FORWARDING A REQUEST TO THE WHATCOM COUNTY AUDITOR TO
INCLUDE THE QUESTION OF ANNEXATION OF THE CITY OF BLAINE INTO
FIRE DISTRICT 13 (IN ACCORDANCE WITH RCW 52.04) ON THE BALLOT AT
THE NEXT SPECIAL ELECTION
WHEREAS, on June 23, 2003, the City of Blaine adopted Ordinance 03-
2550, initiating the process for annexing the City into Whatcom County Fire
Protection District #13; and
WHEREAS, on August 14, 2003, Whatcom County Fire Protection
District #13 approved Resolution 2003-05, concurring with the City of
Blaine's annexation proposal; and
WHEREAS, both the City of Blaine and Whatcom County Fire Protection
District #13 believe the annexation will best serve the public's interest; and
WHEREAS, RCW 52.04 outlines the process for annexation of a city or
town into a fire protection district; and
WHEREAS, the City of Blaine has fulfilled all the requirements for the
proposed annexation and the proposal is now ready to be sent to a vote of
the people.
NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council
hereby forwards the annexation proposal to the Whatcom County Auditor for
inclusion on the ballot of the next special election.
BE IT FURTHER RESOLVED that the proposition shall be in
substantially the following form:
Shall the City of Blaine be annexed to and be a part of
Whatcom County Fire Protection District #13?

BE IT FINALLY RESOLVED that if a majority of the people voting on the
proposition in the City of Blaine and a majority of the people voting on the
proposition in the fire protection district vote in favor of the annexation, the
City of Blaine shall be annexed and shall become part of Whatcom County
Fire Protection District #13.

The Citv of Blaine is submitting a Notice of Intention for:

consolidation, of any city, town, or special purpose district;
Consolidation of special purpose districts, but not including
consolidation of cities and towns;
Dissolution or disincorportation of any city or town, or special
purpose district, except a dissolution or disincorporation of a special
purpose district dissolved or disincorporated pursuant to the
provisions of Chapter 36.96;
2. / / Assumption by any city or town of all or part of the assets, facilities,
or indebtedness of a special purpose district which lies partially
within such city or town.
3 / / Establishment of or change in the boundaries of a mutual water and
sewer system or separate sewer system by a water district
pursuant to RCW 57.08.065 or Chapter 57.40.40, as now or
hereafter amended.
4. / / Establishment of or change in the boundaries of a mutual sewer
and water system or separate water system by a sewer district
pursuant to RCW 56.20.015 or Chapter 56.36, as now or hereafter

Brief explanation of action being sought by this NOI:
Annexation of the City of Blaine into Whatcom County Fire District 13. The City
and Fire District 13 have agreed to place on the ballot thequestion of whether
the CitV should annex to Whatcom Fire District 13.
In accordance with the laws of the State of Washington:
Any governmental unit affected, or the County within which the area of the
proposed action is located, may file a Request for Review of a specific
action:
A Request for Review may be initiated by a petition signed by 5% of the
registered voters residing within the area which is being considered for the
proposed action (as determined by the Boundary Review Board in its
discretion subject to immediate review by writ or certiorari to the superior
court);
A Request for Review may be initiated by a petition by the owner or
owners of property consisting of 5% of the assessed valuation within such
area;
If the majority of the members of a Boundary Review Board concur with a
Request for Review when a petition requesting the review is filed by 5%
of the registered voters who deem themselves affected by the action and
reside within one -quarter mile of the proposed action, but not within the
jurisdiction proposing the action.
Any of those listed may Request Review by the Boundary Review Board for
Whatcom County. However, the person or entity seeking review, shall pay to
the Boundary Review Board for Whatcom County (payable to the Northwest
Regional Council) the sum of Two -Hundred ($200) Dollars.

Dear Ms. Mohebbi:
Pursuant to RCW 36.93.090(1)(a) and RCW 36.93.130, please accept the attached Notice of Intention to
Annex the City of Blaine into Whatcom County Fire District 13. The City and Fire District 13 have igrced
to place on the ballot the question of whether the City should annex to Whatcom Fire District 13. We
anticipate that the election will be held in either February or March of 2004.
In April 1999, the City of Blaine and the Whatcom County Fire District 13 entered into an interlocal
agreement, which sets for the terms, and conditions by which Fire District 13 will provide fire and
emergency medical services to the City. The term of the agreement is five years. Included in the
agreement is a condition that the City and the Fire District explore the possibility of the City annexing to

The City of Blaine and Fire District 13 have jointly evaluated the alternatives available to continue their
partnership. This process included an opportunity for the public to comment on the various organizational
proposals. On June 23, 2003 the Blaine City council unanimously approved Ordinance 03-2550 stating the
City's intent to annex On August 14, 2003 the Commissioners of Fire District 13 will adopt a resolution
concurring with the City of Blaine's intent to annex A copy of that resolution will come under separate
cover.
The City of Blaine's Community Development Department has issued a Determination of
Nonsignificance regarding the proposed annexation_

A "Review" of a proposal may be requested, upon payment of $200.00 to the Whatcom
County Boundary Review Board, by the following:
Any governmental unit affected, including the governmental unit for which the
boundary change or extension of permanent water or sewer service is

within the area which is being considered for the proposed action (as

1. General background of the reasons for seeking the proposed action.
In April 1999, the City of Blaine and the Whatcom Fire District 13 entered into
an interlocal agreement, which basically turned the City's, fire protection,
emergency medical and Fire Marshall services over to District 13. At that
time, it was anticipated that before the end of the agreement ( five years) the
City would annex to the District.
The City has been very satisfied with the service that Whatcom Fire District
13 has provided and wants to move toward a more permanent arrangement
for these service in Blaine.
2. Review of the factors to be considered by the Boundary Review Board as
they effect this proposed action.

THAT THE PUBLIC INTEREST WILL BE SERVED
THEREBY AND PROVIDING FOR SEVERABILITY.
WHEREAS, pursuant to the terms and conditions of the Interlocal Agreement by and
between Whatcom County Fire Protection District No. 13 and the City of Blaine dated April 30,
1999 (the "Agreement"), Whatcom County Fire Protection District No. 13 (the "District") has
provided fire and emergency medical services for the citizens of the City of Blaine; and
WHEREAS, the Agreement has resulted in an enhanced level of service and protection
for the citizens of the City of Blaine; and
WHEREAS, the Agreement contemplates the annexation of the City of Blaine into the
District pursuant to Chapter 52.04 RCW; and
WHEREAS, the stability provided by the annexation will allow for more predictable and
better long range planning for the District; and
WHEREAS, the public interest will be served by annexation.
NOW, THEREFORE, IT IS HEREBY ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BLAINE, WASHINGTON as follows:
Section 1: Pursuant to RCW 52.04.061 the City of Blaine hereby states its intent to join and
annex into Whatcom County Fire Protection District No. 13.
Section 2: Pursuant to RCW 52.04.061 the City of Blaine hereby finds that the public
interest will be served by the annexation of the City of Blaine into Whatcom County Fire
Protection District No. 13.
Section 3: If any section, clause, sentence, provision or phrase of this ordinance should be
deemed or held invalid or unconstitutional by any court of competent jurisdiction, with
jurisdiction over the City of Blaine, such unconstitutionality or invalidity shall not affect any
other section, clause, sentence, provision or phrase of this ordinance.

A RESOLUTION OF THE BOARD OF FIRE COMMISSIONERS OF WHATCOM
COUNTY FIRE PROTECTION DISTRICT NO. 13 CONCURRING IN THE CITY
COUNCIL OF THE CITY OF BLAINE ORDINANCE NO. 03-2550 INITIATING
THE ANNEXATION OF THE CITY OF BLAINE INTO WHATCOM COUNTY

WHEREAS, the City Council of the City of Blaine (the "City") pursuant to Chapter 52.04
RCW, passed Ordinance No. 03-2550 on June 23, 2003 that expressed the City's intent to join
and annex into Whatcom County Fire Protection District No. 13 (the "District") and found that the
public interest would be served by the annexation; and
WHEREAS, pursuant to Chapter 52.04 RCW, the District Board of Fire Commissioners
is authorized to concur in the annexation.
NOW THEREFORE BE IT RESOLVED as follows:
1. Pursuant to RCW 52.04.061 the Board of Fire Commissioners of Whatcom County
Fire Protection District No. 13 hereby concur in the City's intent to join and annex into Whatcom
County Fire Protection District No. 13.

The State Environmental Policy Act (SEPA), chapter 43.21 C RCW, requires all governmental agencies to consider
the environmental impacts of a proposal before making decisions. An environmental impact statement (EIS) must be
prepared for all proposals with probable significant adverse impacts on the quality of the environment. The purpose
of this checklist is to provide information to help you and the agency identify impacts from your proposal (and to
reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide whether an EIS is
required.
Instructions for Applicants:
This environmental checklist asks you to describe some basic information about your proposal. Governmental
.-icies, including the City of Blaine, use this checklist to determine whether the environmental impacts of your
proposal are significant, requiring preparation of an EIS. Please answer the questions briefly, with the most precise
