Auditors WHATCOM COUNTY, WASHINGTON MAINTENANCE AND OPERATIONS LEVY RESOLUTION NO. 2 A RESOLUTION of the Board of Directors of Nooksack Valley School District No. 506, Whatcom County, Washington, providing for the submission to the qualified electors of the district at a special election to be held therein on February 5, 2002 of a proposition of whether an excess tax of $1,800,000 should be levied in 2002 for collection in 2003, whether an excess tax of $1,850,000 should be levied in 2003 for collection in 2004, said excess taxes being for the District's General Fund to pay part of the general expenses of maintenance and operation support of the District. WHEREAS, the District's current maintenance and operations levy expires in 2002; and WHEREAS, the money in and to be paid into the General Fund of Nooksack Valley School District No. 506, Whatcom County, Washington (the "District"), during the 2002-2003, 2003-2004 and 2004-2005 school years will be insufficient to enable the District to pay for necessary maintenance and operation expenses and to properly meet the educational needs of the students attending District schools; and WHEREAS, in order to properly provide for such maintenance and operation expenses and to meet such educational needs, the Board of Directors of Nooksack Valley School District No. 506, Whatcom County, Washington (the "Board of Directors"), deems it necessary to levy the following taxes for the District's General Fund upon all of the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied within the District without a vote of the electors: A. A tax of approximately $3.58 per one thousand dollars of assessed valuation to provide $1,800,000, said levy to be made in 2002 for collection in 2003; and B. A tax of approximately $3.66 per one thousand dollars of assessed valuation to provide $1,850,000, said levy to be made in 2003 for collection in 2004; and -1- WHEREAS, the Constitution and laws of the State of Washington require that the question of whether or not such excess taxes may be levied must be submitted to the qualified electors of the District for their ratification or rejection; NOW THEREFORE, BE IT RESOLVED by the Board of Directors of Nooksack Valley School District No. 506, Whatcom County, Washington, as follows: Section 1. The following taxes for the District's General Fund should be levied upon all of the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied within the District without a vote of the electors: A. A tax of approximately $3.58 per one thousand dollars of assessed valuation to provide $1,800,000, said levy to be made in 2002 for collection in 2003; and B. A tax of approximately $3.66 per one thousand dollars of assessed valuation to provide $1,850,000, said levy to be made in 2003 for collection in 2004; The estimated levy rates above depend upon the final dollar amount of assessed value of the property within the District and are based on information provided by the County Assessor's Office. Upon approval by the voters of Proposition No. 1 set forth below, the District may use the proceeds of said levies during the 2002-2003, 2003-2004 and 2004-2005 school years by incurring indebtedness by the issuance of short term obligations against the General Fund of the District, as authorized by RCW 39.50, and may expend the proceeds of said levies to pay such part of the general expenses of maintenance and operation of the District during such school years as may be authorized or allowed by law for the use of excess levy funds. Section 2. It is hereby found and declared that an emergency exists requiring the submission to the qualified electors of the District of the proposition or whether or not the District shall levy such excess taxes for their ratification or rejection at a special election to be held therein on February 5, 2002. -2- The Whatcom County Auditor, as ex officio supervisor of elections in Whatcom County, Washington, is hereby requested to find the existence of such an emergency and to call and conduct said special election to be held within the District on said date and to submit to the qualified electors of the District the proposition hereinafter set forth. Failure to follow these instructions may invalidate your ballot. The ballot which you have received is actually a data processing card prepared for recording your vote. Do not mark, fold or punch the ballot punchcard except as outlined in the instructions. Your Absentee Ballot Packet consists of: • This Ballot guide listing the ballot measures and/or candidates. • A pre -scored Ballot Punchcard. • A Ballot security envelope for the Ballot Punchcard. • A pre -addressed Return Envelope to return your voted Ballot Punchcard. Now that you have received your Absentee ballot, please use it instead of going to your poll site on election day. Remember to SIGN YOUR NAME on the outside of the MAILING envelope on the line under the Voter Affidavit. Your signature is compared to your signature on file with the County. 2. In the Ballot Guide, to the right of each measure or candidate, is a number which is assigned to a position on your Ballot Card. 3. Use a paper clip, tooth pick or sharp pencil to punch out the pre -scored square located just above the number assigned to the candidate or measure. 4. Write in candidates may be voted for by using the space provided on the flap attached to your ballot card. You must list both the Name and Office of the write-in candidate and the Political Party in Partisan races. Do not punch out a position number for any other candidate for that office. 5.After you have finished voting, place your Ballot Card in the Ballot Security Envelope. 6. Place the Ballot Security Envelope containing your voted ballot punchcard INSIDE THE PRE - ADDRESSED MAILING ENVELOPE. 7. Put a first-class stamp on the envelope and mail it so it is postmarked no later than the day of the election. The ballot will be counted if it is postmarked not later than election day and if it is received by the county auditor not later than the tenth day following any special election or primary, or the fifteenth day following a general election. 8. Using the voting stylus, record your vote by punching the hole indicated by the arrow for the candidate or measure of your choice. Continue turning the ballot pages and vote your selection of candidates or measures. Be certain that you vote all ballot pages. 3.
