the
elections in 2017 and 2019.
Section 3.21 Election and Term of Office.
The County Executive shall be nominated and elected by the voters of the county, and
the term of office shall be four years and until the successor is elected and qualified. The
County Executive shall serve no more than three consecutive full terms in office. Terms are
considered consecutive unless they are at least four years apart. The limit in terms shall be
applied Rrosoectively only, beginning with the election in 2019.
Explanatory Statement:
Presently there is no limitation upon the number of terms to which County Councilmembers
and the County Executive may be elected. This proposed amendment, if adopted, would
limit the number of consecutive terms to which Councilmembers and Executive could be
elected to three full four-year terms. Terms would be considered consecutive unless a
period of four years out of such office intervened between elected terms of service. The
limitation if adopted would apply prospectively only, beginning with the elections of 2017 for
councilmembers elected that year and 2019 for councilmembers and executive elected that
year.

ALTERING COMPOSITION OF DISTRICTING COMMISSION
The Whatcom County Charter Review Commission has proposed an amendment to the
Whatcom County Charter to alter the requirements for composition of the Districting
Commission. This measure would amend Charter Section 4.41 to include representation on
the districting committee from each political party with a candidate who receives at least
15% of the vote cast in the County in the last gubernatorial primary or presidential election,
with a second representative on the committee assigned to each party of which a candidate
for those same elections received at least 33% of the vote. Should this proposal be:

Section 4.41 Districting Committee.
During the month of January, 1981, and by January 31 of each tenth year thereafter, a
five r e ffiDistricting Committee shall be appointed. The County Council shall appoint
to the committee, twe-one representative from each major political party,
defined as the stated party of any candidate receiving at least 15% of the vote in Whatcom
County in the most recent gubernatorial primaEy or residential election. Parties with a
Candidate receiving at least 330/0 of the vote in either of those elections will be provided a
second representative on the Districting Committee. If the number of total representatives
is even, the feur te app appointees will select afifth an additional member who shall be
the Chair. If the total number is odd, the Committee will vote for and appoint a Chair
internally. The Districting Committee shall within thirty (30) days of its appointment meet
and appoint a Districting Master who shall be qualified by education, training and experience
to draw a districting plan. If the Districting Committee is unable to agree upon the
appointment of a Districting Master within thirty (30) days, the County Council shall appoint
a Districting Master by March 31 of that year.
Explanatory Statement:
Presently the County's redistricting committee is comprised of two persons each from the
two major political parties, plus a fifth person chosen by those four. This proposed
amendment, if adopted, would provide for one person from each political party with a
candidate receiving at least 15% of the vote in Whatcom County in the most recent
gubernatorial primary or presidential election, with a second person from each party with a
candidate receiving at least 33% of the vote in Whatcom County in either of those elections.
If the number so chosen is even, those persons shall select an additional member.

require that the county be divided into five districts of equal population. Each of these
districts would have one council position. In addition, this amendment would increase the
number of at -large positions to two, resulting in a total of seven council positions.

at least ninety (90) days after enactment. A minimum of five (5) of affirmative votes shall be
required supermajority (five of seven) of affirmative votes of the entire membership shall be
required to enact such an ordinance. An ordinance proposing an amendment to the Charter
shalt not be subject to the veto power of the County Executive.
The County Council by unanimous vote of the entire Council may effect amendments to the
language of the Charter where the passage of time has rendered language moot or obsolete.
Such changes shall be made by ordinance, and have a public hearing. {Amended by

amendment to place it before the voters. If this amendment passes, a supermajority of
both the Commission and the Council would be required and be sufficient to place any
proposed amendment from either body before the voters. A "yes" vote for this amendment
is incompatible with a "yes" vote for either Proposition No. 2 or No. 3.

Auditor shall give the proposed initiative a number, which shall thereafter be the identifying

PROPOSING AN AMENDMENT TO THE WHATCOM COUNTY CHARTER
TO RESPECT COMMUNITIES AND PROVIDE FOR FAIR
ELECTIONS IN FIVE EQUAL COUNCIL DISTRICTS
WHEREAS, both the Washington State Constitution and the Whatcom County Charter
allow the County Council to propose Charter amendments to the voters; and
WHEREAS, county citizens have testified at the 2015 Charter Review Commission
meetings and expressed concerns regarding diversity and representation on the County
Council; and
WHEREAS, RCW 29A.76.010 states that!
(a) Each district shall be as compact as possible.
(b) Each district shall consist of geographically contiguous area.
(c) Population data may not be used for purposes of favoring or disfavoring any
racial group or political party.
(d) To the extent feasible and if not inconsistent with the basic enabling
legislation for the municipal corporation, county, or district, the district boundaries
shall coincide with existing recognized natural boundaries and shall, to the extent
possible, preserve existing communities of related and mutual interest; and
WHEREAS, both rural areas and the City of Bellingham are in each of the three districts
and both are communities of interest that, to the extent possible, should not be divided yet are
divided under our current three district system; and
WHEREAS, five districts would minimize municipal division and enable communities of
interest to remain whole; and
WHEREAS, moving from three districts to five districts will ensure rural and urban
geographic areas are represented by a person who resides within their district; and
WHEREAS, five districts as proposed would more closely comply with RCW 29A.76.010
than our three current districts which may be in conflict with existing state law.
WHEREAS, the Whatcom County Charter allows a super majority of the Whatcom
County Council to place charter amendment measures as general election ballot questions to
be voted on by all qualified registered voters of Whatcom County.
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that the
County Auditor shall place on the November 2015 general election ballot a Charter amendment
changing the current system of electing members of the Whatcom County Council from three
districts with one at -large council member to a system of five districts in which five of the

TO RESPECT COMMUNITIES AND PROVIDE FOR FAIR
ELECTIONS IN FIVE EQUAL COUNCIL DISTRICTS
WHEREAS, both the Washington State Constitution and the Whatcom County Charter
allow the County Council to propose Charter amendments to the voters; and
WHEREAS, county citizens have testified at the 2015 Charter Review Commission
meetings and expressed concerns regarding diversity and representation on the County
Council; and
WHEREAS, RCW 29A.76.010 states that:
(a) Each district shall be as compact as possible.
(b) Each district shall consist of geographically contiguous area.
(c) Population data may not be used for purposes of favoring or disfavoring any
racial group or political party.
(d) To the extent feasible and if not inconsistent with the basic enabling
legislation for the municipal corporation, county, or district, the district boundaries
shall coincide with existing recognized natural boundaries and shall, to the extent
possible, preserve existing communities of related and mutual interest; and
WHEREAS, both rural areas and the City of Bellingham are in each of the three districts
and both are communities of interest that, to the extent possible, should not be divided yet are
divided under our current three district system; and
WHEREAS, five districts would minimize municipal division and enable communities of
interest to remain whole; and
WHEREAS, moving from three districts to five districts will ensure rural and urban
geographic areas are represented by a person who resides within their district; and
WHEREAS, five districts as proposed would more closely comply with RCW 29A.76.010
than our three current districts which may be in conflict with existing state law.
WHEREAS, the Whatcom County Charter allows a super majority of the Whatcom
County Council to place charter amendment measures as general election ballot questions to
be voted on by all qualified registered voters of Whatcom County.
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that the
County Auditor shall place on the November 2015 general election ballot a Charter amendment
changing the current system of electing members of the Whatcom County Council from three
districts with one at -large council member to a system of five districts in which five of the
