Dear Harlan:
I regret to inform you that I will not be conducting a Special
Election for Fire Protection District No. 14 on February 5, 1991 as
the district's resolution No. 90-06 was not received in my office
until January 3, 1991 which is only 33 days prior to the February
5 election date. This date does not allow me sufficient time to
comply with the following state requirements.
The Revised Code of Washington 29.13.020 (See Attached) requires
that a resolution from the governing body of the district shall be
presented to the county auditor at least forty-five days prior to
the date of the special election. That date was December 21, 1990.
In addition R.C.W. 29. 07. 160 ( See Attached) requires registration
files be closed for thirty days immediately preceding every
election and that a notice of the closing of the registration files
for original registrations and transfers within the district shall
be published in a newspaper at least five days before such closing.
The latest possible date to receive your resolution and comply with
R.C.W. 29. 07. 160 would have been December 28, 1990.

A RESOLUTION of the Board of Fire Commissioners
of Fire Protection District No. 14, Whatcom County,
Washington, providing for the submission to the
qualified electors of the District at a special
election to be held therein on February 5, 1991, of a
proposition authorizing the incurring of general
indebtedness in the sum of not to exceed $204,000 for
capital purposes only, other than the replacement of
equipment, and authorizing the issuance of general
obligation bonds evidencing such indebtedness, the
principal of and interest thereon to be payable from
annual property tax levies to be made in excess of
regular property tax levies.
WHEREAS, in the judgment of the Board of Fire Commissioners
of Fire Protection District No. 14, Whatcom County, Washington
(the "District"), it is essential and necessary for the
protection of the public health, life and property that the
District acquire a fully -equipped pumper truck, the cost of
which is estimated, as nearly as may be, to be the sum of
$204,000; NOW, THEREFORE,
BE IT RESOLVED BY THE BOARD OF FIRE COMMISSIONERS OF FIRE
PROTECTION DISTRICT NO. 14, WHATCOM COUNTY, WASHINGTON, as
follows:
Section 1. The District shall acquire a fully -equipped
pumper truck and other fire fighting and lifesaving equipment
(the "Project") conditioned upon the ratification by the
qualified electors of the District of the proposition described
in Section 3 of this resolution.
Section 2. The District shall borrow an amount not to
exceed $204,000, and in no event to exceed an amount, together
with any outstanding general obligation indebtedness, equal to
three -fourths of one percent of the value of the taxable
property within the District, and issue and sell its general
obligation bonds in that principal amount, conditioned as
provided in Section 1, for capital purposes only, other than the
replacement of equipment, to provide the funds for the Project.
Costs of engineering, planning, financial, legal and other
services lawfully incurred incident to the purposes specified in
Section 1 of this resolution shall be appropriate capital costs
to be paid from the proceeds of the bonds provided for by this
resolution. The bonds authorized shall be issued as a single
issue, as a part of a combined issue with other authorized
bonds, or in more than one series. The bonds shall be fully
registered bonds; shall mature within 15 years from the date of
issue (the life of the improvements to be acquired by the
issuance of bonds being at least 15 years); shall be paid by
annual property tax levies sufficient in amount to pay both
principal and interest when due, which annual property tax
levies shall be made in excess of regular property tax levies
without limitation as to rate or amount but only in amounts
sufficient to meet such payments of principal and interest as
they come due; and shall be issued and sold in such manner and

at such time as shall be required for the purpose for which such
bonds are to be issued. The exact date, form, terms, option of
prior redemption, price, interest rate or rates and maturities
of the bonds shall be fixed hereafter by resolution of the Board
of Fire Commissioners. Pending the issuance of the bonds, the
District may issue short-term obligations pursuant to Chapter
39.50 RCW.
Section 3. There shall be submitted to the qualified
electors of the District for their ratification or rejection at
a special election to be held therein on February 5, 1991, the
question of whether or not such indebtedness shall be incurred
and such general obligation bonds issued and such excess
property taxes levied. The Board of Fire Commissioners declares
that an emergency exists and the Auditor of Whatcom County,
Washington, as ex officio Supervisor of Elections, is requested
to find and declare the existence of an emergency and further is
requested to call and conduct a special election and to submit
such proposition to the qualified electors of the District at
such special election, as aforesaid, in the form of a ballot
title substantially as follows:

$204,000 to acquire a fully -equipped pumper truck by
selling general obligation bonds therefor maturing
within 15 years and levy annual excess property taxes

Section 4. The Secretary to the Board of Fire Commissioners
of the District is directed (a) to certify to the Whatcom County
Auditor a copy of this resolution showing its adoption by this
Board of Fire Commissioners at least forty-five (45) days prior
to the date of such special election, and (b) to perform such
other duties as are necessary or required by law to the end that
the question of whether or not bonds shall be issued and excess
taxes levied necessary to redeem the bonds as herein provided
for shall be submitted to the voters of the District at the
aforesaid special election.
ADOPTED by the Board of Fire Commissioners of Fire
Protection District No. 14, Whatcom County, Washington, at a
regular open public meeting thereof this 19th day of November,
1990, the following Commissioners being present and voting:

WHEREAS, the undersigned as the duly elected, qualified and
acting Auditor of Whatcom County, Washington, has jurisdiction of
and is required by law to conduct all special elections for fire
districts within the county; and
WHEREAS, Whatcom County Fire Protection District No. 14,
Whatcom County, Washington, lies entirely within the boundaries
of Whatcom County; and
WHEREAS, the Board of Commissioners of said district by
resolution adopted November 19, 1990, a certified copy of which
has been delivered to the undersigned, has found that an emergency
exists requiring the holding of a special election on February 5,
1991; and
WHEREAS, said district by said resolution has authorized and
directed the undersigned to assume jurisdiction of and conduct said
special election within Whatcom County;
NOW, THEREFORE, it is hereby authorized and ordered as follows:
The undersigned concurs in the finding of an emergency and
does hereby assume jurisdiction within Whatcom County of the above -
mentioned special election of Whatcom County Fire Protection
District No. 14, Whatcom County, Washington, authorized and ordered
by resolution of its Board of Commissioners adopted November 19,
1990, and will conduct said special election to be held February
5, 1991.
