I STATE MEASURES
INITIATIVE TO THE LEGISLATURE 336
Initiative Measure No. 336 concerns medical
malpractice, including insurance, healthcare
provider licensing, and lawsuits. This measure
would: require notices and hearings on
insurance rate increases; establish a
supplemental malpractice insurance program;
require license revocation proceedings after
three malpractice incidents; and limit numbers of
expert witnesses in lawsuits.

AMENDMENT TO THE STATE CONSTITUTION
PROPOSED BY THE LEGISLATURE
SENATE JOINT RESOLUTION 8207
The legislature has proposed a constitutional
amendment on qualifications for service on the
commission on judicial conduct. This
amendment would permit one member of the
commission on judicial conduct to be selected
by and from the judges of all courts of limited
jurisdiction.

PROPOSITION NO.1
SALES AND USE TAX FOR COUNTIES AND
CITIES
The Whatcom County Council passed
Resolution No. 2005-043 concerning a
proposition to authorize a sales and use tax as
allowed by law and for the provision of
countywide emergency medical services. This
ballot proposition would authorize the imposition
of a sales and use tax, in addition to any other
taxes authorized by law, of one -tenth of one
percent (0.1% -- 10 cents for every $100), two-
thirds to a used solely for costs associated with
the provision of countywide emergency medical
services and one-third for criminal justice
purposes, as authorized by RCW 82.14.450,

SUMMARY STATEMENT:
Approval by the Whatcom County Council to submit to the qualified

7 PROVIDING FOR SUBMISSION TO THE QUALIFIED VOTERS OF THE COUNTY A
8 PROPOSITION AUTHORIZING A LOCAL SALES AND USE TAX OF ONE -TENTH
9 OF ONE PERCENT TO BE USED FOR FUNDING COUNTYWIDE EMERGENCY
10 MEDICAL SERVICES AND AS REQUIRED BY LAW

12 WHEREAS, appropriate emergency medical services are needed to provide for the
13 health, welfare, and safety of the residents of Whatcom County; and
14
15 WHEREAS, the Whatcom County Emergency Medical Services Working Group and the
16 Whatcom County Executive have submitted a recommended plan for the provision of these
17 services; and
18
19 WHEREAS, the Whatcom County Council has reviewed the recommended plan and
20 determined that continuation of unified countywide emergency medical service is in the best
21 interest of the people of Whatcom County; and
22
23 WHEREAS, reduced revenue from Medicaid, Medicare and other sources along with
24 increasing costs has created a budget deficit in the current program and a projected deficit in the
25 recommended plan budget; and
26
27 Whereas, a stable, long term funding source is necessary in order to adequately provide
28 these services to the people of Whatcom County as outlined in the recommended emergency
29 medical services plan.

I NOW, THEREFORE, BE IT RESOLVED that a ballot proposition shall be submitted in
2 the November 2005 general election to the qualified voters of the County pursuant to RCW
3 82.14.450 to authorize the County Council to fix and impose a local sales and use tax of one-
4 tenth of one percent (0.1 % -- 10 cents for every $100) to be used as required by law and to
5 provide funding for the provision of countywide emergency medical services.

7 BE IT FURTHER RESOLVED, that the County Executive is hereby authorized and
8 requested to initiate the appropriate action necessary to ensure a proposition in substantially the
9 following form shall be submitted to the voters of Whatcom County:
