Thank you for asking our office to draft ttte ballot title for the tax levy described in the
District's recent resolution. As per our conversation, I would offer the following draft for
your consideration. This version reflects the fact that last year the ley was actually
$.12473 Please advise if it is acceptable. If so, please nakc a note to that effect on this

A RESOLUTION of the Board of Directors of Point Roberts Park and Recreation District 41
Whatcom County, 'Washington, providing for the submission to the. Qualified electors of the district at the
General Election to be held therein on November 6 2001, a proposition of whether or not there should be
levied t!n excess tax of approximately $ ( . /t9,4'>cents) per thousand dollars of assessed valuation (based
on 1000/6 of true and ftur value) to provide $30,000 (thirty thousand dollars) for the districts General Fund
to pay the general expenses of maintenance and operation of the Point Roberts Park and Recreation District
# 1, such levy to made in 2001 and collection in 2002 and in 2003
WHEREAS, the money in :utd to be paid into the General Fund of the point Roberts Park and
Recreation District #1, Whatcom County, Washington, during 2002 and 2001 will be insufficient to enable
the district to teke care of all of its necessary financial obligations, and
WHEREAS, in order to properly pro�vtd�. for said operation and maintenance, it is deemed
necessary tlt<nt a tax of approximately $. ( /3�cenis) per"thousand dollars of assessed valuation (based
oil 1000/a of true and fair value) to provide $30,000 (thirty thousand dollars) for the districts General Fund
be levied upon all of the taxable property within the distract in excess of the maximum annual tax levy
permitted by law to be levied for the district without a vote of the electors, such levy to be made in 2001 for
collection in 2002 wid 2003; and
WHEREAS, the Constitution and laws of We State of Washington require that the question of
whether or notsuch excess tax may be levied must be submitted to the qualified electors of the district for
their ratification or rejection.
NOW, THEREFORE, BE IT RESOLVED by the Board of )Directors of Point Roberts Park and
Recreation District #1, Whatcom County, Washington, as follows
Section 1. It is hereby found ai.id declared that the welfare of the residents of the district requires
the district to carry out the plans hctebtafter provided.
Section 2. In order to provide $30,000 (thirty thousand dollars) for the General Ftund of the
Distr cts the district aulhotizes the County Council of Whatcom County to levy a tax of approximately $
( .)pO cents) per thousand dollars of assessed valuation (based on 100% of true and fair value) to be lcvicd
in 2001 for collection in 2002 and in 2003 upon a1J taxable property wilhin the District in excess of the
maximum annual tax levy be permitted by law to be levied for the District without a vote of the electors.
Upon approval by the voters of Proposition No, 1, hereinafter set forth, the district may use the
proceeds of such levy during 2002 and 2003 tax years, and may expend the proceeds of said levy to pay the
general expenses of maintenance and operations of 1he District as itwy be authori:Lc:d or allowed by law for
the use of excess levy funds.
Section It is hereby found and declared that an emergency exists requiring the submission to
the qualified electors of the district a proposition of whether or not such excess tart should be levied for
their ratification or rejection at the General Election to be held therein oil November 6. 2001
The Wlraiconi County Auditor as ex-officio supervisor of election in 'Whatcom County is herebl
requested to also find the existence of such emergency and to call and conduct said excess Icvy election to
be held within rite district on said date and to submit to the quAified electors of the district the proposition
hereinafter set forth.
The secretary of the Board of Directors is hereby authorized and directed to certify said
proposition in the following fork.-

your vote. Do not mark, fold or punch the
ballot punchcard except as outlined in the

* A pre -scored Ballot Punchcard.
* A Ballot security envelope for the Ballot

1. Remember to SIGN YOUR NAME on the outside
of the MAILING envelope on the line under the
Voter Affidavit. Your signature is compared to your
signature on file with the County.
2.In the Ballot Guide, to the right of each measure or
candidate, is a number which is assigned to a
position on your Ballot Card.
3. Use a paper clip, tooth pick or sharp pencil to
punch out the pre -scored square located just
above the number assigned to the candidate or
measure.
4. Write in candidates may be voted for by using the
space provided on the flap attached to your ballot
card. You must list both the Name and Office of the
write-in candidate and the Political Party in
Partisan races. Do not punch out a position
number for any other candidate for that office.
5.After you have finished voting, place your Ballot
Card in the Ballot Security Envelope.
6. Place the Ballot Security Envelope containing your
voted ballot punchcard INSIDE THE PRE -
ADDRESSED MAILING ENVELOPE.
7. Put a first-class stamp on the envelope and mail it
so it is gOstmarked no later than the day of the
election. The ballot will be counted if it is
postmarked not later than election day and if it is
received by the county auditor not later than the
tenth day following any special election or primary,
or the fifteenth day following a general election.
8. If you spoil your ballot or wish to change your vote,
use the BALLOT GUIDE and with a pen make
your selections. Return it in the Ballot Security
Envelope instead of the ballot card.

Initiative Measure No. 773 concerns additional tobacco taxes for low-
