R.C.W. 52,04.011, (3) provides that should such petition be signed by sixty percent of the qualified registered electors residing within the territory proposed to be annexed and should the fire commissioners concur therein, an election in such territory and a hearing on such petition shall be dispensed with and the County Council shall enter its order incorporating such territory within the said existing fire protection district. The enclosed Certificate of Sufficiency has been forwarded to the County Council for their action. (Please see instruc- tions and legal description of area to be annexed on the second page.) We, the undersigned, being registered voters resident in the Deming area proposed for annexation to Whatcom County Fire Protection District 1, State of Washington, do hereby petition the District 1 Commissioners to incorporate this area [.jithin their, district. We petitioners believe that extending the boundary of District 1 shall be conducive to the public safety, welfare and convenience and will be a benefit to the property in the annexed area. The area to be annexed is recommended for a rural forestry designation and according to county planners needs to be included in a fire district. Station # 2 of Fire District 1 is located in close proximity and [,,sill provide the facilities and ser- vices needed to protect property in the area. We understand the county property taxes will be increased in the amount of the fire district levy. The current fire district levy for Fire District 1 is .86142 per $ valuation. COMMITTEE ACTION TAKEN. - COUNCIL ACTION TAKEN.- 5/26/92: Referred back to committee. 6/9/92: Council adopted the ordinance. 7-0 Related File Numbers: Ordinance or Resolution Number (this item only): 092-030 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 t"irel.ord 4/27/92 SPONSORED BY: Consent AB91-200E PROPOSED BY: Citizens INTRODUCTION DATE: 5-5-92 ORDINANCE NO. 92-030 REGARDING THE ANNEXATION OF CERTAIN PROPERTIES NEAR DENIING INTO FIRE PROTECTION DISTRICT NO. 1 WHEREAS, Whatcom County Council Resolution 92-011 encouraged the annexation of unincorporated areas into existing fire protection districts; and WHEREAS, the Council is considering an ordinance that would prohibit the issuance of building permits in areas not included in a fire protection district; and WHEREAS, citizens living near Deming have petitioned for incorporation into existing Fire Protection District No. 1; and WHEREAS, the Auditor certified that the petition bears the signatures of at least 60 percent of the qualified electors within the area proposed to be annexed; and WHEREAS, the commissioners of Fire District No. 1 have offered their written consent to the proposed annexation; and WHEREAS, Section 52.04.011 (3) of the Revised Code of Washington provides that if a petition is signed by 60 percent of the qualified registered electors residing within the territory proposed to be annexed, and if the board of fire commissioners concur, an election in the territory and a hearing on the petition shall be dispensed with and the county legislative authority shall enter its order incorporating the territory into the existing fire protection district; and WHEREAS, the Council scheduled this proposal for a hearing and had notice of such hearing posted in three public places within the area proposed for annexation; and WHEREAS, the petition signed by 60 percent of the qualified electors within the district stated that county property taxes would be increased in the amount of the fire district levy and bond repayment obligation (the amount of taxes in District 1 is $.86132 per $1,000 of assessed valuation for the regular levy and bond issues by the district), and that unimproved lands may be exempt under stat law if they meet certain conditions; and WHEREAS, the proposed annexation would benefit the public health, safety and welfare; NOW, THEREFORE, BE IT ORDAINED that the Whatcom County Council Fire District 1 Annexation Page I 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 hereby enters its order incorporating the area described below into Fire Protection District No. 1: North 1/2 of Northwest 1/4 of Township 39 Range 5E Section 31; South 1/2 of Southwest 1/4 of Township 39 Range 5E Section 30; any portion of the South half of the Northwest quarter of Township 39 Range 5E Section 31 not already included in the existing fire district. BE IT FURTHER ORDAINED that as stipulated by the Revised Code of Washington, Section 52.04.011 (3), upon entry of this order the territory shall become subject to the indebtedness, bonded or otherwise, of the existing district, provided that the property owners of the existing district shall be placed on a fair and equitable relationship with the property owners of the territory being annexed. COMMITTEE ACTION TAKEN: COUNCIL ACTION TAKEN: 5/26/92: Referred back to committee. 6/9/92: council adopted the ordinance. 7-0 Related File Numbers: Ohiinm:ce or Resolution Number (this item only): 092-030 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 fiml.ord 4/27/92 SPONSORED BY: Consent AB91-200E PROPOSED BY: Citizens INTRODUCTION DATE: 5-5-92 ORDINANCE NO. 92-030 REGARDING THE ANNEXATION OF CERTAIN PROPERTIES NEAR DEMING INTO FIRE PROTECTION DISTRICT NO. 1 WHEREAS, Whatcom County Council Resolution 92-011 encouraged the annexation of unincorporated areas into existing fire protection districts; and WHEREAS, the Council is considering an ordinance that would prohibit the issuance of building permits in areas not included in a fire protection district; and WHEREAS, citizens living near Deming have petitioned for incorporation into existing Fire Protection District No. 1; and WHEREAS, the Auditor certified that the petition bears the signatures of at least 60 percent of the qualified electors within the area proposed to be annexed; and WHEREAS, the commissioners of Fire District No. 1 have offered their written consent to the proposed annexation; and WHEREAS, Section 52.04.011 (3) of the Revised Code of Washington provides that if a petition is signed by 60 percent of the qualified registered electors residing within the territory proposed to be annexed, and if the board of fire commissioners concur, an election in the territory and a hearing on the petition shall be dispensed with and the county legislative authority shall enter its order incorporating the territory into the existing fire protection district; and WHEREAS, the Council scheduled this proposal for a hearing and had notice of such hearing posted in three public places within the area proposed for annexation; and WHEREAS, the petition signed by 60 percent of the qualified electors within the district stated that county property taxes would be increased in the amount of the fire district levy and bond repayment obligation (the amount of taxes in District 1 is $.86132 per $1,000 of assessed valuation for the regular levy and bond issues by the district), and that unimproved lands may be exempt under stat law if they meet certain conditions; and WHEREAS, the proposed annexation would benefit the public health, safety and welfare; NOW, THEREFORE, BE IT ORDAINED that the Whatcom County Council Fire District 1 Annexation Page 1 1 hereby enters its order incorporating the area described below into Fire Protection 2 District No. 1: 3 4 North 1/2 of Northwest 1/4 of Township 39 Range 5E Section 31; South 5 1/2 of Southwest 1/4 of Township 39 Range 5E Section 30; any portion of the 6 South half of the Northwest quarter of Township 39 Range 5E Section 31 not 7 already included in the existing fire district. 8 BE IT FURTHER ORDAINED that as stipulated by the Revised Code of 9 Washington, Section 52.04.011 (3), upon entry of this order the territory shall become 10 subject to the indebtedness, bonded or otherwise, of the existing district, provided that 11 the property owners of the existing district shall be placed on a fair and equitable 12 relationship with the property owners of the territory being annexed. 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 ADOPTED this 91--h day of June , 1992.
