A RESOLUTION OF THE BOARD OF COMMISSIONERS OF WHATCOM COUNTY
FIRE PROTECTION DISTRICT #21 TO PERMANENTLY INCREASE THE MEMBERS
ON THE BOARD OF FIRE COMMISSIONERS FROM THREE TO FIVE.
WHEREAS, as a result of the merger of Whatcom County Fire Districts 3 and 13, the
Board of Fire Commissioners of Whatcom County Fire District No. 21 d/b/a North
Whatcom Fire & Rescue (the "District") is currently comprised of five members;
WHEREAS, the District currently has a five member Board of Fire Commissioners as a
result of the merger;
WHEREAS, RCW 52.06.085 establishes a process for decreasing the number of
Commissioners to three; and
WHEREAS, the District has determined that it would be in the best interests of the
District and its citizens to permanently increase the Board of Fire Commissioners of the
District from three to five members.
NOW, THEREFORE, BE IT RESOLVED by the Board of Fire Commissioners of
Whatcom County Fire District No. 21 as follows:
Section 1. FINDINGS AND DESCRIPTION OF PROPOSITION. The Board of Fire
Commissioners for Whatcom County Fire District No. 21 hereby find that it is in the best
interests of the District to submit to the qualified electors of the District at the general
election to be held on November 3, 2009 a proposition to permanently increase the Board
of Fire Commissioners to five members.
Section 2. BALLOT TITLE AND PROPOSITION. Pursuant to RCW 52.14.015,
Whatcom County Fire District No. 21 has drafted a ballot title and requests that the
Whatcom County Auditor submit to the qualified electors of Whatcom County Fire
District No. 21 at the election to be held on November 3, 2009, a proposition in
substantially the following form:

INCREASING NUMBER OF COMMISSIONERS FROM THREE TO FIVE
Shall the Board of Commissioners of Whatcom County Fire Protection District

Section 3. COPIES FILED WITH THE WHATCOM COUNTY AUDITOR. The
District Secretary of Whatcom County Fire District No. 21 is authorized and directed, no
later than August 11, 2009, to provide to the Whatcom County Auditor a certified copy of
this Resolution and to perform such other duties as are necessary or required by law to
the end that the Proposition described in this Resolution appears on the ballot at the
November 3, 2009 election. All actions taken prior to the effective date of this
Resolution and in furtherance of this objective are hereby ratified and confirmed.
Section 4. EFFECTIVE DATE.
THIS RESOLUTION shall be in full force and effect upon passage and signatures
hereon.

I, the undersigned, Secretary of Whatcom County Fire Protection District No. 21,
hereby certify as follows:
The attached copy of Resolution No. 2009-12 (the "Resolution") is a full,
true and correct copy of the Resolution duly adopted at a regularly
scheduled meeting of the Board of Fire Commissioners of Whatcom
County Fire District No. 21 (the "Board") held on August 6, 2009, as the
Resolution appears on the minute books of the District and the Resolution
is now in full force and effect.
2. A quorum of the members of the Board was present throughout the
meeting and a majority of those members on the Board present voted in
the proper manner for the adoption of the Resolution.
IN WITNESS WHEREOF, I have hereunto set my hand this 6th day of August,

Commissioners for Whatcom County Fire District No. 21 from three to five. Although

require the Board to be reduced to three as Commissioner seats become vacant. Thus,
this measure would maintain the current level of elected representation for the District.
