RESOLUTION 2004-01
A RESOLUTION of the Board of Commissioners of the Lynden Regional Park and
Recreation District # 3, Whatcom County, Washington, providing for the submission to the
qualified electors of the district at the General Election to be held therein on November 2, 2004,
a proposition of whether or not there should be levied a tax of $0.10 (ten cents) per thousand
dollars of assessed valuation (based on 100% of true and fair value) for the Districts General
Fund to pay the general and necessary expenses of maintenance and operations of the Lynden
Regional Park and Recreation District # 3, such levy to be made in 2004 and collection in 2005,
2006, 2007 and 2008.
WHEREAS, in order to properly provide for said operations and maintenance, it is deemed
necessary that a tax of $0.10 (ten cents) per thousa 611ars of as d valuation (based on
100% of true and fair value) for the Districts en GI Fund be levied upon all of the taxable
property within the district as permitted by law be levied by the District such levy to be
made in 2004 for collection in 2005, 2006, 2007 nd 2008; and
WHEREAS, The Constitution and laws of the State of Washington require that the question
of whether or not such a tax may be levied must be submitted to the qualified electors of the
district for their ratification or rejection.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Lynden
Regional Park and Recreation District # 3, Whatcom County, Washington. As follows,
Section One. It is hereby found and declared that the welfare of the residents of the
district requires the district to carry out the plans hereinafter provided.
Section Two. In order to provide funds for the General Fund of the District, the district
authorizes the County of Whatcom to levy a tax of $0.10 (ten cents) per thousand dollars of
assessed valuation (based on 100% of the true and fair value) to be levied in 2004 for
collection in 2005, 2006, 2007 and 2008 upon the taxable property within the District.
Upon approval of the voters of Proposition No. 1, hereinafter set forth, the district may use
the proceeds of such levy during 2005, 2006, 2007 and 2008 tax years, and may expend the
proceeds of said levy to pay the general and necessary expenses of maintenance and
operations of the District as may be authorized or allowed by law for use of levy funds.
The Whatcom County Auditor as ex-officio supervisor of elections within Whatcom County is
hereby requested to find the need to call and conduct said levy election to be held within the
district on said date and submit to the qualified electors of the district the proposition
hereinafter set forth.
The President of the Board of Commissioners is hereby authorized and directed to certify
said proposition in the following form:

Park & Recreation District Tax Levies
Note: difference between a "Park and Recreation District" under Chapter 36.69 RCW
(the "Recreation Districts Act"), verses the "Park and Recreation Service Area" under
Chapter 36.68 RCW. It looks like they operate the same, but the legislature has phased
out the District in favor of the Service Area. But check out the purposes, the two may be
different in purposes. Although it looks like the taxing abilities are the same.
For District under Chapter 36.69 RCW:
RCW 36.69.140 authorizes levies, up to six year in length are authorized under RCW
36.69.145.

Constitutional Constraints:
It looks like Art. 7, Sec. 2 would limit EXCESS tax levies to ONE year in duration
(except for schools that can go up to 6 years in duration). I say this because the section
provides the levy question must be "submitted not more than twelve months prior to the
date on which the proposed levy is to be made."
§ 84.52.010. Taxes levied or voted in specific amounts -- Effect of constitutional and
statutory limitations -- Use of hypothetical levy. Except as is permitted under RCW
84.55.050, all taxes shall be levied or voted in specific amounts....
As to the duration of the Excess vs. the Regular Property Taxes, see below exchange of
emails on the question:
Last year, the constitution was amended to allow fire protection districts
to have excess levies that exceed 1 year. RCW 84.52.130 provides the
specifics for fire protection district excess levies.
Other than schools and fire districts, all other excess levies are limited
to one year. Voter approved regular levies (like those authorized in RCW
36.69.145) are limited by the language of the specific statute -- in this
case six years.

I am trying to sort out some differences between "excess" and "regular"
property tax election issues/ballot titles, for a Park and Recreation
District. It looks to me like Wa. Const. Art. 7, Sec. 2 would limit the
duration of an "excess" levy to one year, because (except for schools) such
a levy question must be "submitted not more than twelve months prior to the
date on which the proposed levy is to be made." Hence, for "excess" levies,
the district would have to put them on the ballot once a year.
In contrast, for "regular" tax levies, since they are not over that Art. 7,
Sec. 2 limit, the legislature has allowed the districts to impose these
taxes for 6 consecutive years at a single election, per RCW 36.69.145(1).
I am trying to figure this one out because I have a district wanting to
impose an excess levy for a period of more than one year by a single ballot
question. Oh, RCW 36.69.140(1) prescribes that for "excess levies" they are
to be made per Art. 7, Sec. 2. I am thinking that I may have missed a
constitutional amendment that alters that 12 month time span of Art. 7, Sec.
2.

necessary that a tax of $0.10 (ten cents) per thousand dollars of assessed valuation (based on
100% of true and fair value) for the Districts General Fund be levied upon all of the taxable
property within the district as permitted by law to be levied by the District, such levy to be
made in 2004 for collection in 2005, 2006, 2007 and 2008; and
WHEREAS, The Constitution and laws of the State of Washington require that the question
of whether or not such a tax may be levied must be submitted to the qualified electors of the
district for their ratification or rejection.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Lynden
Regional Park and Recreation District # 3, Whatcom County, Washington. As follows,
Section One. It is hereby found and declared that the welfare of the residents of the
district requires the district to carry out the plans hereinafter provided.
Section Two. In order to provide funds for the General Fund of the District, the district
authorizes the County of Whatcom to levy a tax of $0.10 (ten cents) per thousand dollars of
assessed valuation (based on 100% of the true and fair value) to be levied in 2004 for
collection in 2005, 2006, 2007 and 2008 upon the taxable property within the District.
Upon approval of the voters of Proposition No. 1, hereinafter set forth, the district may use
the proceeds of such levy during 2005, 2006, 2007 and 2008 tax years, and may expend the
proceeds of said levy to pay the general and necessary expenses of maintenance and
operations of the District as may be authorized or allowed by law for use of levy funds.
The Whatcom County Auditor as ex-officio supervisor of elections within Whatcom County is
hereby requested to find the need to call and conduct said levy election to be held within the
district on said date and submit to the qualified electors of the district the proposition
hereinafter set forth.
The President of the Board of Commissioners is hereby authorized and directed to certify
said proposition in the following form:
