MAINTENANCE AND OPERATIONS LEVY
RESOLUTION NO. 12-03
A RESOLUTION of the board of Directors of Meridian School
District No. 505, Whatcom County, Washington, providing for
the submission to the qualified electors of the district at a special
election to be held therein on February 3, 2004 of a proposition
of whether an excess tax of $1,820,000 should be levied in 2004
for collection in 2005, and whether an excess tax of $1,875,000
should be levied in 2005 for collection in 2006, and whether an
excess tax of $1,930,000 should be levied in 2006 for collection
in 2007, and whether an excess tax of $1,990,000 should be
levied in 2007 for collection in 2008, said excess taxes being for
the District's General Fund to pay part of the general expenses of
maintenance and operation support of the District.
WHEREAS, the money in and to be paid into the General Fund of Meridian School
District No. 505, Whatcom County, Washington (the "District"), during the 2004-2005,
2005-2006, 2006-2007, 2007-2008, and 2008-2009 school years will be insufficient to enable
the District to pay for necessary maintenance and operation expenses and to properly meet
the educational needs of the students attending District schools; and
WHEREAS, in order to properly provide for such maintenance and operation expenses
and to meet such educational needs, the Board of Directors of Meridian School District No.
505, Whatcom County, Washington (the "Board of Directors"), deems it necessary to levy
the following taxes for the District's General Fund upon all of the taxable property within the
District in excess of the maximum annual tax levy permitted by law to be levied within the
District without a vote of the electors:
A. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,820,000, said levy to be made in 2004 for
collection in 2005; and

B. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,875,000, said levy to be made in 2005 for
collection in 2006; and
C. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,930,000, said levy to be made in 2006 for
collection in 2007; and
D. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,990,000, said levy to be made in 2007 for
collection in 2008; and
WHEREAS, the Constitution and laws of the State of Washington require that the
question of whether or not such excess taxes may be levied must be submitted to the
qualified electors of the District for their ratification or rejection;
NOW THEREFORE, BE IT RESOLVED by the board of Directors of Meridian School
District No. 505, Whatcom County, Washington, as follows:
Section 1. The following taxes for the District's General Fund should be levied upon
all of the taxable property within the District in excess of the maximum annual tax levy
permitted by law to be levied within the district without a vote of the electors:
A. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,820,000, said levy to be made in 2004 for
collection in 2005;
B. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,875,000, said levy to be made in 2005 for
collection in 2006;
C. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,930,000, said levy to be made in 2006 for
collection in 2007;
D. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,990,000, said levy to be made in 2007 for
collection in 2008;

Upon approval by the voters of Proposition No. 1 set forth below, the District may use
the proceeds of said levies during the 2004-2005, 2005-2006, 2006-2007, 2007-2008, and
2008-2009 school years by incurring indebtedness by the issuance of short term obligations
against the General Fund of the District, as authorized by RCW 39.50, and may expend the
proceeds of said levies to pay such part of the general expenses of maintenance and operation
of the District during such school years as may be authorized or allowed by law for the use of
excess levy funds.
Section 2. It is hereby found and declared that an emergency exists requiring the
submission to the qualified electors of the District of the proposition or whether or not the
District shall levy such excess taxes for their ratification or rejection at a special election to
be held therein on February 3, 2004.
The Whatcom County Auditor, as supervisor of elections in Whatcom County, Washington,
is hereby requested to find the existence of such an emergency and to call and conduct said
special election to be held within the District on said date and to submit to the qualified
electors of the District the proposition hereinafter set forth.
The Secretary of the Board of Directors is hereby authorized and directed to certify said
proposition to the Whatcom County Auditor as supervisor of elections in Whatcom County,
Washington, in the following form:

I'm led to believe that the laws of this state may again be being violated in the above referred to matter:
1. In that the District had the ability to make request for an election in this matter well before the statutorily indicated
"November General Election", and in fact indicated an intent to propose this levy before any deadlines for said
election date, by what authority or reason would you consider allowance of those specially created "Emergency"
dates?
2. In that the applicable RCW mandates that you "deem" that an emergency exists prior to allowing usage of
"Emergency" dates, please advise of the process you will utilize to ascertain or "deem" 9 you will, that an
emergency actually exists that necessitates your failure to protect the voters/taxpayers at large that will be impacted
by this election. (You are wel/aware that the reasoning for this apparent violation by the District is to circumvul7t

3. In light of the large percentage of this vote that historically takes place via "absentee" balloting, the bulk of which
are returned to your office even before you file the notice required of you in the law — what step do you intend to
take to comply with the notice requirements intern?
Basically, the above fisted are but the tip of the iceberg when it comes to the difference between strict compliance with the
law, and a usurpation of the duty you told to protect the constituency that will be herewith violated if you abandon your
Constitutionally mandated duty. As I have requested before, by virtue of what "written' statute, directive, or policy do you
consider waiving the expected protection of the majority as contemplated by the law? Please provide a copy of same! if it
be not available it would seem that you need do you duty and advise that the District th available date to place
the levy. before the voters would be November 9, 2004.
Further, it would seem to be part of your duties as the County Auditor, and your of ifiated responsibilities with the State, to
make whatever reports and/or pass on investigation results that might demonstrate the declaration of "Emergency` to be
fraudulent. This is not just an obligation of the local district taxpayers, but the State ends up with an additional obligation
due to State Levy Equalization funds. Timing is of the issue in this matter.

MAINTENANCE AND OPERATIONS LEVY
RESOLUTION NO. 12-03
A RESOLUTION of the board of Directors of Meridian School
District No. 505, Whatcom County, Washington, providing for
the submission to the qualified electors of the district at a special
election to be held therein on February 3, 2004 of a proposition
of whether an excess tax of $1,820,000 should be levied in 2004
for collection in 2005, and whether an excess tax of $1,875,000
should be levied in 2005 for collection in 2006, and whether an
excess tax of $1,930,000 should be levied in 2006 for collection
in 2007, and whether an excess tax -of $1,990,000 should be
levied in 2007 for collection in 2008, said excess taxes being for
the District's General Fund to pay part of the general expenses of
maintenance and operation support of the District.
WHEREAS, the money in and to be paid into the General Fund of Meridian School
District No. 505, Whatcom County, Washington (the "District"), during the 2004-2005,
2005-2006, 2006-2007, 2007-2008, and 2008-2009 school years will be insufficient to enable
the District to pay for necessary maintenance and operation expenses and to properly meet
the educational needs of the students attending District schools; and
WHEREAS, in order to properly provide for such maintenance and operation expenses
and to meet such educational needs, the Board of Directors of Meridian School District No.
505, Whatcom County, Washington (the "Board of Directors"), deems it necessary to levy
the following taxes for the District's General Fund upon all of the taxable property within the
District in excess of the maximum annual tax levy permitted by law to be levied within the
District without a vote of the electors:
A. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,820,000, said levy to be made in 2004 for
collection in 2005; and

B. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,875,000, said levy to be made in 2005 for
collection in 2006; and
C. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,930,000, said levy to be made in 2006 for
collection in 2007; and
D. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,990,000, said levy to be made in 2007 for
collection in 2008; and
WHEREAS, the Constitution and laws of the State of Washington require that the
question of whether or not such excess taxes may be levied must be submitted to the
qualified electors of the District for their ratification or rejection;
NOW THEREFORE, BE IT RESOLVED by the board of Directors of Meridian School
District No. 505, Whatcom County, Washington, as follows:
Section 1. The following taxes for the District's General Fund should be levied upon
all of the taxable property within the District in excess of the maximum annual tax levy
permitted by law to be levied within the district without a vote of the electors:
A. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,820,000, said levy to be made in 2004 for
collection in 2005;
B. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,875,000, said levy to be made in 2005 for
collection in 2006;
C. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,930,000, said levy to be made in 2006 for
collection in 2007;
D. A tax of approximately $3.26 per one thousand dollars of assessed
valuation to provide $1,990,000, said levy to be made in 2007 for
collection in 2008;

Upon approval by the voters of Proposition No. 1 set forth below, the District may use
the proceeds of said levies during the 2004-2005, 2005-2006, 2006-2007, 2007-2008, and
2008-2009 school years by incurring indebtedness by the issuance of short term obligations
against the General Fund of the District, as authorized by RCW 39.50, and may expend the
proceeds of said levies to pay such part of the general expenses of maintenance and operation
of the District during such school years as may be authorized or allowed by law for the use of
excess levy funds.
Section 2. It is hereby found and declared that an emergency exists requiring the
submission to the qualified electors of the District of the proposition or whether or not the
District shall levy such excess taxes for their ratification or rejection at a special election to
be held therein on February 3, 2004.
The Whatcom County Auditor, as supervisor of elections in Whatcom County, Washington,
is hereby requested to find the existence of such an emergency and to call and conduct said
special election to be held within the District on said date and to submit to the qualified
electors of the District the proposition hereinafter set forth.
The Secretary of the Board of Directors is hereby authorized and directed to certify said
proposition to the Whatcom County Auditor as supervisor of elections in Whatcom County,
Washington, in the following form:
