Remember to SIGN YOUR NAME on the outside of the MAILING envelope on the line under the Voter Affidavit. Your signature is compared to your signature on file with the County. 2. In the Ballot Guide, to the right of each measure or candidate, is a number which is assigned to a position on your Ballot Card. 3. Use a paper clip, tooth pick or sharp pencil to punch out the pre -scored square located just above the number assigned to the candidate or measure. 4. Write in candidates may be voted for by using the space provided on the flap attached to your ballot card. You must list both the Name and Office of the write-in candidate and the Political Party in Partisan races. Do not punch out a position number for any other candidate for that office. 5. After you have finished voting, place your Ballot Card in the Ballot Security Envelope. 6. Place the Ballot Security Envelope containing your voted ballot punchcard INSIDE THE PRE -ADDRESSED MAILING ENVELOPE. 7. Put a first-class stamp on the envelope and mail it so it is postmarked no later than the day of the election. The ballot will be counted if it is postmarked not later than election day and if it is received by the county auditor not later than the tenth day following any special election or primary, or the fifteenth day following a general election. 8. If you spoil your ballot or wish to change your vote, use the BALLOT GUIDE and with a pen make your selections. Return it in the Ballot Security Envelope instead of the ballot card. 9. Frakes, Civil Deputy Prosecuting Attorney RE: Glacier Water District Annexation DATE: June 30, 1997 After reviewing the pertinent statutes, I have concluded that the water district did not follow the required procedure necessary for annexation in the annex- ation at issue. The district was evidently attempting to use the alternative procedure for annexation laid out in RCW 57.24.070 through 57.24.050. This method can only be used if the area sought to be annexed is contiguous to the district's existing boundaries. In checking with the Assessor's Office, I confirmed that the area pro- posed for annexation was not contiguous. Given the noncontiguous nature of the area sought to be annexed, the process laid out in RCW 57.24.010 through 57.24.050 should have been followed. This process, which culminates with an election, clearly was not followed. As a re- sult, I do not believe that the County should recognize this as a valid annexation. Section A of Resolution No. 97, Section 20 of Resolution No. 19, and Section 1 of Resolution No. 91, are hereby amended to read as follows: 1. Quarterly statements for charges for water service shall be mailed immediately after the end of each quarter for the preceding quarter. All monies owed to the District shall be payable at such place or places designated by the Water District on or before the 30th day after the statement has been mailed. Billing shall become delinquent on the 31st day after the statement has been mailed, except that the Commissioners may by minute entry direct their manager not to charge delinquency charges in any case in which regular mail service between Glacier, Washington, and/or Bellingham, Washington, to the billing address of the customer is interrupted for reasons beyond the control of the customer. A delinquency charge or $4.00 or one percent (1%) of the outstanding balance per month, whichever is greater, shall be placed on all delinquent accounts and shall constitute a charge against the property, if unpaid. 2. The District may, by act of its Board of Commissioners, terminate water service to any user who is delinquent in payment of water rates and charges. Notice of Intent to Terminate Service for non-payment shall be mailed to the user at least fifteen (15) days prior to actual termination. A notice will be placed at the dwelling seven (7) days prior to actual termination. 3. The District may, by act of its Board of Commissioners, charge for dispatching to terminate water service to any user who is delinquent in payment of water charges. Charges for dispatching to turn off a service for non-payment of all charges shall be as follows: (a). Dispatch/turn off charge: All charges to date plus Twenty-five dollars ($25.00) if payment has not been paid in full at the District's office by 4:30 P.M. the day before the date the account has been scheduled to be turned off for non- payment. The District will dispatch staff to turn off the service the morning of the scheduled turn off. On the day of the scheduled turn off, the foregoing charge is due whether the staff has actually left the District's premises or arrived at the service address scheduled to be turned off. (b). Turn on charge: All charges to date, including Dispatch/turn off charge, plus Twenty-five dollars ($25.00) if turn on is during normal business hours of the District. (c). All charges to date, including Dispatch/turn off charge, plus Seventy-five dollars ($75.00) if turn on is outside of normal business hours of the District. Water service shall not be turned on again until all charges are paid or satisfactory arrangements for payment of delinquent charges have been made to the District. All delinquent bills shall be a lien upon the property serviced and claims of lien shall be filed by the Water District with the Whatcom County Treasurer for such delinquencies. Section B. If any section, subsection, sentence, clause or phrase of this resolution is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this resolution. The Commissioners hereby declare that they would have passed this resolution and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases has been declared invalid or unconstitutional, and if, for any reason, this resolution should be declared invalid or unconstitutional, then the original resolution or resolutions shall be in full force and effect. Section C. Any resolution or parts of resolution in conflict hererwith are hereby repealed. Section D. This resolution shall be in full force and effect immediately. Section E. The remainder of Resolutions 19, 43, 77, 91 and 97 with the exception of those sections amended by other resolutions, shall remain unchanged.
