THIS IS TO CERTIFY that the petition for annexation
of certain territory to Fire Protection District No. 14
contains the signatures of more than sixty percent (60%)
of the qualified registered electors residing within the
territory proposed to be annexed. A sufficiency is there-
fore established. R.C.W. 52.08.060 provides for the
annexation of such territory without an election upon
acceptance by the Fire Protection District Commissioners.

A PETITION TO ANNEX CERTAIN PROPERTIES NEAR THE NEW WELCOME
FIRE STATION TO WHATCON COUNTY FIRE PROTECTION DISTRICT 14
(Please see instructions and the legal description of territory
to be annexed on the reverse side of this petition.)
We the undersigned, being registered electors resident in
the Mosquito Lake Road area proposed for annexation to Whatcom
County Fire Protection District 14, State of ;sashington,
do hereby petition the District 14 Commissioners to
incorporate this territory within their district. We
petitioners believe that extending the boundary of District
14 shall be conducive to the public safety, welfare and
convenience and will be a benefit to the property in the
annexed territory. The newly constructed Station Number 3,
known as the �11elcome Fire Department of District 14, is
located in close proximity to the annex and o,111 provide the
facilities and services needed to protect property anc lives
in the area.
r,e understand that county property taxes will be increased
iff the amount of the fire district levy and bond repayment
obligation (the amount of taxes for 1S84 in District 14 is
P0.81461 per '1,000 of assessed valuation for the regular
levy and �,'?0.47752 per '1,000 of same for bonds issued by the
District; unimproved lands may be exempt under State lava if
they meet certain conditions).

52.08.050 Condemnation proceedings. Such fire pro-
tection district may, at its option, unite in a single action
proceedings to condemn for its use, property which is
held by separate owners. Two or more condemnation
suits instituted separately may also, in the discretion of
the court, be consolidated, upon motion of any interested
party, into a single action. In such cases, the jury shall
render separate verdicts for each tract of land in differ-
ent ownership. No finding of the jury nor decree of the
court as to damages in any condemnation proceeding in.

construed to abridge or destroy the right of the district
to levy and collect taxes for any and all district purposes
against the uncondamned land situated within the dis.
trict. The title acquired by a fire protection district in
condemnation proceedings shall be the fee simple title or
such lesser estate as shall be designated in the decree of

52.08.060 Annexation of territory by election
metbod—Procedure—Indebtedness—Hearing and
election dispensed with, when. Any territory contiguous
to a fire protection district and not within the boundaries
of a city or town or other fire protection district may be
annexed to such fire protection district, for the purpose
of obtaining fire fighting protection or prevention facili-
ties, by petition of fifteen percent of the qualified regis-
tered electors residing within the territory proposed to be
annexed. Such petition shall be filed with the fire com-
missioners of the fire protection district and if the said
fire commissioners shall concur in the said petition they
shall then file such petition with the county auditor who
shall within thirty days from the date of filing such pe-
tition examine the signatures thereof and certify to the
sufficiency or insufficiency thereof. After the county au-
ditor shall have certified to the sufficiency of the peti-
tion, the proceedings thereafter by the board of county
commissioners and the rights and powers and duties of
the board of county commissioners, petitioners and ob-
jectors and the election and canvass thereof shall be the
same as in the original proceedings to form a fire pro-
tection district: Provided, That the board of county
commissioners shall have authority and it shall be its
duty to determine on an equitable basis, the amount of
obligation which the territory to be annexed to the dis-
trict shall assume, if any, to place the taxpayers of the
existing district on a fair and equitable relationship with
the taxpayers of the territory to be annexed by reason of
the benefits of coming into a going district previously
supported by the taxpayers of the existing district, and
such obligation may be paid to the district in yearly in-
stallments to he fixed by the county board if within the
one dollar per thousand dollars of assessed value annual
tax limit and included in the annual tax levies against
the property in such annexed territory until fully paid
The amount of the obligation and the plan of payment
thereof fixed by the county board shall be set out in
general terms in the notice of election for annexation:
Provided, however, That the special election shall be
held only within the boundaries of the territory proposed
to be annexed to said fire protection district. Upon the

entry of the order of the board of county commissioners
incorporating such contiguous territory with such exist-
ing fire protection districts, said territory shall became
subject to the indebtedness, bonded or otherwise, of said
existing district in like manner as the territory of said
district. Should such petition be signed by sixty percent
of the qualified registered electors residing within the
territory proposed to be annexed, and should the fire
commissioners concur therein, an election in such terri-
tory and a hearing on such petition shall be dispensed
with and the board of county commissioners shall enter
its order incorporating such territory within the said ex-

provided for in RCW 52.08.066, 52.08.067 and 52.08-

52.08.066 Annexation by petition method —Peti-
tion —Signers -Content. A petition for annexation
of an area contiguous to a fire district may be made in
writing, addressed to and riled with the board of com-
missioners of the district to which annexation is desired.
It must be signed by the owners, according to the re-
cords of the county auditor, of not less than sixty percent
of the area of land for which annexation is petitioned,
shall set forth a description of the property according to
government legal subdivisions or legal plats, and shall be
accompanied by a plat which outlines the boundaries of
the property sought to be annexed. The petition shall
state financial obligation, if any, to be assumed by the
area to be annexed. [1965 c 59 § 2.1
52.08.067 Annexation by petition method—Hear-
ing--lvotice. if the petition for annexation riled with
the board of commissioners Complies with the require-
ments of law, as proved to the satisfaction of the board
of commissioners, it may entertain the petition, fix the
date for public hearing thereon, and cause notice of the
hearing to be published in one issue of a newspaper of
general circulation in the area proposed to be annexed
and also posted in three public places within the area
proposed for annexation. The notice shall specify the
time and place of hearing and invite interested persons
to appear and voice approval or disapproval of the an-
nexation. The expense of publication and posting of the
notice shall be borne by the signers of the petition. 11965

52.08.068 Annexation by petition method —Reso-
lution providing for annexation. Following the hearing
(1983 Ed.)
the board of commissioners shall determine by resolution
whether annexation shall be made. It may annex all or
any portion of the proposed area but may not include in
the annexation any property not described in the peti-
tion. upon passage of the resolution a certified copy
shall be filed with the board of county commissioners of
the county in which the annexed property is located.

52.08.080 Executory conditional sales contracts for
purchase of property —Limit on indebtedness —
Election, wben. Any fire protection district may execute
an executory conditional sales contract with any other
municipal corporation, the state or any of its political
subdivisions, the government of the United States, or
any private party for the purchase of any real or per-
sonal property, or property rights. in connection with the
exercise of any powers or duties which they now or
hereafter are authorized to exercise, if the entire amount
of the purchase price specified in such contract does not
result in a total indebtedness in excess of three--cighths
of one percent of the value of the taxable property in
such fire protection district: Provided, That if such a
proposed contract would result in a total indebtedness in
excess of three --eighths of one percent of the vaInc of the
taxable property of such fire protection district, as the
cast may be, a proposition in regard to whether or not
such a contract may be executed shall be submitted to
the voters for approval or rejection in the same manner
that bond issues for capital purposes are submitted to
the voters: Provided further, That any fire protection
district may jointly execute Contracts authorized by this
section.
The term "value of the taxable property" shall have
the meaning set forth in RCW 39.36.015. [1970 ex.s. c
42 § 29; 1965 c 21 § 1.]

52.08.090 Liability insurance for officials and em-
plevees. The board of commissioners of each fire district
may purchase liability insurance with such limits as they
may deem reasonable for the purpose of protecting their
officials and employees against liability for personal or
bodily injuries and property damage arising from their
acts or omissions while performing or in good faith pur-
