HomeMy WebLinkAbout1944 - Fire Protection District 2, Formation & Annexation Organized April 21, 1944BEFORE THE, BOLR.D OF COUNTY COMMISSIONERS OF WHATCOM COUNTY, WASHINGTON IN THE 4ATTER OF THE FORMATION OF A FIRE ) PROTECTION DISTRICT IN GENEVA TOWNSIUP ( RESOLUTION OF WHATCO;d COUNTY, WASHINGTON } THERF.AS, on February 15, 1944, there was filed with this Board of County Commissioners a petition, petitioning said Board, under the provisions of Chapter 34, Laws of 1939, to take the action necessary for the formation of a Fire Protection District, embracing lands hereinafter particularly described, and THEREAS, the said petition was duly checked by the County Auditor and found to be sufficient and in all respects conforming to the law, and WHEREAS, the said petition alleges that the formation of said .proposed Fire Protection District will be conducive to the public welfare, safety and convenience, and WHEREAS, this Board did, on the 15th day of February, 1944, by resolution adapted in regular adjourned session of the Board, fix the time and place for hearing on said petition, at 10:00 o'clock A.k., on Friday, march 17, 1944, in the Commissioners' office in the Court House in Bellingham, Washington, and notices of said hearing were duly -nd regul_arly posted and published, all in conformity with the law, and WHEREAS, said public hearing was duly and regularly held at the time and place fixed in said notice of public herring, and the Board hearing all arguments for and against the formation of the proposed Fire Protection District, Emd the Board being satisfied that all proceedings heretofore had in the matter are in substantial compliance with the provisions of law, and that the formation of such District wiil be conducive to the public welfare, safety and convenience, NOWO 1EREFORE0 BE IT RESOLVED: 1. That subject to the ap?rovel of two --thirds of the qualified and registered electors, residing within the boundaries of the proposed Fire Protection District, who shL11 vote upon the proposition of the formation of the proposed district, at a special election hereinafter provided for in this resolution, the proposed district to be designated as wWRATCOld COUNTY FIRE PROTECTION DISTRICT NO. 2" 2. That the proposed district comprise the l9azds situated in Geneva Township of Whatcom County, Washington, lying within the following described boundaries, to -wit: Beginning at the point of intersection of the Forth and South center line of Section 36, T. 38 N, R 3 E.W.M., and the southerly shore line of Lake Whatcom, thence South along said North and South center line of Section 36 to a point one hundred fifty (150) feet South of and at right angles to the center of Lake Whzitcom Boulevard paved road; thence along a line one hundred fifty (150) feet distant from and parallel to the center line of said Lake Whatcom Boulevard to an intersection with Fremont Avenue in Amended Plat of Geneva; thence West along said Fremont Avenue to Lake, or Austin Street; thence South on said Lake, or Austin Street one block; thence West &.long Fifth Street, plat of West Geneva, two blocks to Depot Street; thence North on Depot Street one block to Fourth Street; hence West on said Fourth Street between the plat of Clarks Acre Tracts and plat of Kershaws Acre Tracts to Terrace Avenue South; thence along said Terrace Avenue South to an intersection with the Lake Whatcom Boulevard pavement; thence Northerly and Westerly along said pa.vemerit and the South line of Section 27, T. 38 N, R 3 E.W.14. to an intersection with the East boundary of the City of Bellingham said point being the S.W. 1/4 section corner said section 27; thence north along the East boundary of the City of Bellingh�.m, being, the West line of the S.W. 1/4 said section 27 one half mile to the West one quarter corner said section 27; thence East along the South boundary of the City of Bellingham, said line being the East and West center line of said section 27 to an intersection with the Westerly Shore line of Lake Whatcom; thence Southerly and Westerly along the Southerly Shore Line of Lake Whatcom and around Echo Point to the place of beginning. 3. That Robert Renauf, Charles Cline and Earl Le©alley, being residents of said proposed Fire Protection District and ;qualified in all respects to act, be, and they are hereby nominated by this Board as candidates for the first Board of ,Fire District Commissioners in said proposed Fire Protection District. 4. That the Whatcom County Election Board, be and it is hereby directed to call and hold a special election in said proposed Fire Protection District, on the 21st day of April, 1941+1 for the pury)ose of determining whether or not said proposed Fire Protection District shall be finally formed and also the election of the first Board of Fire District Commissioners for said District, all as provided in Chapter 34, Session Laws of 1939.
