I have reviewed your memorandum of July 15, 1991,
concerning the above —referenced matter in which you state your
intention to include on the ballot all candidates for
commissioner of Water District No. 10 regardless of their
geographic location within the District. I agree that this the
correct approach for your office to take. Until Substitute
Senate Bill 5156 becomes effective on July 1, 1992, the
Auditor should not try to screen candidates filing for office
to determine if they reside in the appropriate district.
I do encourage you to inform anyone filing for the
commissioner post in Water District No. 10 that in light of
Resolution No. 532, if they do not live within the newly
created commissioner district subject to the election, they
may be removed from office if elected. If you have any
questions or wish to discuss this matter further, please let
me know.

Resolution to Establish Commissioner
Districts Within Water District No. 10
Boundaries
WHEREAS, commissioners are currently elected at large by
the registered voters within Water District No. 10 and,
WHEREAS, the Board of Commissioners of Water District No.
10 feel that it is in the best interest of the District to
establish commissioner districts and,
WHEREAS, the formation of commissioner districts is allowed
under R.C.W. 57.12.039,
NOW THEREFORE BE IT RESOLVED that the following
commissioner districts be formed and shall be effective
beginning with the 1991 primary election:
Commissioner
District #: Precincts:
1 Valley East and Valley West
2 Geneva 1, Geneva 2 and Lake
3 Park 1, Park and Glenhaven
AND BE IT FURTHER RESOLVED that the 1991 election shall be
for Commissioner District No. 1, the 1993 election shall be for
Commissioner District No. 2 and the 1995 election shall be for
Commissioner District No. 3.

Commissioner District #3 should read Park 1, Park 2 and
Glenhaven. The number 2 was inadvertently left out on
the original resolution.

WHATCOM COUNTY WATER DISTRICT )
NO.10 )
WHEREAS, the returns of the election for the formation of a
Water District at Lake Whatcom have been duly canvassed, and
WHEREAS, of the votes cast on the proposition for the formation
of the Water District, 451 votes were cast in favor of the organization
of said District and 30 votes were cast against the same; that of the
votes cast on the proposition authorizing the Water District to levy
a general tax of five mills for one year for general preliminary
expenses of the District, 432 votes were cast in favor of the levy
and 45 votes were cast against the levy, said vote being a majority
of three -fifths of the electors thereof voting on the proposition and
being not less than forty percent of the total number of votes cast
in the District at the last preceding general State election held
therein, as provided in R.C.W_ 57.04 050.
NOW, THEREFORE, BE IT RESOLVED that Whatcom County Water District
No. 10, is now a duly organized water district under the laws of the
State of Washington, with boundaries established and defined in
"EXHIBIT A" attached hereto and made a part of this Resolution,
BE IT FURTHER RESOLVED that the following are the duly elected
