Filing a Proposed Ballot Measure for Inclusion in
Election
(AUDITOR'S OFFICE - Elections)
This procedure applies to Auditor's Staff, the Prosecuting Attorney, the Assessor's Office, and
representatives of the cities and districts submitting a proposed ballot measure.
Actions by Cities and District Representative:
1. Submits proposed ballot measure (considered ballot title) together with the ballot measure
cover sheet, an explanatory statement for the Local Voter Pamphlet prepared by legal
counsel, and the "For" and "Against" committee appointments to the Auditor's Office. Must
be submitted at least 60 days prior to the election date for a special election, no later than
the Friday immediately before the first day of regular candidate filing for the primary election,
or no later than the day of the primary for a general election.
Actions by Election Clerk:
CO2. If received by mail or courier (e.g., Fourth Corner Network), date stamps Ballot Measure
Cover Sheet and the first page of the resolution. Gives to Office Coordinator to complete
steps 4-6.

Ensures front staff completed and applied initials for Steps 2-7 above. Notes any
information still needed and tracks getting it from submitter.

13. Checks to see that the ballot title concise description does not exceed 75 words (RCW
29A.36.071) and the explanatory statement does not exceed 100 words. If it does, advises
Auditor.

14. Checks to see that the For and Against committee appointment forms have been
completed. If a committee appointment has not been made for either side, advises Auditor.
15. Checks to see that the ballot title ballot measure in the resolution matches the ballot title
(measure) on the "official ballot" page (if one was submitted). If not, advises Auditor. If

discrepancy is found, waits for clarification before proceeding to next step.
16. Photocopies proposed ballot title and explanatory statement. Reviews ballot title and
headings for capitalization and punctuation.
17. Assigns ballot measure number (sequential numbering for each special purpose or taxing

district).* Number formula = <<yyyy - #>>. Writes ballot measure number on outside of file
folder and in the heading of the ballot title.
18. Notes suggested edits for Auditor's review.

Determines if efforts made were adequate and decides if further action is warranted by the

25. Makes edits and initials and dates the changes.

Attached is a copy of the May 2, 2017 letter sent to Fire Protection District 16
approving the ballot measure and explanatory statement for the August 1 Primary
Election. On July 21, 2017, the District submitted Resolution No. 03-2017 and
requested the same measure be put on the November 7 General Election ballot if it
doesn't pass in the August 1 Primary.
Modifications made to the ballot measure are the proposition number in the heading
and the resolution number in the text of the measure. The sole change to the
explanatory statement was the proposition number.

RESOLUTION NO.03-2017
A RESOLUTION of the Board of Fire Commissioners (the `Board") of Whatcom County Fire
Protection District No. 16 (the "District"), providing for the submission to the voters of the District at
special election to be held therein on November 7, 2017, in conjunction with the State general election
to be held on the same day, a proposition authorizing a regular property tax levy of $1.00 per $1,000,
which is an increase of $.34 per $1,000 of assessed valuation. This proposition would authorize the
District to set and maintain a regular property tax levy of $1.00 per $1,000 of assessed valuation for
2017 and thereafter pursuant to RCW 84.55.050 and subject to any otherwise applicable statutory dollar
rate limitations, all as more particularly set for herein.
WHEREAS, the Board of Fire Commissioners of Whatcom County Fire Protection District No. 16
has determined that it appears certain money available for the Expense Fund for the calendar year 2018
would be insufficient to permit the District to meet the expenses of operation, services, and
maintenance essential and necessary for the protection of the public health, life and property of its
residents during such calendar year, given the current levy rate of $.66 per $1,000 of assessed valuation;
and that it is necessary for the regular property tax levy of the District be set at $1.00 per $1,000, such
levy to be made in 2017 for collection in 2018, and in succeeding years, on all taxable property within
the District (such assessed value representing 100% of the true and fair value unless specifically
provided otherwise by law), in order for the Expense Fund of the District to be able to provide sufficient
funds to meet those expenses, and;
WHEREAS, the Constitution and laws of the State of Washington require that the question of
whether such taxes may be levied must be submitted to the qualified electors of the District for their
ratification or rejection;
NOW, THEREFORE, be it resolved by the Board of Commissioners of Whatcom County Fire
Protections District No. 16 as follows:
Section 1. The Auditor of Whatcom County, Washington, as ex officio Supervisor of Elections (the
"Auditor"), is requested to call and conduct a special election in the District, in the manner provided by
law, to be held herein on November 7, 2017, in conjunction with the State general election to be held on
the same date, for the purpose of submitting to the voters of the District, for their approval or rejection,
a proposition of whether the regular property tax levy of the District shall be set at and maintained at
$1.00 per $1,000 of assessed valuation; such levy to be made in 2017 for collection in 2018, and in
succeeding years, on all taxable property within the District (such assessed value representing 100% of
the true and fair value unless specifically provided otherwise by law), subject to otherwise applicable
statutory limitations; and for the dollar amount of such levies to be used for the purpose of computing
the limitations for subsequent levies under RCW 84.55.050.
Section 2. Pursuant to RCW 29A.36.071, as amended, the Whatcom County Prosecuting Attorney is
requested to prepare the concise description of the aforesaid proposition for the ballot title in
substantially the following form:

maintain its regular property tax levy at $1.00 per $1,000 of assessed valuation for 2017 and thereafter

84.55.050. Should this proposal be approved?
