RESOLUTION NO. 8-89
A resolution of the Board of Directors of Lynden School`..'
District #504, Whatcom County, Washington, providing for
the submission to the qualified electors of the District
at a special election to be held therein on February 6,
1990, of the proposition of whether or not there should
be levied an excess tax of approximately $2.53 per
thousand dollars of assessed valuation (based on 100% of
true and fair value) to provide $845,000 for the
District's General Fund to pay part of the general
expenses of maintenance and operation of the District,
such levy to be made in 1990 for collection in 1991 and
whether there should be levied a further excess tax of
approximately $2.55 per thousand dollars of assessed
valuation (based on 100% of true and fair value) to
provide $895,000 for the District's General Fund to pay
part of the general expenses of maintenance and operation
of the District, such levy to be made in 1991 for
collection in 1992.
WHEREAS, the money in and to be paid into the General Fund of
Lynden School District #504, Whatcom County, Washington, during the
1990-91 and 1991-92 and 1992-93 school years will be insufficient
to enable the District to take care of all of its necessary
financial obligations and to properly meet the educational needs
of students attending the District's schools; and
WHEREAS, in order to properly provide for said financial
obligations and educational needs of the District for the next two
successive school years, it is deemed necessary that a tax of
approximately $2.53 per thousand dollars of assessed valuation
(based on 100% of true and fair value) to provide $845,000 for the
District's General Fund be levied upon all of the taxable property
within the District in excess of the maximum annual tax levy
permitted by law to be levied for the district without a vote of
the electors, such levy to be made in 1990 for collection in 1991
and that a tax of approximately $2.55 per thousand dollars of
assessed valuation (based on 1000 of true and fair value) to
provide $895, 000 for the District's General fund be levied upon all
of the taxable property within the District in excess of the
maximum annual tax levy permitted by law to be levied for the
District without a vote of the electors, such levy to be made in
1991 for collection in 1992 and
WHEREAS, the Constitution and laws of the State of Washington
require that the question of whether or not such excess tax may be
levied must be submitted to the qualified electors of the District
for their ratification or rejection,
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Lynden
School District #504, Whatcom County, Washington, as follows:
Section 1. It is hereby found and declared that the welfare
of the students and other residents of the District requires the
District to carry out the plans hereinafter provided.
Section 2. In order to provide $845,000 for the General Fund
of the District, a tax of approximately $2.53 per thousand dollars
of assessed valuation (based on 100% of true and fair value) should
be levied in 1990 for collection in 1991 upon all the taxable
property within the District in excess of the maximum annual tax
levy permitted by law to be levied for the District without a vote
of the electors and that in order to provide $895,000 for the
General Fund of the District, a tax of approximately $2.55 per
thousand of assessed valuation (based on 100% of true and fair
value) should be levied in 1991 for collection in 1992 upon all the
taxable property within the District in excess of the maximum
annual tax levy permitted by law to be levied for the District
without a vote of the electors.
Upon approval by the voters of Proposition No. 1 hereinafter set
forth, the District may use the proceeds of such levies during the
1990-91, 1991-92, and 1992-93 school years by incurring an
indebtedness by the issuance of warrants against the General Fund
of the District, and may expend the proceeds of said levies to pay
such part of the general expenses of maintenance and operations of
the District as may be authorized or allowed by law for the use of
excess levy funds.
Section 3. It is hereby found and declared that an emergency
exists requiring the submission to the qualified electors of the
District of the proposition of whether or not such excess taxes
should be levied in 1990-91 for their ratification or rejection at
a special election to be held herein on February 6, 1990.
The Whatcom County Auditor as ex officio supervisor of elections
in Whatcom County is hereby requested to also find the existence
of such emergency and to call and conduct said special election to
be held within the District on said date and to submit to the
qualified electors of the District the proposition hereinafter set
forth.
The Secretary of the Board of Directors is hereby authorized and
directed to certify said proposition in the following form:

levied for Lynden School District's General Fund upon all taxable
property within the District: approximately $2.53 per $1,000.00
assessed value (based on 100% of true and fair value) to provide
$845,000 for 1991 collection; and approximately $2.55 per $1,006.00
assessed value (based on 100% of true and fair value) to provide
$895, 00dfor the 1992 collection as specified in District Resolution
No. 8-89.

ADOPTED by the Board of Directors of Lynden School District #504,
Whatcom County, Washington, at a regular open public meeting
thereof, held December 18, 1989, the following directors being
present and voting therefor.
