RESOLUTION NO.
A RESOLUTION of the Board of Fire Commissioners of ftr
Protection District No. 6, Whatcom County, Washington, prov
for the submission to the qualified electors of the District at -
the general election to be held there in on November 8, 1994, of
a proposition authorizing the incurring of general indebtedness
in the sum of not to exceed $495,000.00 for capital purposes
only, other than the replacement of equipment, and the
authorizing the issuance of general obligation bonds evidencing
such indebtedness, the principal of and interest thereon to be
payable from annual property tax levies to be made in excess of
the regular property tax levy.
WHEREAS, in the judgment of the Board of Fire commissioners
of the district, it is essential and necessary for the protection
of the public health, life and property that the District
construct and addition to the existing property now owned by the
District in the County of Whatcom, and acquire fire fighting
apparatus (a truck), the cost of which is estimated, as near as
may be, $495,000.00.
NOW, THEREFORE,
BE IT RESOLVED BY THE BOARD OF FIRE COMMISSIONERS OF FIRE
PROTECTION DISTRICT NO. 6, WHATCOM COUNTY, WASHINGTON, as
follows:
Section 1. The District shall construct and equip a renovation to
the existing fire station now owned by the District in the County
of Whatcom, and acquire fire fighting apparatus (a truck), upon
the ratification by the qualified electors of the District of the
proposition described in Section 3 of this resolution.
Section 2. For the purpose of providing the funds to do those
things described in Section 1 hereof, and conditioned as provided
in Section 1, the District shall incur a general indebtedness and
issue general obligation bonds evidencing such indebtedness in an
amount not to exceed $495,000.00 and in no event to exceed an
amount, together with any outstanding general obligation
indebtedness, equal to three -fourths of one percent of the value
of the taxable property within the District as provided in
Section 50, Chapter 195, Laws of Washington, 1973, lst Ex. Sess.
The bonds shall be serial in form and maturity; shall be numbered
from "1" upward consecutively; shall bear interest a such rate or
rates not to exceed 10% per annum as the Board of Fire
Commissioners of the District shall hereafter determine by
resolution, payable semi-annually from the date of the bonds
until their principal is paid (except that the first interest
payment may be a such time up to twelve months from the date of
issuance such Commissioners may hereafter determine by
resolution), with interest coupons evidencing such interest to

maturity to be attached thereto, and with full obligation on the
part of the District to pay interest at the bond rate or rates
from and after the maturity dates until the bonds with interest
are paid in full; shall mature serially, annually, in from two to
fifteen years from the date of issue, the various annual
maturities to be, as nearly as practicable, in such amounts as
will, together with interest on all outstanding bonds, be met by
equal annual tax levies for the payment of the principal and
interest of such bonds; shall be issued in denominations of
$100.00 or some multiple thereof; and shall bear such date or
dates, shall be in such form, and shall contain such covenants as
the Board of Fire Commissioners of the District shall hereafter
determine by resolution. Both principal of and interest on the
bonds shall be payable from annual property tax levies to be made
in excess of the regular property tax levy, without limitation as
to rate or amount. The bonds shall be sold in such a manner as
the Board of Fire Commissioners or the District shall deem to be
for the best interest of the District and at a price not less
than par. The bonds shall be issued from time to time (in one or
more series) as funds are needed. The proceeds of the sale of
such bonds shall be used only to defray the cost of doing those
things described in Section 1 hereof and the cost of issuance of
such bonds and not for the current budget or operation of the
district. Such acquisitions and construction are declared to be
for capital purposes only.
Section 3. There shall be submitted to the qualified
electors of the District for their ratification or rejection, at
the general election to be held therein on November 8, 1994, the
question of whether or not such indebtedness shall be incurred
and such bonds issued, and the Board of Fire Commissioners hereby
requests the County Auditor of Whatcom County, Washington, to
submit to the qualified electors of the District at the general
election on November 8, 1994, in the form of a ballot title
substantially as follows:

interest not to exceed 10% per annum, and to be payable from

excess property taxes necessary to redeem the bonds, as provided

Section 4. The Secretary of the Board of Fire Commissioners of
the District is directed (a) to certify to the County Auditor a
copy of this resolution showing its adoption by this Board of
Fire Commissioners at Least Forty -Five (45) days prior to the
date of such general election, and (b) to perform such other
duties as are necessary or required by law to the end that the
question of whether or not bonds shall be issued as herein
provided for shall be submitted to the voters of the District at
the aforesaid general election.
ADOPTED by the Board of Fire Commissioners of Whatcom County
Fire Protection District No. 6, Whatcom County, Washington, at a
regular open public meeting thereof this 14th day of September,
1994, the following Commissioners being present and voting:

WHEREAS, the undersigned as the duly elected, qualified and
acting Auditor of Whatcom County, Washington, has jurisdiction of
and is required by law to conduct all special elections for fire
protection districts within the County; and
WHEREAS, Whatcom County Fire Protection District No. 6,
Whatcom County, Washington, lies entirely within the boundaries of
Whatcom County; and
WHEREAS, the Board of Fire Commissioners of said district by
resolution adopted on September 14, 1994, a certified copy of which
has been delivered to the undersigned, has found that an emergency
exists requiring the holding of a special election November 8,
1994; and
WHEREAS, said district by said resolution has authorized and
directed the undersigned to assume jurisdiction of and conduct said
special election within Whatcom County.
NOW, THEREFORE, it is hereby authorized and ordered as
follows:
The undersigned concurs in the finding of an emergency and
does hereby assume jurisdiction within Whatcom County of the above -
mentioned special election of Whatcom County Fire Protection
District No. 6, Whatcom County, Washington, authorized and ordered
by resolution of its Board of Fire Commissioners adopted on
September 14, 1994, and will conduct said special election to be
held November 8, 1994.
