NO - 180 4 canvass 4F at i _ •T• aj• • L-3 ` to :t - STArt OF having been completed this 23rd day of November, WHATCOM COUNTY CANVASSING BOARD County Au itor County Legislative Au hor' oun Deputy Prosecuting Attorney Y SKAGIT COUNTY PUBLIC HOSPITAL DISTRICT NO. 304 SKAGIT COUNTY, WASHINGTON RESOLUTION NO. 1055 A RESOLUTION of the Board of Commissioners of Public Hospital District No. 304, Skagit County, Washington, providing for the submission to the qualified electors of the district at a special election to be held on November 8, 1994, of two propositions, one an advisory proposition on disaffiliation from Public Hospital District No. 1 and the other a proposition, contingent upon passage of the advisory proposition, to impose tax levies in excess of the 106 percent limitation established in Chapter 84.55 RCW in order to provide funds for operation of an emergency room and limited inpatient beds at United General Hospital, with the possibility of additional annual special tax levies. WHEREAS, the residents of Skagit County Public Hospital District No. 304 ("the District") have a continuing need for accessible, convenient and affordable hospital and related medical services; and WHEREAS, the District has participated in an Affiliation Agreement with the adjacent Public Hospital District No. 1 to form Affiliated Health Services; and WHEREAS, the purpose of the affiliation was to reduce hospital operating costs and obtain operating efficiencies in order for the District to continue to provide accessible, convenient and affordable hospital and related medical services to its residents; and WHEREAS, after affiliation the Joint Operating Board of Affiliated Health Services determined that it believed it was no longer feasible to operate United General Hospital as an acute care hospital with an emergency room and consolidated those functions at Skagit Valley Hospital; and WHEREAS, the discontinuation of inpatient and emergency room services at United General Hospital generated a public controversy among residents of the District; and ,., W!4EREAS, some residents of the District have expressed their dissatisfaction with the current status of United General Hospital and have expressed interest in restoring limited inpatient and emergency room services at the hospital; and WHEREAS, a majority of the Joint Operating Board of Affiliated Health Services has been unwilling to restore limited hospital and emergency room services at United General Hospital; and WHEREAS, the District wants to ascertain the will of District residents about whether to continue the affiliation with Hospital District No. 1 or to disaffiliate and restore (1) the District's independent status, and (2) limited inpatient and emergency room services at United General Hospital; and WHEREAS, the will of District residents can be ascertained by an advisory vote on the question of whether the District should disaffiliate from Affiliated Health Services; and WHEREAS, the Commissioners of the District anticipate that, if the District disaffiliates from Public Hospital District No. 1, the operating and capital costs of operating United General Hospital independently and on a limited basis may exceed hospital revenues and funds available to the District from the regular levy at current rates; WHEREAS, if the District disaffiliates, the District has determined it may be necessary to impose additional taxes within the limits permitted to public hospital districts as authorized under RCW 70.44.060; and WHEREAS, RCW 70.44.060(6) authorizes the voters of a public hospital district to levy regular property taxes up to an aggregate total of $.75 per thousand dollars of assessed valuation upon approval of the voters; and 2 WHEREAS, Chapter 84.55 RCW establishes a levy limitation, which may be lifted upon approval of the voters; and WHEREAS, the conditions here and above set forth create an emergency which requires the holding of a special election in the District; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF SKAGIT COUNTY PUBLIC HOSPITAL DISTRICT NO.304, SKAGIT COUNTY, WASHIN.GTON as follows: SECTION 1. It is hereby found and declared that the health, safety and welfare of District residents require the District to determine whether its residents want to disaffiliate from Public Hospital District No. 1 and to offer emergency room and limited inpatient services at United General Hospital. SECTION 2. It is hereby found and declared that, if the District disaffiliates from Public Hospital District No. 1, the operating and capital costs of operating United General Hospital independently and on a limited basis may exceed hospital revenues and funds available to the District from the regular levy at current rates. SECTION 3. It is hereby found and declared that an emergency exists requiring the submission to the qualified electors of the District the following propositions for their ratification or rejection at a special election to be held on November 8, 1994: (1) An Advisory Proposition whether the District shall disaffiliate from Public Hospital District No. 1 and, upon disaffiliation, offer emergency room and limited inpatient services at United General Hospital, even if the offering of such services may require increasing the District's regular property taxes from $.2221 per $1,000 in assessed value to the legal maximum of $35 per $1,000 of assessed value and may occasionaly need a special tax levy requiring a J• voter approval; and (2) If the residents approve the Advisory Proposition and the District f and Hospital District No. 1 vote for disaffiliation; shall the District levy regular property taxes of up to $.75 per thousand dollars of assessed valuation, which is in excess of the limitations established in Chapter 84.55 RCW. For the purpose of providing funds necessary for the needs described in Section 2 above, the Skagit County Auditor and Whatcom County Auditor are hereby requested to find the existence of such an emergency and to call and conduct such special election to be held within the District on such day and to submit to the qualified electors of the District for their approval or rejection, the two propositions described above. SECTION 4. The Secretary of the Board of Public Hospital District Commissioners for the District is hereby authorized and directed to certify to the Skagit County Auditor, as ex-officio Supervisor of Elections in Skagit County, and to the Whatcom County Auditor, as ex-officio Supervisor of Elections in Whatcom County, an advisory ballot measure in the following form: ADVISORY PROPOSITION No. 1 SKAGIT COUNTY PUBLIC HOSPITAL DISTRICT NO. 304 DISAFFILIATION Shall Hospital District #304 seek to terminate the Affiliation Agreement with Hospital District #1 and, upon disaffiliation, operate United General Hospital with emergency room and limited inpatient hospital services, even if such operations may require increasing regular property taxes from $.2221 per $1,000 in assessed value to the legal maximum of $.75 per $1,000 of assessed value, and may occassionaly need a special tax levy requiring voter approval? In the same election during which voters vote on the advisory proposition to disaffiliate from Public Hospital District No. 1, the voters shall determine by vote whether to increase regular property taxes from the current level of $.2221 per thousand of assessed value to $.75 per thousand of assessed value, the legal maximum established in RCW 70.44.060(6), such increase in regular taxes to be contingent upon an affirmative vote in favor of the advisory proposition and a subsequent vote by a majority of the Boards of Commissioners for both the District and Public Hospital District No. 1 to terminate the Affiliation Agreement, such vote to occur prior to the tax levy. SECTION 6. The Secretary of the Board of Public Hospital District Commissioners is hereby authorized and directed to certify to the Skagit County Auditor, as ex-officio Supervisor of Elections in Skagit County, and to the Whatcom County Auditor, as ex-officio Supervisor of Elections in Whatcom County, the following proposition in the following form: PROPOSITION NO. 2 SKAGIT COUNTY PUBLIC HOSPITAL DISTRICT NO. 304 PROGRAM LEVIES If Proposition #1 is approved, and if Hospital District #304 and Hospital District #1 vote to disaffiliate, shall Hospital District #304 increase the levy lid on regular property taxes to exceed the 106 percent legal limit, and increase regular property taxes from $.2221 per $1,000 of assessed value up to a maximum of $.75 per $1,000 assessed value, as authorized by RCW70.44.060(6) and RCW84.55.050, on taxable property within Hospital District #304, for collection in 1995?
