Celeste 50063 I:\Policies & Procedures\Elections\02_Pre-Election\02_Filing - Ballot Measures\FRM Prosecuting Atty ballot title letter.doc RECEIVED JUN 1 6 2009 RESOLUTION NO. 2009-04 SHIRLEY FORSLOF WHATC MAPPAT IMWissolution of Whatcom County Fire District No. 6 WHEREAS, at the general election in November, 2008, the voters approved the formation of the South Whatcom Fire Authority ("SWFA"), which is comprised of the following fire districts: Whatcom County Fire District Nos. 2, 6, 9 and 10; WHEREAS, the SWFA commenced operations on January 1, 2009; WHEREAS, the purpose of creating the SWFA was to regionalize fire and emergency medical services in order to provide an enhanced level of service while reducing redundancies between the four (4) member fire districts; WHEREAS, the applicable statutes governing fire districts and regional fire protection service authorities did not allow for the automatic dissolution of the District upon creation of the SWFA, but the SWFA Plan expressly contemplated that the dissolution of each of the member fire districts would be brought to the voters; WHEREAS, because the SWFA was not created until January 1, 2009, the District levied taxes for 2009, which revenues have been forwarded to SWFA for operations during 2009; WHEREAS, beginning in 2010, the SWFA, rather than the District, will levy the necessary taxes to support its operations; WHEREAS, the District is now a non -essential, superfluous governmental entity; WHEREAS, until the District is dissolved, the Board of Fire Commissioners is required to meet monthly pursuant to RCW 52.14.090; WHEREAS, each of the member fire districts intend to submit to the voters of that district at the November 2009 general election a similar ballot proposition to dissolve each of the member fire districts; and WHEREAS, the Board of Commissioners believes it is in the best interests of the citizens of the District to dissolve the District and to eliminate an unnecessary layer of government by dissolving the District. NOW, THEREFORE, BE IT RESOLVED by the Commission of Whatcom County Fire Protection District No. 6 (the "District") as follows: Section 1. FINDINGS AND DESCRIPTION OF PROPOSITION. The Board of Fire Commissioners for Whatcom County Fire District No. 6 hereby finds that it is in the best interests of the District to submit to the qualified electors of the District at the general election to be held on November 3, 2009 a proposition to dissolve the District regarding the creation of the South Whatcom Regional Fire Protection Service Authority, pursuant to chapter 52.10 RCW. Section 2. BALLOT TITLE AND PROPOSITION. Pursuant to RCW 52.10.010, Whatcom County Fire District No. 6 has drafted a ballot title and requests that the Whatcom County Auditor submit to the qualified electors of Whatcom County Fire Districts No. 6 at the election to be held on November 3, 2009, a proposition in substantially the following form: PROPOSITION NO. 1 [Whatcom County Fire Protection District #6] DISSOLUTION OF WHATCOM COUNTY FIRE DISTRICT NO. 6 The Board of Fire Commissioners of Whatcom County Fire District No. 6 passed Resolution No. 2009-04 concerning a proposition to dissolve the fire district. The District Secretary of Whatcom County Fire District No. 6 is authorized and directed, no later than August 11, 2009, to provide to the Whatcom County Auditor a certified copy of this Resolution and to perform such other duties as are necessary or required by law to the end that the Proposition described in this Resolution appears on the ballot at the November 3, 2009 election. All actions taken prior to the effective date of this Resolution and in furtherance of this objective are hereby ratified and confirmed. Section 5. EFFECTIVE DATE. The SWFA, which also includes Fire Districts 6 was created by a vote of the people in 2008. Since January 1, 2009, the SWFA has been the exclusive provider of fire and emergency medical services within each of the four member districts. The SWFA, a separate governmental entity, is governed by an elected five member board of commissioners. The individual fire districts are no longer needed. Dissolving the District will eliminate unnecessary expenses.
