Whatcom County Council Resolution 92-011 encouraged areas to annex into fire protection districts if they
had not already done so. The petitioners requested to be annexed into Fire District No. 14; the
Commissioners of that District concur with the request; and the Auditor declared that the petition was
sufficient in order for annexation to occur without an election.
The area proposed for annexation is legally described as follows: Forty acres, County Assessor Parcel
No. 390529 467065, the Southeast quarter, Southeast quarter, Section 29, Township 39 North, Range 5 East.

2 REGARDING THE ANNEXATION OF CERTAIN PROPERTIES NEAR
3 Welcome INTO FIRE PROTECTION DISTRICT NO. 14

5 WHEREAS, Whatcom County Council Resolution 92-011 encouraged the
6 annexation of unincorporated areas into existing fire protection districts; and
7
8 WHEREAS, the Council is considering an ordinance that would prohibit the
9 issuance of building permits in areas not included in a fire protection district; and
10
11 WHEREAS, citizens living near Welcome have petitioned for incorporation into
12 existing Fire Protection District No. 14; and
13
14 WHEREAS, the Auditor certified that the petition bears the signatures of at least
15 60 percent of the qualified electors within the area proposed to be annexed; and
16
17 WHEREAS, the commissioners of Fire District No. 14 have offered their written
18 coflsent to the proposed annexation; and
19
20 WHEREAS, Section 52.04.011 (3) of the Revised Code of Washington provides
21 that if a petition is signed by 60 percent of the qualified registered electors residing
22 within the territory proposed to be annexed, and if the board of fire commissioners
23 concur, an election in the territory and a hearing on the petition shall be dispensed with
24 and the county legislative authority shall enter its order incorporating the territory into
25 the existing fire protection district; and
26
27 WHEREAS, the Council scheduled this proposal for a hearing and had notice of
28 such hearing posted in three public places within the area proposed for annexation; and
29
30 WHEREAS, the petition signed by 60 percent of the qualified electors within the
31 district stated that county property taxes would be increased in the amount of the fire
32 district levy and bond repayment obligation (in 1992 the amount of taxes in District 14 is
33 $1.00 general levy and $0.23004 bond per $1,000 of assessed valuation for the regular
34 levy and bond issues by the district), and that unimproved lands may be exempt under
35 state law if they meet certain conditions; and
36
37 WHEREAS, the proposed annexation would benefit the public health, safety and
38 welfare;

NOW, THEREFORE, BE IT ORDAINED that the Whatcom County Council
hereby enters its order incorporating the area described below into Fire Protection
District No. 14:
Forty acres, County Assessor Parcel No. 390529 467065, the Southeast quarter,
Southeast quarter, Section 29, Township 39 North, Range 5 East..
BE IT FURTHER ORDAINED that as stipulated by the Revised Code of
Washington, Section 52.04.011 (3), upon entry of this order the territory shall become
subject to the indebtedness, bonded or otherwise, of the existing district, provided that
the property owners of the existing district shall be placed on a fair and equitable
relationship with the property owners of the territory being annexed.

REGARDING THE ANNEXATION OF CERTAIN PROPERTIES NEAR

Government Lot 1 in Section 30; and Government Lots 2, 3, 4 and the
East half of the Northwest quarter in Section 19; and the portion of the Southeast
quarter of the Southwest quarter lying Southerly of the South Pass Road in
Section 18 less the Easterly five acres; all in Township 40 North, Range 5 East, of
the Willamette Meridian situate in Whatcom County, Washington.

This petition was submitted at the same time as another petition for annexation into Fire District 14, and it
was not immediately apparent that they were indeed separate. The other petition was approved by the County
Council. Adoption of this ordinance would make the full Silver Lake -area annexation complete.

REGARDING THE ANNEXATION OF CERTAIN PROPERTIES NEAR
SILVER LAKE INTO FIRE PROTECTION DISTRICT 14
WHEREAS, Whatcom County Council Resolution 92-011 encouraged the
annexation of unincorporated areas into existing fire protection districts; and
WHEREAS, the Council is considering an ordinance that would prohibit the
issuance of building permits in areas not included in a fire protection district; and
WHEREAS, citizens living near Silver Lake have petitioned for incorporation into
existing Fire Protection District No. 14; and
WHEREAS, the Auditor certified that the petition bears the signatures of at least
60 percent of the qualified electors within the area proposed to be annexed; and
WHEREAS, the commissioners of Fire District No. 14 have offered their written
consent to the proposed annexation; and
WHEREAS, Section 52.04.011 of the Revised Code of Washington provides that
if a petition is signed by 60 percent of the qualified registered electors residing within
the territory proposed to be annexed, and if the board of fire commissioners concur, an
election in the territory and a hearing on the petition shall be dispensed with and the
county legislative authority shall enter its order incorporating the territory into the
existing fire protection district; and
WHEREAS, the Council scheduled this proposal for a hearing and had notice of
such hearing posted in three public places within the area proposed for annexation; and
WHEREAS, the petition signed by 60 percent of the qualified electors within the
district stated that county property taxes would be increased in the amount of the fire
district levy and bond repayment obligation (the amount -of taxes in District 14 is $1.23
per $1,000 of assessed valuation for the regular levy and bond issues by the district), and
that unimproved lands may be exempt under stat law if they meet certain conditions; and
WHEREAS, the proposed annexation would benefit the public health, safety and
welfare;
NOW, THEREFORE, BE IT ORDAINED that the Whatcom County Council
Fire District 14 Annexation

hereby enters its order incorporating the area described below into Fire Protection
District No. 14:
The Northeast quarter and the Northwest quarter of the Northwest quarter
of Section 17, Township 40, and Range 6E in Whatcom County.
BE IT FURTHER ORDAINED that as stipulated by state law, upon entry of this
order the territory shall become subject to the indebtedness, bonded or otherwise, of the
existing district, provided that the property owners of the existing district shall be placed
on a fair and equitable relationship with the property owners of the territory being
annexed.

Commencing at the center of section 13 township 38 north range 5 east
hence southerly on centerline of section 13, 24, and 25 to the southerly section
line of 25, hence westerly to the comer of sections 25, 26, 35 and 36 hence
southerly between sections 35 and 36 continuing southerly in township 37 north,
range 5 east between sections 1 and 2 to east and west centerline of sections 1
and 2 hence westerly through section 2 and 3 hence northerly between 3 and 4 to
section corner of 3, 4, 33, and 34 hence easterly between sections 3 and 34 to
