WHEREAS, the undersigned, as the duly elected, qualified and acting Auditor of
Whatcom County, Washington, has jurisdiction of and is required by law to conduct all special
elections for fire protection districts within the County; and
WHEREAS, Whatcom County Fire Protection District No. 4, Whatcom County,
Washington (the "District"), lies entirely within the boundaries of Whatcom County; and
WHEREAS, the Board of Commissioners of said district by resolution adopted on
August 7, 2000, a certified copy of which has been delivered to the undersigned, has found that
an emergency exists requiring the holding of a special election on November 7, 2000; and
WHEREAS, the District by such resolution has authorized and directed the undersigned
to assume jurisdiction of and conduct a special election within Whatcom County;
NOW, THEREFORE, it is hereby authorized and ordered as follows:
The undersigned concurs in the finding of an emergency and does hereby assume
jurisdiction within Whatcom County of the above -mentioned special election of Whatcom
County Fire Protection District No. 4, Whatcom County, Washington, authorized and ordered by

RESOLUTION NO. 2000-4
A RESOLUTION of the Board of Commissioners of Whatcom
County Fire Protection District No. 4, Whatcom County,
Washington, providing for a form of the ballot proposition and
specifying certain other details concerning submission to the
qualified electors of the district at a special election to be held
therein on November 7, 2000 for the issuance of its general
obligation bonds in the aggregate principal amount of $2,900,000
for the purpose of providing funds to finance a fire station
headquarters and a training facility and to repay a loan.
WHEREAS, Whatcom County Fire Protection District No. 4, Whatcom County,
Washington (the "District") is in need of new fire protection and training facilities in order to
provide the residents and property owners within the District with adequate fire protection and
life safety facilities; and
WHEREAS, in order to provide all or a part of the funds to enable the District to acquire,
construct, equip and to expand and make such necessary capital improvements, it is deemed
necessary and advisable that the District issue and sell its unlimited tax general obligation bonds
to provide funds for such purposes; and
WHEREAS, the Constitution and laws of the State of Washington provide that the
question of whether or not such bonds may be issued and sold for such purposes must be
submitted to the qualified electors of the District for their ratification or rejection;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS
OF WHATCOM COUNTY FIRE PROTECTION DISTRICT NO. 4, WHATCOM COUNTY,
WASHINGTON, as follows:
Section 1. Findings. This Board of Commissioners (the "Board") hereby finds and
declares that the best interest of the residents and property owners of the District requires the
District to carry out the plans hereinafter provided at the time or times and in the order deemed
most necessary and advisable by the Board.
Section 2. Capital Improvements and Loan Repayment. The District shall undertake
the following program of capital improvements: the District shall purchase real property and
design, construct and equip a fire station headquarters building and a training facility with
appropriate fixtures and apparatus (the "Projects"). The District shall also repay a loan which
was used to finance capital improvements to District facilities in the amount of $900,000. The
cost of constructing, developing and acquiring the Projects and all costs incidental thereto and
repaying the loan, including, but not limited to, engineering, architectural, planning, financial
and legal services, incidental to the Projects and to the issuance of the bonds, is estimated to be
$2,900,000.
The Board shall determine the application of money available as between the various
Projects so as to accomplish, as nearly as may be, all Projects described or provided for in this
section. The Board shall determine the exact location, extent and specifications for construction
of structures or other improvements. If the Board shall determine that it has become impractical
to accomplish any of the Projects or portions thereof by reason of changed conditions,
incompatible development, costs substantially in excess of the amount of the bond proceeds
estimated to be applied thereto, or acquisition by a superior governmental authority, the Board
shall not be required to accomplish such Project and may apply bond proceeds as set forth in
section 4 of this resolution. In the event that the proceeds of sale of the bonds, plus any other
money of the District legally available, are insufficient to accomplish all of the Projects provided
by this section, the District shall use the available funds for paying the cost of those Projects
deemed by the Board most necessary and in the best interest of the District
Section 3. Authorization of Bonds. For the purpose of providing all or a part of the
funds necessary to pay the cost of the Projects described in Section 2 of this resolution and to
repay a loan, together with incidental costs and costs related to the sale and issuance of the
bonds, the District shall issue and sell its unlimited tax general obligation bonds in the principal
amount of not to exceed $2,900,000. The balance of the cost of such improvements shall be paid
out of any moneys which the District now has or may later have on hand which are legally
available for such purposes. None of said bond proceeds shall be used for the replacement of
equipment or for any other than a capital purpose. Such bonds shall be issued in an amount not

exceeding the amount approved by the qualified electors of the District as required by the
Constitution and laws of the State of Washington or exceeding the amount permitted by the
Constitution and laws of the State of Washington.
Section 4. Details of Bonds. The bonds provided for in Section 3 hereof shall be sold
in such amounts and at such time or times as deemed necessary and advisable by this Board and
as permitted by law, shall bear interest at a rate or rates not to exceed the maximum rate
permitted by law at the time the bonds are sold, and shall mature in such amounts and at such
times within a maximum term of twenty (20) years from date of issue, but may mature at an
earlier date or dates, as authorized by this Board and as provided by law. Said bonds shall be
general obligations of the District and, unless paid from other sources, both principal thereof and
interest thereon (including original issue discount) shall be payable out of annual tax levies to be
made upon all the taxable property within the District without limitation as to rate or amount and
in excess of any constitutional or statutory tax limitations. The exact date, form, terms and
maturities of said bonds shall be as hereafter fixed by resolution of the Board of Commissioners.
After voter approval of the bond proposition and in anticipation of the issuance of such bonds,
the District may issue short term obligations as authorized and provided by Chapter 39.50 RCW.
Section 5. Bond Election. It is hereby found and declared that an emergency exists
requiring the District to submit to the qualified electors of the District the proposition of whether
or not the District shall issue such bonds for the foregoing projects, at a special election to be
held therein on November 7, 2000. The Whatcom County Auditor, as ex officio supervisor of
elections, is hereby requested also to find the existence of such emergency and to call and
conduct the special election within the District on such date and to submit to the qualified
electors of the District the proposition hereinafter set forth. The Secretary of the District is
hereby authorized and directed to certify the proposition to the county auditor in the following
form:

acquire, design, construct and equip a fire station headquarters and a
training facility and to repay loan, issue $2,900,000 of general
obligation bonds maturing within a maximum term of 20 years, and
levy property taxes annually in a ess of regular property tax levies to

I am the deputy prosecutor who was handed the task to review your (I think) proposed ballot title for the
above fire district. I am aware of the recent legislative changes to RCW 29.79.055 and 29.27.060.
Nonetheless I have revised your suggested language as set forth below. Note, I changed the reference
to the loan repayment to clarify that it was a pre-existing loan; this conclusion drawn by me from its
description in the first paragraph of page 2 of the District's resolution # 2000-4. Given the changes I
made I thought I ought to give your firm an opportunity to offer any comments to me before I turned my
work over the Auditor. Please respond via email, as that is the quickest method to reach me. Thanks.

Voter Affidavit. Your signature is compared to your

2. In the Ballot Guide, to the right of each measure or
candidate, is a number which is assigned to a
position on your Ballot Card.
3. Use a paper clip, tooth pick or sharp pencil to
punch out the pre -scored square located just
above the number assigned to the candidate or
measure.
4. Write in candidates may be voted for by using the
space provided on the flap attached to your ballot
card. You must list both the Name and Office of the
write-in candidate and the Political Party in
Partisan races. Do not punch out a position
number for any other candidate for that office.
5.After you have finished voting, place your Ballot
Card in the Ballot Security Envelope.
6. Place the Ballot Security Envelope containing_ your

7. Put a first-class stamp on the envelope and mail it
so it is postmarked no later than the day of the
