The undersigned, being the officers designated by law as constituting the Whatcom County
Canvassing Board, have completed the canvass of votes as it pertains to the General Election held
November 7, 2017, within the boundaries of Whatcom County, State of Washington.
The proposition concerned authorizing a sales and use tax for public safety purposes, including new
jail facilities. The proposition would authorize a sales and use tax of two tenths of one percent for
public safety purposes, including costs associated with construction, maintenance, and operation of
jail facilities, plus incarceration prevention, medical and behavioral health facilities and programs.
Based on the criteria for passage which was supplied by the district, the measure Failed.

Filing a Proposed Ballot Measure for Inclusion in
Election
(AUDITOR'S OFFICE — Elections)
This procedure applies to Auditor's Staff, the Prosecuting Attorney, the Assessor's Office, and
representatives of the cities and districts submitting a proposed ballot measure.
Actions by Cities and District Representative:
1. Submits proposed ballot measure (considered ballot title) together with the ballot measure
cover sheet, an explanatory statement for the Local Voter Pamphlet prepared by legal
counsel, and the "For' and "Against" committee appointments to the Auditor's Office. Must
be submitted at least 60 days prior to the election date for a special election, no later than
the Friday immediately before the first day of regular candidate filing for the primary election,
or no later than the day of the primary for a general election.
Actions by Election Clerk:
2. If received by mail or courier (e.g., Fourth Corner Network), date stamps Ballot Measure
Cover Sheet and the first page of the resolution. Gives to Office Coordinator to complete
steps 4-6.
3. If received over the counter, date stamps Ballot Measure Cover Sheet and the first page of
the resolution.
4. Verifies that:
■ the Ballot Measure Cover Sheet (FRM #AU470090F) is complete and all
documentation requested is attached
the date of the election is stated in the resolution
5. Notes any missing information in the lower right corner of the Ballot Measure Cover Sheet.
Fills in the submittal deadline date (resolution deadline date) if there is missing information.
Photocopies the ballot measure cover sheet. Gives the photocopy to the submitter to
serve as their receipt. Retains the original cover sheet to be placed in the file.

0 Requirements and the Committee Statement Form) to submitter.
7. Initials that Steps 2-6 have been completed.
8. Gives all materials to Office Coordinator.

Creates ballot measure file folder with label that states: district or city name, proposition
number, name of measure, and date of election. Staples this procedure to front of folder to
be used as a checklist. Puts copy of validation requirements in file.

We need a safe jail. The current jail's deplorable condition places inmates and employees at catastrophic
risk. Defective locks allow prisoners to assault staff and other inmates. Potential tragedies and lawsuits
threaten. Lack of space to separate inmates with mental health or chemical dependency issues is unsafe
and inhumane. The new design provides 36 designated beds for mental health and medical treatment.
Since 2013, an increasing County population raised felony filings by 20%. The existing jail is dangerously
small; overcrowding often causes booking restrictions, transfers to facilities across the state away from
family connections, and early releases.
At just 20 cents per $100 of non-food items the small sales tax increase funds not only construction but also
ongoing operations and incarceration prevention initiatives-- something a property tax increase can't do. The
proposal helps cities fund public safety needs, including police and fire departments. The related agreement
between Bellingham and Whatcom County designates an additional $30,000,000 over 30 years to expanded
incarceration reduction and prevention programs.
Delayed construction escalates cost by $6,000,000 annually. All Mayors, City Councils, County Council,
County Executive and Sheriff support this modified proposal, reached by listening and compromise. Vote
yes for a safe and humane jail.

Statement For:
We need a safe jail. The current jail's deplorable condition places inmates and employees at catastrophic
risk. Defective locks allow prisoners to assault staff and other inmates. Potential tragedies and lawsuits
threaten. Lack of space to separate inmates with mental health or chemical dependency issues is unsafe
and inhumane. The new design provides 36 designated beds for mental health and medical treatment.
Since 2013, an increasing County population raised felony filings by 20%. The existing jail is dangerously
small; overcrowding often causes booking restrictions, transfers to facilities across the state away from
family connections, and early releases.
At just 20 cents per $100 of non-food items the small sales tax increase funds not only construction but also
ongoing operations and incarceration prevention initiatives-- something a property tax increase can't do. The
proposal helps cities fund public safety needs, including police and fire departments. The related agreement
between Bellingham and Whatcom County designates an additional $30,000,000 over 30 years to expanded
incarceration reduction and prevention programs.
Delayed construction escalates cost by $6,000,000 annually. All Mayors, City Councils, County Council,
County Executive and Sheriff support this modified proposal, reached by listening and compromise. Vote
yes for a safe and humane jail.

The ballot measure submitted has been received and will appear on the November 7, 2017,
General Election ballot. Changes to the heading have been made and are highlighted for quick
reference:

All other ballot measure language will remain the same as submitted.
Two modifications were made to the explanatory statement and are highlighted for reference.
The explanatory statement will be printed in the Local Voters' Pamphlet as follows:
State law requires the County to provide a jail. The County Council has determined the
current jail does not meet existing and future needs. If Proposition 2017-6 passes, the
County will build a replacement jail in Ferndale, demolish the existing jail and construct
an inmate holding space at the County Courthouse. The Proposition would add a sales
and use tax at a rate of 0.2% (two -tenths of one percent) to be used for public safety,
including construction and operation of a jail, and facilities and programs for medical and
behavioral health services and incarceration prevention, as authorized by
RCW 82.14.450.
This notice is being provided pursuant to RCW 29A.36.080.

Here's the FOR rebuttal to the AGAINST:
This is a vastly improved plan from 2015. It funds operations, medical beds, mental -health treatment, and incarceration
reduction and prevention programming along with jail construction. Unfortunately, costs will only get higher with further delay.
The design facilitates future expansion if required by population growth. The 2004 tax enabled basic maintenance; the facility is
now beyond economic repair. The 1-5/Slater site is more convenient for local families and officers will return to patrols more
quickly.

Building an expensive new jail because of broken locks and other maintenance issues makes no sense. The new Skagit jail cost $120,000 per bed. This
proposed jail costs $250,000 per bed, making it one of the most expensive jails ever built in the U.S.! We need to fully fund treatment and diversion
instead of warehousing the mentally ill and those who can't afford bail. Whatcom Democrats, local businesses, and others endorse a `No' vote.

Duite simply, the tax is too high and there are too many problems with the proposed jail. If this tax
basses, all of the county's public safety tax revenue will be sunk into a large jail for the next 30
/ears. A county sponsored report concluded "Any attempt to ease overcrowding by building a new
:acility will not address the underlying causes of population growth, and the new facility will quickly
)ecome overcrowded." The Vera Institute report outlines many ways to achieve a safe, sustainable,
and fair justice system. The proposed large jail and new sheriff offices in Ferndale will disrupt our
efficient law and justice system in downtown Bellingham, producing new security concerns while

The Whatcom County Council passed Ordinance 2017- 037 concerning a
proposition to authorize a sales and use tax for public safety purposes, including new jail
facilities. This proposition would authorize a sales and use tax of two tenths of one percent
(0.002) for public safety purposes, including costs associated with construction,
maintenance, and operation of jail facilities, plus incarceration prevention, medical and
behavioral health facilities and programs, as authorized by RCW 82.14.450. Half of this tax
(0.001) will expire upon repayment of the total capital cost of jail facilities, or December 31,

WHEREAS, ensuring the protection and safety of the residents of Whatcom County
is an essential priority; and
WHEREAS, the Whatcom County Council has determined that the present county-
wide jail facilities on Prospect Street and an interim jail on Division Street in Bellingham,
which are owned, operated, and maintained by Whatcom County, do not meet existing and
future County and cities' inmate incarceration needs; and
WHEREAS, the health, welfare and safety of the residents and businesses of
Whatcom County necessitate that the County provide replacement jail facilities; and
WHEREAS, the health and safety of jail inmates and the safety of the County jail
staff necessitate that the County provide new jail facilities that are consolidated; and
WHEREAS, the Whatcom County Jail Planning Task Force has recognized the need
and recommended to "replace the existing County Jail, the Whatcom County Jail
Stakeholders Workgroup unanimously recommended to the Whatcom County Council the
financial agreement needed to develop the funding mechanism and cost -sharing allocation
to build a new jail, and the County Sheriff and the County Executive have collectively
submitted a recommended plan for the building and operation of a new County jail located
on LaBounty Road in Ferndale; and
WHEREAS, the new jail will include jail housing, booking and administration
facilities, expanded medical and behavioral health facilities and jail alternative programming
space to serve the needs of the community for the foreseeable future; and
WHEREAS, in order to provide funding for public safety purposes, including the
costs associated with financing, construction, maintenance, and operation of jail facilities,
and incarceration prevention programs, including medical and behavioral health facilities
and programs, it is deemed necessary and advisable for Whatcom County to submit a ballot
proposition to the voters for authorization to impose an additional local sales and use tax of
two tenths of one percent (0.002 -- 20 cents for every $100), as authorized by RCW
82.14.450; and
WHEREAS, the Whatcom County Council, pursuant to the passage of Resolution
2017- 031, has authorized and approved the Whatcom County Executive to enter into lon

I the Whatcom County cities to share in the costs of the construction and ongoing operating
2 costs of a new jail and jail -related facilities that serve the future needs of their city and
3 county inmates with the proceeds of a sales and use tax; and

5 WHEREAS, the parties of the JFFUA, recognize and fully support the goals of the
6 Incarceration Prevention and Reduction Task Force ("IPRTF"), established through
7 Ordinance 2015-025, to reduce incarceration and recidivism. The IPRTF is charged with
8 continually reviewing Whatcom County's criminal justice and behavioral health programs
9 and make specific recommendations to safely and effectively reduce incarceration of
10 individuals struggling with mental illness and chemical dependency, and minimize jail
11 utilization by pretrial defendants who can safely be released. This includes increasing the
12 availability of Alternative Jail programs, including Electronic Home Detention, Work Release
13 and Work Crew programs, the establishment of a County pretrial supervision program, and
14 the expansion of the Crisis Triage Facility.

16 WHEREAS, to ensure public safety and to support the goals of the IPRTF, the
17 Whatcom County Council urges the Cities of Whatcom County to continue to fund
18 incarceration prevention programs. The Whatcom County Council requests the City of
19 Bellingham to commit at least 25% annually (projected at $255,632 in 2019) of the City's
20 net sales tax revenue, in excess of the City's portion of the capital cost of the new jail, to
21 fund these programs. Since Whatcom County is not projected, in the first few years, to
22 receive net sales tax revenue, in excess of Whatcom County's portion of the capital cost, the
23 Whatcom County Council commits to use sales tax revenue or other legitimate funding
24 sources on a dollar for dollar match, up to an annual amount of 25% of the County's net
25 sales tax revenue or $300,000, whichever is greater. If both jurisdictions commit to this
26 funding, this amount would be projected to be $30,193,628 over 30 years, and shall last
?7 until repayment of the total capital cost of jail facilities, or December 31, 2048, whichever
28 occurs first. This commitment is intended to accomplish the continued implementation of
29 the criminal justice and behavioral health programs recommended by the IPRTF.

31 WHEREAS, following passage of a voter -approved proposition for a sales and use
32 tax and signing of the JFFUA, the County will issue general obligation bonds for the
33 construction costs of the new jail and the Whatcom County cities will pay capital payments
34 commensurate with those outlined in the JFFUA; and
35
36 WHEREAS, as soon as practical after December 31, 2048, or when the total capital
37 cost of the new jail has been paid for by all the Cities and County, whichever occurs earlier,
38 the Cities and County have agreed that collection of one half of the two tenths of one
39 percent (0.001) of the sales and use tax shall expire;

41 NOW, THEREFORE, BE IT ORDAINED that:

43 Section 1. a ballot proposition shall be submitted to the qualified voters of the
44 County pursuant to RCW 82.14.450 to authorize the County Council to fix and impose a
45 local sales and use tax of two tenths of one percent (0.002 -- 20 cents for every $100) to

The Whatcom County Council approved a motion at its July 25, 2017, meeting to
officially request that the Prosecutor's Office include the word "jail" in the ballot title
for the sales and use tax proposition. The motion is as follows:
Buchanan moved to request that the Prosecutor's Office include the word
"jail" in the ballot measure.
The motion was seconded.
The motion carried by the following vote:

More specifically, as I mentioned to you earlier this week, the Council would like the
word "jail" included in the statement of the subject of the measure, similar to the
attached ballot title. Although it is not stated in the motion, when listening to the
audio from the meeting (and from discussions I've had with councilmembers) I
believe the desire of Council is to include the word "jail" in the subject title of the
measure, not just in the measure's description.

build a replacement jail on LaBounty Road in Ferndale, demolish the existing Prospect Street
jail, and construct facilities for inmate transfer at the County Courthouse.

Jail Facilities Sales And Use Tax
The Whatcom County Council passed Resolution 2015-024 concerning a proposition authorizing
a sales and use tax for jail facilities. This proposition would impose a sales and use tax of two
tenths of one percent (20 cents for every $100) for constructing and operating jail facilities for
inmates charged or convicted of misdemeanor and felony acts, and for other public safety
purposes, as authorized by RCW 82.14.450. Half of this tax (10 cents for every $100) would
expire upon repayment of bonds issued to finance the facilities, no later than 30 years after
