SUBJECT: Ballot title for Fire Protection District No. 16 EMS levy
RCW 29A.36.071 places the authority and burden on the Prosecuting Attorney to review
and draft ballot titles for measures such as the EMS levy at issue. With regard to EMS
levies, RCW 84.52.069(2) requires that such propositions conform to RCW 29A.36.210.
I reviewed the proposal of the Fire District and found it insufficient with those
requirements. Therefore, applying the formatting requirements of RCW 29A.36.210 to
District's resolution, I have rewritten the ballot title as shown below. Please use this
alternative wording for the ballot.

NOW THEREFORE BE IT RESOLVED BY THE BOARD OF WHATCOM COUNTY FIRE
PROTECTION DISTRICT NO. 16, WASHINGTON AS FOLLOWS:
SECTION 1: That the District shall provide emergency medical care or emergency medical
services, including related personnel costs, training for such personnel, and related equipment,
supplies, vehicles and structures needed for the provision of emergency medical care for
emergency medical services.
SECTION 2: In order to produce the revenue adequate to pay the costs of the providing of life
protection services as described in Section 1 of this resolution and to maintain reserve funds
sufficient to assure the continuation of such services, the District shall levy a property tax in the
sum of $O.So per $1,000.00 assessed valuation each year for six consecutive years beginning in
2004 and beginning to be collected in 2005 as provided by the Laws of the State of Washington
RCW 84.52.069.
SECTION 3: There shall be submitted to the qualified electors of the District for their
ratification or rejection, at an election on November 2nd, 2004 the question of whether or not

services will necessitate the expenditure of revenues for maintenance, operations and equipment.
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF WHATCOM COUNTY FIRE
PROTECTION DISTRICT NO. 16, WASHINGTON AS FOLLOWS:
SECTION 1: That the District shall provide emergency medical care or emergency medical
services, including related personnel costs, training for such personnel, and related equipment,
supplies, vehicles and structures needed for the provision of emergency medical care for
emergency medical services.
SECTION 2: In order to produce the revenue adequate to pay the costs of the providing of life
protection services as described in Section 1 of this resolution and to maintain reserve funds
sufficient to assure the continuation of such services, the District shall levy a property tax in the
sum of $0.50 per $1,000.00 assessed valuation each year for six consecutive years beginning in
2004 and beginning to be collected in 2005 as provided by the Laws of the State of Washington
RCW 84.52.069.
SECTION 3: There shall be submitted to the qualified electors of the District for their
ratification or rejection, at an election on November 2°d, 2004 the question of whether or not
