This will acknowledge receipt by this Office of your letter of September
10, 1973, regarding the above -captioned examination report. I'm delighted to
D hear that Judge Boldt gave the parties a day of respite from that horrendous
trial in Tacoma. I'm sure that the "break" was well appreciated by the
parties, and just as much deserved.
Your letter advises that immediately upon the release of the examination
report in September, 1972, the Commissioners closed out the three bank accounts
which the district had been maintaining, and that since that time all district
funds have been deposited with the County Treasurer. Accordingly, we shall
close our files on this matter. In view of the fact that the relations be-
tween the district and Sudden Valley, Inc. had been closed out by my letter
to you of September 6, 1973, we now consider the file to be completely closed.
I an taking the liberty of directing a copy of this letter to Bill
Gardiner, Deputy Prosecuting Attorney, for whatever use it may be to him in
the context- of --advising the County Auditor and ex officio elections super-
visor vis-a-vis the pending recall action against two of the district com-
missioners.
We appreciate your cooperation, and that of the district and County
officials involved, in the resolution of these matters.

demand the recall of Chester Young, loth 'Water District Commissioner.
We demand the recall and removal from office of Chester Young, Com-
missioner for Water District No. 10, for committing the following
acts of misfeasance, malfeasance and violation of his oath of office:
1. That acting as a Commissioner for Water District No. 10,
he did knowingly and willfully sign and vote in support of a con-
tract between the loth Water District and Sudden Valley, Inc.
dated November 3, 1971, even though said contract provides for a
method of raising Water District revenue in violation of Washington
law, and said contract will allow Sudden Valley, Inc. the use and
benefit of a sewer trunk and interceptor system without requiring
Sudden Valley, Inc. to pay its fair share of the cost of said
system.
2. That acting as a Commissioner for the loth 'Hater District,
he disregarded recommendations of the R. W. Beck engineering firm,
the CH2M engineering firm, and the Bellingham City Enr7ineer, and
voted to build a sewer system that was partial to the -interests
of Sudden Valley, Inc. and detrimental to the loth Water District.
3. That acting as a Commissioner for Water District No. 10,
he failed to establish procedures and. adopt rules governing the
transaction of Water District business in contravention of R.C.W.
57.12.010.
4. That acting as a Commissioner for Water District No. 10,
he permitted maintenance of three checking accounts outside the
custody of the County Treasurer for which no receipts or remittance
advises were made available for inspection, nor claim vouchers for
vendors' invoices available to substantiate expenditures, in con-

Dear Mr. Gardiner:
On Friday, August 24, I received the ballot synopsis for the
recall of the above mentioned Water District commissioners.
In the interests of accuracy, I believe the synopsis should be
revised, and I am requesting that your office make a few changes
on the synopsis.
First, I wish to withdraw the last charge regarding the compre-
hensive plan. After reviewing the matter, I have discovered I
was in error regarding the comprehensive plan and wish to with-
draw this charge.
Secondly, you will note in the demand for recall that I did not
allege that Faye Dixon signed the contract with Sudden Valley,
but rather he voted in support of this contract. Accordingly,
I request that you change the phrase "signed and voted for" to
read he "voted in support of".
Thirdly, in the ballot synopsis for Chester Young, you apparently
inadvertently omitted the clause "which violated law as to method
of raising district revenue". This clause is in the synopsis for
Faye Dixon and is a charge in the demand for recall for Chester
Young, which I submitted to the County Auditor. Accordingly, I
request that this clause be inserted.
Except for these relatively minor changes, I am satisfied with
the ballot synopsis.
If you require that I submit a formal letter to the County Audi-
tor requesting these changes, please so advise me.

Assistant Attorney General, Donald Foss, Jr., has called my attention
to the fact that the office of the Attorney General has the exclusive perog&ive
regarding institution of legal action concerning alleged malfeasance, misfeas-
ance or nonfeasance of a public office predicated upon findings of the state
auditor's examination into the financial affairs of public officers.
By letter dated September 6, 1973, (a copy of which appears to have
been mailed to you) Mr. Foss, advised that the Attorney General has closed
his file on question of possible excessive reimbursement arising out of inter-
pretation of a contract between the Water District Board and Sudden Valley,
Inc. The Water District's attorney has sent a letter to the Assistant Attorney
General of September 10, 1973, confirming the deposit of all district funds
with the County Treasurer shortly after receipt of the examiner's report.
Accordingly, I assume the Attorney General's office finds no malfeasance,
misfeasance or nonfeasance by Water District #10 Commissioners on the
matters questioned in the Auditor's report. This requires me to advise you
that your charges Nos. 1, the first section of No. 2 and No. 4 are not, there -
fore, legally sufficient to support recall. You have already determined to
delete charge No. 5.
Standing alone, I doubt that charges No. 2 and 3 are sufficient to meet
the constitutional requirements for recall. The ballot synopsis previously
given you must,, therefore, be withdrawn and is not to be used in any nianrer.

It would seem that Mr. Edwards intends to initiate
recall proceedings against the two named Water District

would appear that the verification required by statute
is lacking.
The statute states that the legal voter or committee
desiring recall prepare a typewritten charge reciting the
acts of malfeasance or misfeasance while in office or
violations of his oath of office or that he has been

contract and District's Resolution #109, dated Nov. 3, 1971, set up
conditions under which Sudden Valley, in addition to getting a free
intercepter, could accrue an amount far in excess of their original
"loan" at the expense of District #10 and Federal tax -payers. This
violated his oath of office to "impartially perform the dutties of
office --".
(B) The commission, di sreggrding the recommendations
of R. W. Beck and CH2M, tvao of Washington's most respected engineering
firms, built an inadequate intercepter.
(0) The commission has consistently failed to adopt
an Administrative Code which would have prevented the District from
perpetual encucnb eranc a (maint ai nanc a and repair) by Sudden Valley's
sub -standard internal collection system.
(D) The co:rilnission had three checking accounts outside
the custody of the County Treasurer. For these, there were no receipts
or remittance advices available for inspection; nor were there claim
vouchers for vendors' invoices available to substantiate expenditures,
in contravention of iiN 57.20.140.
(E) The district maintained no minutes,.of commissioners'
meetings from district's inception (Nov. 1968) until Aug. 8, 1969,
Subsetiuently minutes of meetings were uj}signed. Meetings were
conducted with no consideration of "Robert' a Rules of Order". This
led to a law -suit (Bee prosecuting Attorney Versus Young file #46630).
This showed a lack of true and faithful performance of the Commissioner's

Dear Mr. Edwards:
This is your notice that the enclosed two sheets
contain the ballot synopsis, respectively, for your
petitions to recall commissioners Dixon and Young.
I have attached the respective ballot synopsis to
each of your revised charges (dated August 17, 1973),
and delivered them to Wella Hansen, County Auditor as
county supervisor of elections.
Hereafter the charges are to be designated by the
ballot synopsis on all petitions, ballots, and other
proceedings undertaken by you for recall of these
commissioners respectively.
You are now in position to take such further pro-

This is a revised demand for recall, which we are submitting to
demand the recall of Faye Dixon, loth Water District Commissioner.
We demand the recall and removal from office of Faye Dixon, Com-
missioner for Water District No. 10, for comitting the follow-
ing acts of misfeasance, malfeasance and violation of his oath
of office:
1. That acting as a Commissioner for Water District No. 10,
he did knowingly and willfully vote in support of a contract
between the loth Water District and Sudden Valley, Inc. dated
November 3, 1973, even though said contract provides for a method
of raising Water District revenue in violation of Washington law,
and said contract will allow Sudden Valley, Inc. the use and bene-
fit of a sewer trunk and interceptor system without requiring
Sudden Valley, Inc. to pay its fair share of the cost of said
system.
2. That acting as a Commissioner for Water District No. 10,
