On November 17, 1993, The Board of Directors of the Whatcom Transportation
Authority passed a resolution calling for the annexation of specified additional areas into
the WTA Public Transportation Benefit Area. A certified copy of the Resolution is
Attached.
We worked closely with your department in development of the resolution and with
Richard Langabeer, WTA legal counsel. In addition, the resolution is similar to previous
annexation resolutions of the WTA.
The date that we have requested the election is March 8, 1994. We are aware that the
WTA is required to participate in the cost of the election. Please review the document
and advise the WTA on how we should proceed and what if any additional obligations or
responsibilities that we may have.
We appreciate the assistance that you and your staff have provided in developing WTA
annexation plans.

RESOLUTION NO. 119-93
A RESOLUTION OF THE WHATCOM TRANSPORTATION AUTHORITY
PURSUANT TO R.C.W. 36.57A.140 AND R.C.W. 82.14.045 PROVIDING FOR THE
ANNEXATION OF CERTAIN TERRITORY TO THE WHATCOM TRANSPORT-
ATION BENEFIT AREA, DESCRIBING THE BOUNDARIES TO BE ANNEXED,
AND PROVIDING FOR SUBMISSION TO THE ELECTORATE OF THE
TERRITORY SOUGHT TO BE ANNEXED A PROPOSITION AUTHORIZING THE
INCLUSION WITHIN THE WHATCOM TRANSPORTATION BENEFIT AREA
AND THE IMPOSITION OF A SALES AND USE TAX AT THE RATE OF THREE
TENTHS OF ONE PERCENT (.003) OF THE SELLING PRICE (IN THE CASE OF A
SALES TAX) OR THE VALUE OF THE ARTICLE USED (IN THE CASE OF A USE
TAX) TO BE COLLECTED BY THE WHATCOM TRANSPORTATION
AUTHORITY.
WHEREAS, the Whatcom Transportation Authority (Authority) is a
public transportation benefit area (P.T.B.A.) created in accordance with the procedures
established by chapter 36.57A R.C.W.; and
WHEREAS, R.C.W. 36.57A.140 provides there shall be submitted to the
electorate of the areas sought to be annexed a proposition authorizing the inclusion of the
area within the P.T.B.A. and authorizing the imposition of such taxes authorized by law; and
WHEREAS, R.C.W. 82.14.045 authorizes a P.T.B.A. for the purpose of
providing funds for the operation, maintenance or capital needs of public transportation
systems to fix and impose sales tax provided that no such sales and use tax shall be imposed
without submitting such an authorizing proposition to the voters and obtaining approval of
a majority of persons thereon; and
WHEREAS, there has been public interest shown in extending the
boundaries of the Whatcom Transportation Benefit Area to include the City of Blaine,
Semiahmoo 1, Semiahmoo 2, Custer 1, Custer 2, Custer 3, Custer 4, Mt View 1, Mt. View 3,
Mt. View 4 and Ferndale Township 2, Ferndale Township 3, Ferndale Township 8, and Delta
3 election precincts as shown on the map attached hereto as Exhibit "A,"
BE IT FURTHER RESOLVED, that there shall be submitted on
March 8,1994, to the electorate of the above described areas to be annexed a proposition
authorizing the inclusion of the above described areas within the Whatcom Transportation
Benefit Area and authorizing the imposition of a sales and use tax at the rate of three tenths
of one percent (.003) of the selling price (in the case of a sales tax) or the value of the article
used (in the case of a use tax).

BE IT FURTHER RESOLVED, that the ballot titles for the respective
areas to be annexed be submitted to the Whatcom County Auditor and read substantially as
follows:
"Shall the area comprised of Whatcom County voting precincts: City of Blaine,
Semiahmoo 1, Semiahmoo 2, Custer 1, Custer 2, Custer 3, Custer 4, Mt. View 1,
Mt. View 3, Mt. View 4 and Ferndale Township 2, Ferndale Township 3, Ferndale
Township 8, and Delta 3 election precincts be annexed to the Whatcom
Transportation Benefit Area and shall the Authority be authorized to impose a
sales and use tax not to exceed three tenths of one percent (.003) for public
transportation.
