Filing Proposed Ballot Measures for Inclusion in
Election
(AUDITOR'S OFFICE - Elections)
This procedure applies to Auditor's Staff, the Prosecuting Attorney, the Assessor's Office, and
representatives of the cities and districts submitting proposed ballot measures.
ctions by Cities and Representative of Districts:
1. Submits proposed ballot measure (considered ballot title) together with an explanatory
statement prepared by legal counsel to Auditor's Office. Must be submitted at least 46 days
prior to the election date for a special election, no later than the Friday immediately before
the first day of regular candidate filing for the primary election, or no later than the day of the
primary for a general election.
Actions by Election Clerk:

Cover Sheet and the first page of the resolution. Gives to Office Coordinator to complete
steps 3-7.
3. If received over the counter, date stamps Ballot Measure Cover Sheet and the first page of

The undersigned, being the officers designated by law as constituting the Whatcom County
Canvassing Board, have completed the canvass of votes as it pertains to the Primary Election held
August 4, 2015, within the boundaries of Fire Protection District 16, Whatcom County, State of
Washington.
The proposition concerned a permanent regular property tax levy for the sum of $.50 per $1,000
assessed valuation to begin collection in 2016 for the provision of Emergency Medical Services.
Based on the criteria for passage which was supplied by the district, the measure Passed.

Shall Whatcom County Fire Protection District #16 be authorized to levy a permanent
regular property tax for the sum of fifty cents ($.50) per $1,000 dollars assessed
valuation beginning in 2015, to begin collection in 2016, for the provision of all
Emergency Medical Services, as provided in Whatcom County Fire Protection Districi
#16 Resolution 02-15?

Changes were made to the explanatory statement and will appear in the Local Voters'
Pamphlet as follows:
Almost Sixty Six percent (66%) of the emergency responses in Whatcom County Fire
Protection District No. 16 are emergency medical responses. Funds raised by this EMS
levy will only be used to provide emergency medical services, including training for EMS
personnel, EMS related equipment, supplies, and vehicles needed to provide
emergency medical services. The levy amount will be established at the rate of fifty
cents ($.50) per thousand dollars of assessed valuation. Voter approval of Proposition

No. 2015-1 will provide funding for Whatcom County Fire Protection District No. 16 to
continue providing emergency medical services at the current levels.
Royce Buckingham, Deputy Prosecuting Attorney, and Richard Davis discussed the
pass/fail requirement for this levy. They determined that there are validation
requirements rather than a simple majority as your cover sheet indicates. The validation
requirements are 40% turnout and 60% "Yes" vote based on the 2014 General Election
turnout.
This notice is being provided pursuant to RCW 29A.36.080.

RESOLUTION TO IMPOSE PERMANENT EMS LEVY
A RESOLUTION of the Board of Fire Commissioners (the "Board") of Whatcom County
Fire Protection District No. 16 (the "District") providing for the submission to the voters of the
District at an election to be held therein on August 4, 2015, in conjunction with the State primary
election to be held on the same day, a proposition to impose a permanent Emergency Medical
Services Levy ("EMS Levy") at a levy rate of fifty cents ($.50) per thousand dollars of assessed
valuation in addition to its regular property tax levy, to be levied each year beginning in 2015
and to be collected in each year succeeding the year of the levy to provide funds required by the
District to enable the District to continue to provide emergency medical services.
WHEREAS, it is the judgment of the Board of Commissioners of Whatcom County Fire
Protection District No. 16 that it is essential and necessary for the protection of the health and
life of the residents of the District that emergency medical services continue to be provided by
the District. Such services will necessitate the expenditure of revenues for maintenance,
operations, equipment, and personnel in excess of those which can be provided by the District's
regular tax levy; and
WHEREAS, the District desires to impose a permanent EMS Levy in order to continue
providing emergency medical services.
NOW, THEREFORE, be it resolved by the Board of Commissioners of Whatcom County
Fire Protection District No. 16 as follows:
Section 1. In order to provide the revenue adequate to pay the costs of providing adequate life
protection services and facilities, the District shall levy an emergency medical services levy
beginning in 2015 and collect each year a general tax on taxable property within the District, in
addition to the regular levy for maintenance and operation costs, in an amount not to exceed
fifty cents ($.50) per thousand dollars of assessed valuation of such property.
Section 2. In accordance with RCW 84.52.069, the funds raised by such levy shall be used
only for the provision of emergency medical services, including related personnel costs, training
for such personnel and related equipment, supplies, vehicles and structures needed for the
provision of emergency medical services.
Section 3. BALLOT TITLE AND PROPOSITION. Pursuant to RCW 84.52.069 and
29A.36.210, the Whatcom County Prosecuting Attorney is requested to prepare the concise
description of the aforesaid proposition for the ballot title in substantially the following form:

Section 4. REFERENDUM. A referendum petition may be filed at any time with the Fire Chief,
which is currently Elvin Kalsbeek. Within ten (10) days, the Fire Chief must confer with the
petitioner concerning form and style of the petition, issue the petition an identification number,
and secure an accurate, concise, and positive ballot title from the Whatcom County Auditor.
The petitioner has thirty (30) days in which to secure the signatures of not less than fifteen
percent (15%) of the registered voters of the taxing district, as of the last primary election, upon
petition forms which contain the ballot title and the full text of the measure to be referred. The
Fire Chief and/or his designees must verify the sufficiency of the signatures on the petition and,
if sufficient valid signatures are properly submitted, must certify the referendum measure to the
next election within the taxing district if one is to be held within one hundred eighty (180) days
from the date of filing of the referendum petition, or at a special election to be called for that
purpose in accordance with RCW 29A.04.330. Pursuant to RCW 84.52.069(4)(b), the
referendum procedure provided herein is exclusive in all instances and supersedes the
procedures provided under all other statutory or charter provisions for initiative or referendum
which might otherwise apply.
Section 5. CERTIFICATION. The Secretary of the District is directed (a) to certify to the
Auditor a copy of this Resolution No. 02-15 showing its adoption by the Board;
and (b) to perform such other duties as are necessary and required by law in submitting to the
voters of the District at the aforesaid election the foregoing proposition.
Section 6. IMPLEMENTATION. The Fire Chief of the District is authorized to implement such
administrative procedures as may be necessary to carry out the directives of this legislation.
Section 7. EFFECTIVE DATE. This Resolution shall be in full force and effect upon passage
and signatures hereon -

RESOLUTION TO IMPOSE PERMANENT EMS LEVY
A RESOLUTION of the Board of Fire Commissioners (the "Board") of Whatcom County
Fire Protection District No. 16 (the "District") providing for the submission to the voters of the
District at an election to be held therein on August 4, 2015, in conjunction with the State primary
election to be held on the same day, a proposition to impose a permanent Emergency Medical
Services Levy ("EMS Levy") at a levy rate of fifty cents ($.50) per thousand dollars of assessed
valuation in addition to its regular property tax levy, to be levied each year beginning in 2015
and to be collected in each year succeeding the year of the levy to provide funds required by the
District to enable the District to continue to provide emergency medical services.
WHEREAS, it is the judgment of the Board of Commissioners of Whatcom County Fire
Protection District No. 16 that it is essential and necessary for the protection of the health and
life of the residents of the District that emergency medical services continue to be provided by
the District. Such services will necessitate the expenditure of revenues for maintenance,
operations, equipment, and personnel in excess of those which can be provided by the District's
regular tax levy; and
WHEREAS, the District desires to impose a permanent EMS Levy in order to continue
providing emergency medical services.
NOW, THEREFORE, be it resolved by the Board of Commissioners of Whatcom County
Fire Protection District No. 16 as follows:
Section 1. In order to provide the revenue adequate to pay the costs of providing adequate life
protection services and facilities, the District shall levy an emergency medical services levy
beginning in 2015 and collect each year a general tax on taxable property within the District, in
addition to the regular levy for maintenance and operation costs, in an amount not to exceed
fifty cents ($.50) per thousand dollars of assessed valuation of such property.
Section 2. In accordance with RCW 84.52.069, the funds raised by such levy shall be used
only for the provision of emergency medical services, including related personnel costs, training
for such personnel and related equipment, supplies, vehicles and structures needed for the
provision of emergency medical services.
Section 3. BALLOT TITLE AND PROPOSITION. Pursuant to RCW 84.52.069 and
29A.36.210, the Whatcom County Prosecuting Attorney is requested to prepare the concise
description of the aforesaid proposition for the ballot title in substantially the following form:
