Last week we briefly discussed this matter on the phone and your office's role in assigning "ballot title" to items such as this (see Count Code Chapter 1.06.070). Enclosed please find a draft Petition for Annexation. The Resolution provides the initiative for an election. We expect this matter to be included on the next ballot either following an independent resolution of the Whatcom Transportation Authority Board or by petition of four percent (4%) of the registered voters residing within the two precincts above mentioned. As I explained, we would prefer that the matter come to the people through the efforts of the Whatcom Transportation Authority Board. And, by separate letter, we are requesting the Whatcom Transportation Authority Board to pass a resolution directing the Whatcom County Auditor to include the question regarding this proposed annexation and the imposition of the sales tax on the November 3, 1992 ballot as it may do in accordance with RCW Chapter 29.13,010. However, anticipating that the Whatcom Transportation Authority Board may not act, or not act in a timely manner, we will proceed with this petition process. Please review the enclosed draft Petition and advise me as to a proper 'ballot title." RESOLUTION 192-107 OF THE LUPP[I INDIAN BUSINESS COUNCIL WHEREAS, the Lummi Indian Business Council is the duly constitut- ed governing body of the Lummi Indian Reservation by the authori- ty of the Constitution and By -Laws of the Lummi Nation of the Lummi Reservation, Washington, as approved on April 10, 1970, by the Assistant Commissioner of Indian Affairs; and WHEREAS, the Lummi Reservation community includes both Indian and non -Indian residents who travel into the neighboring communities of Ferndale, Bellingham, and elsewhere in Whatcom County to work and play, to buy and sell, (including the payment of that portion of the applicable sales taxes collected by merchants within those neighboring communities for the Whatcom Tramsportation.Authority). and to carry out a myriad of other transactions; and WHEREAS, the Whatcom Transportation Authority operates an exten- sive public transportation system within a Public Transportation Benefit Area that presently does not include the Lummi Reserva- tion; and WHEREAS, the process of annexation includes a provision requiring that the area to be annexed must be contiguous to the existing boundaries of the Whatcom Transportation Authority; and WHEREAS, the precinct entitled Marietta #1 lies between the Lummi Reservation and the existing boundaries of the Whatcom Transpor- tation Authority; and WHEREAS, this resolution should in no way be construed as a compromise of Lummi national sovereignty or of Lummi jurisdiction within the external boundaries of the Lummi Reservation, and NOW THEREFORE BE IT RESOLVED, that the Lummi Indian Business Council formally requests the Whatcom Transportation Authority to resolve to undertake those actions necessary to annex the Lummi Reservation into the Public Transportation Benefit Area and fur- ther to provide comprehensive public transportation services to and from the Lummi Reservation; and BE IT FURTHER RESOLVED, that the Chairman (or the Vice Chairman in his absence) is hereby authorized and directed to execute this resolution and any documents connected therewith, and the Secre- tary (or the Recording Secretary in his absence) is authorized and directed to execute the following certification. However, the authority may, by resolution, designate some person having experience in financial or fiscal matters, other than the county auditor, as the auditor of the authority. Such an auditor shall possess all of the powers, responsibilities, and duties that the county auditor possesses for a public transportation benefit area authority related to creating and maintain- ing funds, issuing warrants, and maintaining a record of receipts and disbursements. The treasurer shall establish a "transportation fund," into which shall be paid all authority funds, and the treasurer shall maintain such special accounts as may be created by the authority into which shall be placed all money as the authority may, by resolution, direct. If the treasurer of the authority is a treasurer of the county, all authority funds shall be deposited with the county depositary under the same restrictions, contracts, and security as provided for county depositaries. If the treasurer of the authority is some other person, all funds shall be deposited in such bank or banks authorized to do business in this state that have qualified for insured deposits under any federal deposit insurance act as the authority, by resolution, shall designate. An authority may provide and require a reasonable bond of any other person handling moneys or securities of the authority, but the authority shall pay the pre- mium on the bond. The county or counties and each city or town which is included in the authority shall contribute such sums to- wards the expense for maintaining and operating the public transportation system as shall be agreed upon be- tween them. (1) An election to authorize the annexation of territory contigu- ous to a public transportation benefit area may be called within the area to be annexed pursuant to resolution or petition in the following manner: (a) By resolution of a public transportation benefit area authority when it determines that the best interests and general welfare of the public transportation benefit area would be served. The authority shall consider the question of areas to be annexed to the public transpor- tation benefit area at least once every two years. (b) By petition calling for such an election signed by at least four percent of the qualified voters residing within the area to be annexed and filed with the auditor of the county wherein the largest portion of the public transportation benefit area is located, and notice thereof shall be given to the authority. Upon receipt of such a petition, the auditor shall examine it and certify to the sufficiency of the signatures thereon. (c) By resolution of a public transportation benefit area authority upon request of any city for annexation thereto. (1989 Ed.) (2) The resolution or petition shall describe the boundaries of the area to be annexed. It shall require that there also be submitted to the electorate of the ter- ritory sought to be annexed a proposition authorizing the inclusion of the area within the public transportation benefit area and authorizing the imposition of such taxes authorized by law to be collected by the authority. [ 1983 c 65 § 5; 1975 1st ex.s. c 270 § 24.1 Severability—Effective date 1975 1st ex.s. a 270: See notes following RCW 35.58.272. 36.57A.150 Advanced financial support payments. Counties that have established a county transportation authority pursuant to chapter 36.57 RCW and public transportation benefit areas that have been established pursuant to this chapter are eligible to receive a one— time advanced financial support payment from the state to assist in the development of the initial comprehensive transit plan required by RCW 36.57.070 and 36.57A- .060. The amount of this support payment is established at one dollar per person residing within each county or public transportation benefit area, as determined by the office of financial management, but no single payment shall exceed fifty thousand dollars. Repayment of an advanced financial support payment shall be made to the public transportation account in the general fund or, if such account does not exist, to the general fund by each agency within two years of the date such advanced pay- ment was received. Such repayment shall be waived within two years of the date such advanced payment was received if the voters in the appropriate counties or pub- lic transportation benefit areas do not elect to levy and collect taxes enabled under authority of this chapter and RCW 35.95.040 and 82.14.045. The state department of transportation shall provide technical assistance in the preparation of local transit plans, and administer the advanced financial support payments authorized by this section. A public transportation benefit area established pursuant to this chapter may be dissolved and its affairs liquidated when so directed by a majority of persons in the benefit area voting on such question. An election placing such ques- tion before the voters may be called in the following manner: (1) By resolution of the public transportation benefit area authority; (2) By resolution of the county legislative body or bodies with the concurrence therein by resolution of the city council of a component city; or (3) By petition calling for such election signed by at least ten percent of the qualified voters residing within the area filed with the auditor of the county wherein the largest portion of the public transportation benefit area is located.
