RESOLUTION NO. 92/93-5
A RESOLUTION of the Board of Directors of Mount
Baker School District No. 507, Whatcom County,
Washington, providing for the submission to the
qualified electors of the District at the election
to be held therein on March 9, 1993 of the
proposition of whether or not there should be
levied an excess tax of approximately $.41 per
thousand dollars of assessed valuation (based on
100% of true and fair value unless specifically
otherwise provided by law) to provide $175,000 for
the School District's Transportation Vehicle Fund
to allow said District to purchase school busses,
such levy to be made in 1993 for collection in
1994. And whether there should be levied a further
excess tax of approximately $0.41 per thousand
dollars of assessed valuation (based on 100% of
true an fair value) to provide $175,000 for the
School District's Transportation vehicle fund to
allow said District to purchase school busses, such
levy to be made in 1994 for collection in 1995.
WHEREAS, the money in the Transportation Vehicle Fund of the
Mount Baker School District 507, Whatcom County, Washington, is
insufficient to enable the District to acquire the necessary
school busses to properly meet the transportation needs of the
students attending the District's schools, and that the
anticipated future funding from the State will be insufficient to
meet these needs; and
WHEREAS, due to the age and condition of certain busses of the
school fleet now being operated by the District, it will be
necessary for the District to purchase new busses to meet the
transportation needs of the District; and
WHEREAS, in order to properly provide for said transportation
needs of the District for the next three successive school years
(93/94, 94/95, 95/96), it is deemed necessary that a tax of
approximately $0.41 per thousand dollars of assess valuation
(based on 100% of true and fair value) to provide $175,000.00 for
the District's Transportation Vehicle Fund be levied upon all of
the taxable property within the District in excess of the maximum
annual tax

The Mount Baker School District is an Equal Opportunity Employer
levy permitted by law to be levied for the District without a
vote of the electors, such levy to be made in 1993 for collection
in 1994 and that a tax of approximately $0.41 per thousand
dollars of assessed valuation (based on 100% of true and fair
value) to provide $175,000.00 for the Districts Transportation
Vehicle Fund be levied upon all of the taxable property within
the District in excess of the maximum annual tax levy permitted
by law to be levied for the District without a vote of the
electors, such levy to be made in 1994 for collection in 1995;
and
WHEREAS, the Constitution and laws of the State of Washington
require that the question of whether or not such excess tax may
be levied must be submitted to the qualifed electors of the
District for their ratification or rejection,
NOW, THEREFOR, BE IT RESOLVED by the Board of Directors of the
Mount Baker School District No. 507, Whatcom County, Washington,
as follows:
Section 1. It is hereby found and declared that the welfare of
the children of the District requires it to carry out the plans
hereinafter provided.
Section 2. In order to provide $175,000 for the Transportation
Vehicle Fund of the District, a tax of approximately $.41 per
thousand dollars of assessed valuation (based on 100% of true and
fair value unless specifically otherwise provided by law) should
be levied in 1993 for collection in 1994 upon all of the taxable
property within the District in excess of the maximum annual tax
levy permitted by law to be levied for the District without a
vote of the electors, and that in order to provide $175,000.00
for the Transportation Vehicle Fund of the District, a tax of
approximately $0.41 per thousand of assessed valuation (based on
100% of true an fair value) should be levied in 1994 for
collection in 1995 upon all the taxable property within the
District in excess of the maximum annual levy permitted by law to
be levied for the District without a vote of the electors.
upon approval by the voters of Proposition No. 1 hereinafter set
forth, the District may use the proceeds of such levies during
the 1993/94, 1994/95 and 1995/96 school years by incurring an
indebtedness by the issuance of warrants against the
Transportation Vehicle Fund of the District for the purpose of
purchasing the school busses authorized by this Resolution.

Section 3. it is hereby found and declared that an emergency
exists requiring the submission to the qualifed electors of the
District of the proposition of whether or not there should be
levied such an excess tax for the purpose described herein at a
special election to be held herein on March 9, 1993.
The Whatcom County Auditor as ex officio supervisor of election
in Whatcom County is hereby requested to also find that such an
emergency exists and to call and conduct said special election to
be held within the District on that date and to submit to the
qualified electors of the District the proposition hereinafter
set forth.
The Secretary of the Board of Directors is hereby authorized and
directed to certify said proposition to the Whatcom County
Auditor in the following form:

hereby requested to take all procedural steps necessary and/or
required by law to the end that this proposition shall be
submitted to the voters in said School District.
