PROCEDURE
Filing a Proposed Ballot Measure for Inclusion in
Election
(AUDITOR'S OFFICE — Elections)
This procedure applies to Auditor's Staff, the Prosecuting Attorney, the Assessor's Office, and
representatives of the cities and districts submitting A proposed ballot measure.
Actions by Cities and Representative of Districts:
Submits proposed ballot measure (considered ballot title) together with an explanatory
statement prepared by legal counsel to Auditor's Office. Must be submitted at least 46 days
prior to the election date for a special election, no later than the Friday immediately before
the first day of regular candidate filing for the primary election, or no later than the day of the
primary for a general election.

Actions by Election Clerk:
If received by mail or courier (e.g., Fourth Corner Network), date stamps Ballot Measure
Cover Sheet and the first page of the resolution. Gives to Office Coordinator to complete
steps 3-7.
3. If received over the counter, date stamps Ballot Measure Cover Sheet and the first page of
the resolution.
4. Checks that:
�• the Ballot Measure Cover Sheet (FRM #AU270090F) is attached and complete,
the resolution contains original signatures by a majority of commissioners or other
legislative body or is a certified copy by the clerk,
�■ the date of the election is stated in the resolution, and
✓+ the explanatory statement is included if for a primary or general election.

Process stops here.
5. Prepares Ballot Measure Receipt (See FRM #AU470090A). Makes a copy for file and
gives original to filer. (Note: Fill in ballot measure name only — no references to resolution
number.)
6. If for primary or general election, provides voter pamphlet information packet to submitter.
1 7. Gives all materials to Office Coordinator.

necessary.
�4. Prepares transmittal letter to Assessor to review if there are taxing or funding implications,
allowing 7 days for processing to obtain their review. (See FRM #AU470090C - Assessor
Ballot Title Letter - sends to Janice Judge)

sheet. Attaches to Assessor's transmittal letter.

The undersigned, being the officers designated by law as constituting the Whatcom County
Canvassing Board, have completed the canvass of votes as it pertains to the General Election held
November 3, 2015, within the boundaries of Fire Protection District 14, Whatcom County, State of
Washington.
The proposition concerned a regular property tax levy of $1.30 per $1,000 of assessed valuation for
2015 and thereafter subject to any otherwise applicable statutory dollar rate limitations. The dollar
amount of this levy would be used for the purpose of computing the limitations for subsequent levies.
Based on the criteria for passage which was supplied by the district, the measure Passed.

Subsequent to consultation between Royce Buckingham, Prosecuting Attorney's Office, and
Richard Davis, modifications were made to the explanatory statement and it will appear in the
Whatcom County Local Voters' Pamphlet as follows:
This measure establishes the levy for Whatcom County Fire Protection District 14 at $1.30 per
$1,000 of assessed valuation, an increase of $0.46. This levy is the District's only source of
revenue. State limitations do not allow the District to keep up with increasing costs. Proposition
No. 2015-1 will allow the District to set the levy rate at $1.30 per $1,000 of assessed valuation
as otherwise authorized by law in order to improve fire station facilities, replace aging
apparatus, fire and medical equipment and to provide a consistent level of fire and emergency
medical services to its residents.

language contained in the Districts' submissions.
After consultation with Districts' attorney, Rich Davis, the explanatory statements are amended to the
following:
For District 1

INCREASE OF REAL PROPERTY TAX LEVY
A RESOLUTION OF THE BOARD OF COMMISSIONERS OF WHATCOM COUNTY FIREPROTECTION
DISTRICT NO.14, PROVIDING FOR THE SUBMISSION TO THE QUALIFIED
ELECTORS OF THE DISTRICT AT A SPECIAL ELECTION TO BE HELD WITHIN THE
DISTRICT ON NOVEMBER 3, 2015, IN CONJUNCTION WITH THE STATE GENERAL
ELECTION TO BE HELD ON THE SAME DATE, OFA PROPOSITION AUTHORIZING A LEVYOFA
PROPERTY TAX NOT TO EXCEED $1.30 PER $1,000 OF TRUE AND ASSESSED VALUATION SUBJECT
TO OTHERWISE APPLICATION STATUTORY LIMITATIONS.
WHEREAS, it is the judgment of the Board of Commissioners of the District that it is essential and necessary
for the protection of the health and life of the residents of the District that fire and emergency medical services
be provided by the District. Such services will necessitate the expenditures of revenues forstation construction,
maintenance, operations, equipment and personnel in excess of those which can be provided by the District's
regular tax revenue levied at the current rate of approximately $.84 per $1,000 of assessed valuation of taxable
property within the District as limited by the 101 % limitation.
WHEREAS, the Board of Commissioners has determined that the one percent limit factor established by RCW
84.55.010 will not be sufficient to provide for the expected cost increases required to maintain and increase the
level of services currently provided by the District.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Whatcom CountyFireProtection
District 14, as follows:
Section 1. In order to provide fire protection, prevention and emergency medical services in the District, it is
necessary for the District to operate and maintain emergency fire and medical services vehicles and to
constructand remodel station facilities to be staffed by properly trained personnel equipped with proper fire
fightingand emergency medical equipment.
Section 2. In order to provide the revenue adequate to pay the costs of providing adequate life protection
services and facilities as described in Section I and to maintain reserve funds sufficient to assure the
continuation of such services, the District shall, in accordance with RCW 84.55.050, remove the limitation in
regular property taxes imposed by RCW 84.55.010 and levy beginning in 2015 and collect beginning in 2016,
pursuant to RCW 52.76.130,RCW, 52.16.140 and RCW 52.16.160, a general tax on taxable property withinthe
District at a rate of $1.30 per $1,000 of assessed valuation subject to otherwise applicable statutory limits.
Section 3. The amount levied in 2015 shall serve as the District's tax levy base for purposes of applying the
limit factor established by RCW 84.55.010 in subsequent years.
Section 4. There shall be submitted to the qualified electors of the District for their ratification or rejection, at a
special election on November 3, 2015, in conjunction with the state general election to be held in the same
date, the question of whether or not the regular property tax levy of the District should be increased to $1.30
per $1,000 of true and assessed valuation subject to otherwise applicable statutory limitations. The Auditor of
Whatcom County, as ex-officio Supervisor of Elections, is hereby requested to call such election, and to submit
the following proposition at such election, in the form of a ballot title substantially as follows:

The Board of Fire Commissioners of Fire Protection District No_ 14, Whatcom County, Washington, adopted
Resolution No. 2015-04 authorizing a regular property tax levy of $1.30 per $1,000. This proposition would
authorize the District to set its regular property tax levy at $1.30 per $1,000 of assessed valuation for 2015 and
thereafter subject to any otherwise applicable statutory dollar rate limitations. The dollar amount of this levy
would be used for the purpose of computing the limitations for subsequent levies under RCW 84.55.050.

BALLOT ISSUE EXPLANATORY STATEMENT
This measure establishes the levy for Whatcom County Fire Protection District No. 14 at $1.30 per $1,000 of
assessed valuation. This levy is the only source of revenue for the District. State limitations do not allow the
District to keep up with increasing costs. Passage of Proposition No. 1 will allow the District to set the levy rate
at $1.30 per $1,000 of assessed valuation as otherwise authorized by law in order to improve fire station
facilities, replace aging apparatus, fire and medical equipment and to provide a consistent level of fire and

A RESOLUTION OF THE BOARD OF COMMISSIONERS OF WHATCOM COUNTY FIREPROTECTION
DISTRICT NO.14, PROVIDING FOR THE SUBMISSION TO THE QUALIFIED
ELECTORS OF THE DISTRICT AT A SPECIAL ELECTION TO BE HELD WITHIN THE
DISTRICT ON NOVEMBER 3, 2015, IN CONJUNCTION WITH THE STATE GENERAL
ELECTION TO BE HELD ON THE SAME DATE, OFA PROPOSITION AUTHORIZING A LEVYOFA
PROPERTY TAX NOT TO EXCEED $1.30 PER $1,000 OF TRUE AND ASSESSED VALUATION SUBJECT
TO OTHERWISE APPLICATION STATUTORY LIMITATIONS.
WHEREAS, it is the judgment of the Board of Commissioners of the District that it is essential and necessary
for the protection of the health and life of the residents of the District that fire and emergency medical services
be provided by the District. Such services will necessitate the expenditures of revenues forstation construction,
maintenance, operations, equipment and personnel in excess of those which can be provided by the District's
regular tax revenue levied at the current rate of approximately $.84 per $1,000 of assessed valuation of taxable
property within the District as limited by the 101 % limitation.
WHEREAS, the Board of Commissioners has determined that the one percent limit factor established by RCW
84.55.010 will not be sufficient to provide for the expected cost increases required to maintain and increase the
level of services currently provided by the District.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Whatcom CountyFireProtection
District 14, as follows:
Section 1. In order to provide fire protection, prevention and emergency medical services in the District, it is
necessary for the District to operate and maintain emergency fire and medical services vehicles and to
constructand remodel station facilities to be staffed by properly trained personnel equipped with proper fire
fightingand emergency medical equipment.
Section 2. In order to provide the revenue adequate to pay the costs of providing adequate life protection
services and facilities as described in Section I and to maintain reserve funds sufficient to assure the
continuation of such services, the District shall, in accordance with RCW 84.55.050, remove the limitation in
regular property taxes imposed by RCW 84.55.010 and levy beginning in 2015 and collect beginning in 2016,
pursuant to RCW 52.76.130,RCW, 52.16.140 and RCW 52.16.160, a general tax on taxable property withinthe
District at a rate of $1.30 per $1,000 of assessed valuation subject to otherwise applicable statutory limits.
Section 3. The amount levied in 2015 shall serve as the District's tax levy base for purposes of applying the
limit factor established by RCW 84.55.010 in subsequent years.
Section 4. There shall be submitted to the qualified electors of the District for their ratification or rejection, at a
special election on November 3, 2015, in conjunction with the state general election to be held in the same
date, the question of whether or not the regular property tax levy of the District should be increased to $1.30
per $1,000 of true and assessed valuation subject to otherwise applicable statutory limitations. The Auditor of
Whatcom County, as ex-officio Supervisor of Elections, is hereby requested to call such election, and to submit
the following proposition at such election, in the form of a ballot title substantially as follows:

The Board of Fire Commissioners of Fire Protection District No. 14, Whatcom County, Washington, adopted
Resolution No. 2015-04 authorizing a regular property tax levy of $1.30 per $1,000. This proposition would
authorize the District to set its regular property tax levy at $1.30 per $1,000 of assessed valuation for 2015 and
thereafter subject to any otherwise applicable statutory dollar rate limitations. The dollar amount of this levy
would be used for the purpose of computing the limitations for subsequent levies under RCW 84.55.050.
