The undersigned, being the officers designated by law as constituting the Whatcom County
Canvassing Board, have completed the canvass of votes as it pertains to the General and Special
Election held November 5, 2013, within the boundaries of Fire Protection District 4, Whatcom County,
State of Washington.
The proposition would impose a permanent Emergency Medical Services (EMS) levy of thirty cents or
less per thousand dollars of assessed valuation.
Minimum Numbers for Validation:

Auditor Seeks Committee Opposing Whatcom Fire Protection District 4 EMS Levy
Bellingham, WA, August 12, 2013: Whatcom County Fire Protection District 4 has submitted a
resolution for the November 5 General Election ballot proposing an EMS levy at a rate of $.30 or
less per thousand dollars of assessed valuation. The District has appointed a "Pro" committee
who will submit a statement in favor of the proposition for the Whatcom County Local Voters'
Pamphlet. They have not been able to identify a "Con" Committee.
The Auditor is required to make an effort to identify interested individuals and appoint them to
such a "Con" committee who will submit a statement for the voters' pamphlet recommending
rejection of the proposition. There is a short window of time to allow for this. Persons interested
in submitting a statement against the proposition should contact Debbie Adelstein, County
Auditor, at (360) 715-7474, as soon as possible. A statement against must be submitted by
August 16.

explanatory statement must be 100 words or less. The statement has been revised to meet that requirement:

Almost seventy percent (70%) of the emergency responses in Whatcom County Fire Protection District No. 4
are emergency medical responses. Funds raised by this EMS levy will only be used to provide emergency
medical services, including training for EMS personnel, EMS related equipment, supplies, and vehicles needed
to provide emergency medical services. The levy amount will be established at the rate of thirty cents ($.30) or
less per thousand dollars of assessed valuation. Voter approval of Proposition No. 1 will provide funding for

RESOLUTION NO.
RESOLUTION TO IMPOSE EMS LEVY
A RESOLUTION of the Board of Fire Commissioners (the "Board") of Whatcom County
Fire Protection District No. 4 (the "District") providing for the submission to the voters of the
District at an election to be held therein on November 5, 2013, in conjunction with the State
general election to be held on the same day, a proposition to impose a permanent Emergency
Medical Services Levy ("EMS Levy") at a levy rate of thirty cents ($.30) or less per thousand
dollars of assessed valuation in addition to its regular property tax levy, to be levied each year
beginning in 2013 and to be collected in each year succeeding the year of the levy to provide
funds required by the District to enable the District to continue to provide emergency medical
services.
WHEREAS, it is the judgment of the Board of Commissioners of Whatcom County Fire
Protection District No. 4 that it is essential and necessary for the protection of the health and life
of the residents of the District that emergency medical services continue to be provided by the
District. Such services will necessitate the expenditure of revenues for maintenance,
operations, equipment, and personnel in excess of those which can be provided by the District's
regular tax levy; and
WHEREAS, the District desires to impose a permanent EMS Levy in order to continue
providing emergency medical services.
NOW, THEREFORE, be it resolved by the Board of Commissioners of Whatcom County
Fire Protection District No. 4 as follows:
Section 1. In order to provide the revenue adequate to pay the costs of providing adequate life
protection services and facilities, the District shall levy an emergency medical services levy
beginning in 2013 and collect each year a general tax on taxable property within the District, in
addition to the regular levy for maintenance and operation costs, in an amount not to exceed
thirty cents ($.30) per thousand dollars of assessed valuation of such property.
Section 2. In accordance with RCW 84.52.069, the funds raised by such levy shall be used
only for the provision of emergency medical services, including related personnel costs, training
for such personnel and related equipment, supplies, vehicles and structures needed for the
provision of emergency medical services.
Section 3. BALLOT TITLE AND PROPOSITION. Pursuant to RCW 84.52.069 and
29A.36.210, the Whatcom County Prosecuting Attorney is requested to prepare the concise
description of the aforesaid proposition for the ballot title in substantially the following form:

Will Whatcom County Fire Protection District No. 4 be authorized to impose a PERMANENT
regular property levy of thirty cents ($.30) or less per thousand dollars of assessed valuation?

Section 4. REFERENDUM. A referendum petition may be filed at any time with the Fire Chief,
which is currently Ron Anderson. Within ten (10) days, the Fire Chief must confer with the
petitioner concerning form and style of the petition, issue the petition an identification number,
and secure an accurate, concise, and positive ballot title from the Whatcom County Auditor.
The petitioner has thirty (30) days in which to secure the signatures of not less than fifteen
percent (15%) of the registered voters of the taxing district, as of the last general election, upon
petition forms which contain the ballot title and the full text of the measure to be referred. The
Fire Chief and/or his designees must verify the sufficiency of the signatures on the petition and,
if sufficient valid signatures are properly submitted, must certify the referendum measure to the
next election within the taxing district if one is to be held within one hundred eighty days (180)
from the date of filing of the referendum petition, or at a special election to be called for that
purpose in accordance with RCW 29A.04.330. Pursuant to RCW 84.52.069(4)(b), the
referendum procedure provided herein is exclusive in all instances and supersedes the
procedures provided under all other statutory or charter provisions for initiative or referendum
which might otherwise apply.
Section 5. CERTIFICATION. The Secretary of the District is directed (a) to certify to the
Auditor a copy of this Resolution No. showing its adoption by the Board at least
fifty-two (52) days prior to the date of such general election; and (b) to perform such other duties
as are necessary and required by law in submitting to the voters of the District at the aforesaid
election the foregoing proposition.
Section 6. IMPLEMENTATION. The Fire Chief of the District is authorized to implement such
administrative procedures as may be necessary to carry out the directives of this legislation.
Section 7. EFFECTIVE DATE. This Resolution shall be in full force and effect upon passage
and signatures hereon.
ADOPTED by the Board of Fire Commissioners of Whatcom County Fire Protection
District No. 4, at an open public meeting thereof this day of July, 2013, of which notice
was given in the manner provided by law, and the following Commissioners being present and
voting.

Almost seventy percent (70%) of the emergency responses in Whatcom County Fire Protection District No. 4
are emergency medical responses. Funds raised by this EMS levy will only be used to provide emergency
medical services, including training for EMS personnel, EMS related equipment, supplies, and vehicles needed
to provide emergency medical services. The levy amount will be established at the rate of thirty cents ($.30) or
less per thousand dollars of assessed valuation. Voter approval of Proposition No. 1 will provide funding for

(1) The Ballot Title language contained on page 2 of the Fire District 4 packet is approved.
(2) The Explanatory Statement is the responsibility of the prosecuting attorney or the "attorney for the
jurisdiction" under 29A.32.241(4). A proposed statement was included in the packet. Because the
proposed statement was not submitted via an attorney for the district, the prosecuting attorney
(me) will review and revise it. Please forward a copy of the resulting language (via this memo) to
the district.

RESOLUTION TO IMPOSE EMS LEVY WHATCOM COUNTYAUDITOR
A RESOLUTION of the Board of Fire Commissioners (the "Board") of Whatcom County
Fire Protection District No. 4 (the "District") providing for the submission to the voters of the
District at an election to be held therein on November 5, 2013, in conjunction with the State
general election to be held on the same day, a proposition to impose a permanent Emergency
Medical Services Levy ("EMS Levy") at a levy rate of thirty cents ($.30) or less per thousand
dollars of assessed valuation in addition to its regular property tax levy, to be levied each year
beginning in 2013 and to be collected in each year succeeding the year of the levy to provide
funds required by the District to enable the District to continue to provide emergency medical
services.
WHEREAS, it is the judgment of the Board of Commissioners of Whatcom County Fire
Protection District No.. 4 that it is essential. and necessary for the protection of the health and life
of the residents of the District that emergency medical services continue to be provided by the
District. Such services will necessitate the expenditure of revenues for maintenance,
operations, equipment, and personnel in excess of those which can be provided by the District's
regular tax levy; and
WHEREAS, the District desires to impose a permanent EMS Levy in order to continue
providing emergency medical services.
NOW, THEREFORE, be it resolved by the Board of Commissioners of Whatcom County
Fire Protection District No_ 4 as follows:
Section 1. In order to provide the revenue adequate to pay the costs of providing adequate life
protection services and facilities, the District shall levy an emergency medical services levy
beginning in 2013 and collect each year a general tax on taxable property within the District, in
addition to the regular levy for maintenance and operation costs, in an amount not to exceed
thirty cents ($.30) per thousand dollars of assessed valuation of such property.
Section 2. In accordance with RCW 84.52.069, the funds raised by such levy shall be used
only for the provision of emergency medical services, including related personnel costs, training
for such personnel and related equipment, supplies, vehicles and structures needed for the
provision of emergency medical services.
Section 3. BALLOT TITLE AND PROPOSITION. Pursuant to RCW 84.52.069 and
29A.36.210, the Whatcom County Prosecuting Attorney is requested to prepare the concise
description of the aforesaid proposition for the ballot title in substantially the following form:

and secure an accurate, concise, and positive ballot title from the Whatcom County Auditor.
The petitioner has thirty (30) days in which to secure the signatures of not less than fifteen
percent (15%) of the registered voters of the taxing district, as of the last general election, upon
petition forms which contain the ballot title and the full text of the measure to be referred. The
Fire Chief and/or his designees must verify the sufficiency of the signatures on the petition and,
if sufficient valid signatures are properly submitted, must certify the referendum measure to the
next election within the taxing district if one is to be held within one hundred eighty days (180)
from the date of filing of the referendum petition, or at a special election to be called for that
purpose in accordance with RCW 29A_04.330. Pursuant to RCW 84.52.069(4)(b), the
referendum procedure provided herein is exclusive in all instances and supersedes the
procedures provided under all other statutory or charter provisions for initiative or referendum
which might otherwise apply.
Section 5. CERTIFICATION. The Secretary of the District is directed (a) to certify to the
Auditor a copy of this Resolution No. 2013-3 showing its adoption by the Board at least fifty-two
(52) days prior to the date of such general election; and (b) to perform such other duties as are
necessary and required by law in submitting to the voters of the District at the aforesaid election
the foregoing proposition.
Section 6. IMPLEMENTATION. The Fire Chief of the District is authorized to implement such
administrative procedures as may be necessary to carry out the directives of this legislation.
Section 7. EFFECTIVE DATE. This Resolution shall be in full force and effect upon passage
and signatures hereon.
ADOPTED by the Board of Fire Commissioners of Whatcom County Fire Protection
District No. 4, at an open public meeting thereof this 17th day of July, 2013, of which notice was

I, the undersigned, Secretary of Whatcom County Fire Protection District No. 4, (the
"District'), hereby certify as follows:
1. The attached copy of Resolution No. 2013-3 (the "Resolution") is a full, true and
correct copy of the Resolution duly adopted at a regularly scheduled meeting of the
Board of Fire Commissioners of the District (the "Board") held on July 17, 2013, as the
Resolution appears on the minute book of the District and the Resolution is now in full
force and effect.
2. A quorum of the members of the Board was present throughout the meeting and
a majority of those members on the Board present voted in the proper manner for the
adoption of the Resolution.

EXPLANATORY STATEMENT
Almost seventy percent (70%) of the emergency responses in Whatcom County Fire Protection
District No. 4 are emergency medical responses, and yet, the District does not currently have an
Emergency Medical Services Levy. Funds raised by this EMS levy will only be used to provide
emergency medical services, including related personnel costs, training for such personnel, and
related equipment, supplies, vehicles and structures needed for the provision of emergency
medical services. The levy amount will be established at the rate of thirty cents ($.30) or less
per thousand dollars of assessed valuation. Voter approval of Proposition No_ 1 will provide
funding for Whatcom County Fire Protection District No. 4 to continue providing emergency
medical services at current levels.
