FIRE PROTECTION DISTRICT NO. 7 INTO DISTRICT NO. 3
HONORABLE COMMISSIONERS OF
WHATCOM COUNTY FIRE PROTECTION DISTRICT NO. 7 AND 3.
GENTLEMEN:
The undersigned constituting more than fifteen percent of the qualified
electors in the area to be transferred, pursuant to Revised Code of
Washington, Chapter 52.24, respectfully petition for transfer of a
portion of the area contained within District No. 7 (Ferndale)
into District No. 3 (Lynden). In support of this petition we show
as follows:
1. AREA TO BE TRANSFERRED:
The area which we request be transferred is bounded and described as
follows:
Beginning at a point where the North -South center line of
Section 35, Township 40 North, Range 2 East intersects the
Nooksack River; thence Westerly along said Nooksack River to
a point 1320' west of the West line of said Section 35; thence
south to the Southeast corner of the Southwest Quarter of the
Northeast Quarter of Section-34 Township 39 North, Range 2
East; thence east 6601; thence south 8601; thence east to the
east line of Section 34; thence south to the Southeast corner
of Section 34; thence east to a point 1320' west of the South-
east corner of Section 36, Township 39 North, Range 2 East;
thence north 1 mile; thence west one and one quarter mile
(1-1/4); thence north to the point of beginning.
2. REASONS FOR TRANSFER:
The reasons for the merger into Fire District No. 3, is better service
to the residents because of the closer proximity of the Laurel fire hall.
3. STATEMENT OF FINANCES:
A detailed statement of the finances of the respective districts is
attached to and made a part of this petition as though set forth in
full herein.
4. TERMS OF MERGER:
There are no special terms or conditions to this merger as no property
is to be transferred and there is no outstanding indebtedness to be
assumed.
WHEREFORE, THE PETITIONERS PRAY FOR:
1. Merger of said area into Whatcom County Fire Protection
District No. 3, and,
2. Request an election on this proposed merger unless 3/5ths
or more of the electors within the area si§n the petition in which event
election be dispensed with; and,
3. Commissioners of both Districts by resolution approvetkis merger.

Outstanding current utilities charges, and expenses not in
excess of $830.00

such merger.

merger, transfer, convey, and deliver to the merged district all
t property and funds of the merging district, together with all
interest in and right to collect any assessments theretofore levied.

t 52.24.090 Merger of part of district with adjacent district. A part
of one district may be transferred and merged with an adjacent
district whenever such area can be better served by the merged
district. To effect such a merger a petition shall be filed with the
board of the merger district by the commissioners of the merging
district, setting forth the exact area or part of the merging district
to be transferred. The commissioners of the merging district may
sign and file the petition upon their own initiative, and they shall
file such a petition when it is signed by fifteen percent of the quali-
fied electors resident in the area to be merged. The petition shall
state the reasons for the merger;(give a detailed statement of the
district's finances, listing its assets and liabilities, state the terms and
conditions under which the merger is proposed and pray for the
merger. Said petition shall then be acted upon as set forth in RCW
52.24.030 and 52.24.040. [1953 c 176 § 5.1
52.24.100 When election unnecessary. If three -fifths of
all the qualified electors in the area to be merged sign a petition to
merge the districts, no election on the question of the merger is
necessary, in which case the auditor shall return the petition, to-
gether with his certificate of sufficiency attached thereto, to the
boards of the merging districts') Thereupon the boards of the re-
spective districts shall adopt their concurrent resolutions of transfer
in the same manner and to the same effect as if the same had been
authorized by an election. [1953 a 176 § 6.]
