CHARTER AMENDMENT PETITION FOR SUBMISSION
TO THE VOTERS OF WHATCOM COUNTY
TO: The Auditor of Whatcom County, and to the County Council of Whatcom County:
We, the undersigned citizens of Whatcom County and legal voters respectfully
direct that the proposed measure known as Whatcom County Proposed Charter Amendment
No. 1 entitled:
shall all Government Employees within the boundaries of Whatcom co mty be required
to sign Whatcom Cotmty's non -coercion agreement?
The terms for creation of which are printed on the reverse side of this petition, to
be submitted to the legal voters of the County of Whatcom, State of Washington for their
approval or rejection at the general election to be held on the 5th day of November
1996; and each of us for himself or herself says: I have personally signed this petition;
I am a legal voter of the County of Whatcom, State of Washington, and my residence
address is correctly stated on this petition.

Shall the charter be amended to require that all Governmental Employees within the
boundaries of Whatcom County be required to sign a non -coercion agreement, the form
of which has been decided by the County Council and approved by the Petitioner?
To protect the vital interests of the majority of Whatcom County's citizens, No
Government employee working in Whatcom County shall be allowed to be a member of a trade
union, or act on the behalf of any trade union, or any special interest. Labor contracts
that presently may allow union membership may be allowed to continue until expiration,
provided that such contracts shall not be renewed or of an infinite nature. It is the
belief of the Petitioner that regulations and County politics have become too heavily
influenced by such involvement, and that Government policies should be determined by,
and of nenifit to, the taxpaying public rather than special interest groups.
It shall be required as a term of further employment, that all Government employees
whom are not presently under contract for Union representation, be required to sign
and obey the terms of a non -coercion agreement, the content of which to be determined
by the Whatcom County Council, and agreed to by the Petitioner. All Government employees
whom are currently allowed by contract to be represented by a union shall sign the above -
mentioned non -coercion agreement upon expiration of their contracts as a term of further
employment within this County.
If it can be determined that Whatcom County has no jurisdiction over the conduct
of certain Government employees, that determination shall not be made to apply to all
Government employees, rather, the select group that the ruling may have been made for.
Once in effect, this amendment shall only be revoked by the legal vote of the citizens
of this County.

William A. LaFrieniere has filed the attached proposed charter amendment. I have reviewed
Section 8.22 of the Home Rule Charter for Whatcom County and I do not find any process for
review by either the County Auditor or the Prosecuting Attorney.
With the Initiative and Referendum, the Prosecuting Attorney reviews the ballot title before the
proponents gather the signatures. It appears that with the Charter Amendment, the proponents
gather the signatures and then the Prosecuting Attorney writes the ballot title.
Please review the proposed charter amendment and advise me of your opinion of the next step.
The charter states the proponents have 120 days to collect signatures after filing the proposed
amendment with the County Auditor. The proposed amendment was filed October 30, 1995
although the form requires the addition of the date of the next General Election which is
November 5, 1996.
Please call me or meet with me right away so I can advise the proponents of the next step.
