A RESOLUTION OF THE BOARD OF DIRECTORS OF FERNDALE
SCHOOL DISTRICT No. 502, WHATCOM COUNTY, WASHINGTON,
PROVIDING FOR THE SUBMISSION TO THE QUALIFIED ELECTORS
OF THE DISTRICT AT A SPECIAL ELECTION TO BE HELD
THEREIN ON FEBRUARY 6, 1990, OF A PROPOSITION OF
WHETHER OR NOT THERE SHOULD BE LEVIED EXCESS TAXES
FOR COLLECTION IN 1991 AND 1992 OF APPROXIMATELY
$1,985,000 PER YEAR FOR THE DISTRICT'S GENERAL FUND
TO PAY PART OF THE GENERAL EXPENSES OF MAINTENANCE
AND OPERATION OF THE DISTRICT.
WHEREAS, the money in and to be paid into the General Fund
of Ferndale School District No. 502, Whatcom County, Washington,
(the "District") during 1991 and 1992 will be insufficient to
enable the District to take care of all of its necessary
financial obligations and to properly meet the educational needs
of students attending District's schools; and
WHEREAS, in order to provide for such financial obligations
and educational needs, it is deemed necessary that additional
taxes in the amounts set forth in Section 2 herein be levied for
the District's General Fund upon all of the taxable property
within the District in excess of the maximum annual tax levy
permitted by law without a vote of the electors; and
WHEREAS, the Constitution and laws of the state of
Washington require that the question of whether or not such
excess tax may be levied must be submitted to the qualified
electors of the District for their ratification or rejection;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of
Ferndale School District No. 502, Whatcom County, Washington, as
follows:
1. Declaration of Need. It is hereby found and declared
that the welfare of the students and other residents of the
District requires the District to carry out the plans described
herein to pay part of the general expenses of the maintenance
and operation of the District.

2. Excess Taxes. In order to provide funds for the
maintenance and operation of the District as described in
Section 3 below, the following taxes for the District's General
Fund should be levied upon all of the taxable property within
the District in excess of the maximum annual tax levy permitted
by law to be levied for the District without a vote of the
electors:

3. Voter Approval; Use of Levy Funds. Upon approval by
the District's voters of the ballot proposition described in
Section 4 below, the District may use the proceeds of the levies
to pay such part of the general expenses of the maintenance and
operation of the District as may be authorized or allowed by law
for the use of excess levy funds, and to repay warrants or other
lawful indebtedness incurred to defray such maintenance and
operation expenses.
4. Declaration of Emergency; Election. It is hereby found
and declared that an emergency exists requiring the submission
of the proposition of whether or not such excess taxes should be
levied for ratification or rejection by the qualified electors
of the District, at a special election to be held on February 6,
1990. The Whatcom County Auditor as ex officio supervisor of
elections in said county is hereby requested to also find the
existence of such emergency and to call and conduct the special
election to be held within the District on said date and to
submit to the qualified electors of the District the proposition
set forth below. The Secretary of the Board of Directors is
hereby authorized and directed to certify the proposition in the
following form:

A RESOLUTION OF THE BOARD OF DIRECTORS OF FERNDALE
SCHOOL DISTRICT No. 502, WHATCOM COUNTY, WASHINGTON,
PROVIDING FOR THE SUBMISSION TO THE QUALIFIED ELECTORS
OF THE DISTRICT AT A SPECIAL ELECTION TO BE HELD
THEREIN ON FEBRUARY 6, 1990, OF A PROPOSITION OF
WHETHER OR NOT THERE SHOULD BE LEVIED EXCESS TAXES
FOR COLLECTION IN 1991 AND 1992 IN AN AGGREGATE TOTAL
AMOUNT OF $850,000 PER YEAR FOR DISTRICT CAPITAL PROJECTS.
WHEREAS, in order to provide adequate facilities for the
students of Ferndale School District No. 502, Whatcom County,
Washington (the "District"), it is necessary to make certain
capital improvements; and
WHEREAS, the District lacks sufficient funds with which to
make such improvements; and
WHEREAS, in order to provide funds to pay part of the cost
of such capital improvements, it is deemed necessary that
additional taxes in the amounts set forth in Section 2 herein
be levied upon all of the taxable property within the District
in excess of the maximum annual tax levy permitted by law
without a vote of the electors; and
WHEREAS, the Constitution and laws of the state of
Washington require that the question of whether or not such
excess taxes may be levied must be submitted to the qualified
electors of the District for their ratification or rejection;
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors
of Ferndale School District No. 502, Whatcom County,
Washington, as follows:
1. Declaration of Need. It is hereby found and declared
that the welfare of the students and other residents of the
District requires the District to carry out the plans described
herein to modernize and improve District facilities in the
manner and at the time or times deemed most advisable by the
Board of Directors of the District.

2. Excess Taxes. In order to provide $850,000 per year
for the modernization and improvement of District facilities as
described in Section 3 of this Resolution, the following taxes
should be levied upon all of the taxable property within the
District in excess of the maximum annual tax levy permitted by
law to be levied for the District without a vote of the
electors:

The foregoing levies shall be referred to in this Resolution as
the "Capital Levies."
3. Voter Approval; Use of Levy Funds. Upon approval by
the District's voters of the ballot proposition described in
Section 4 below and subject to the provisions of this Section 3,
the District may use the proceeds of the Capital Levies to
improve and modernize District facilities by acquiring land,
making initial site improvements, upgrading District athletic
facilities, acquiring computer laboratory facilities and making
other capital improvements to the District's facilities. The
acquisitions referred to above may be accomplished by direct
purchases with proceeds of the Capital Levies, by the issuance
of warrants against the District's Capital Projects Fund, or by
the execution of leases, conditional sales contracts, tax
anticipation notes, or other lawful obligations payable from
proceeds of the Capital Levies, all as hereafter determined by
the Board of Directors of the District, and subject to the
requirements of applicable law. In addition to the expenditures
referred to above, the Board of Directors reserves the right to
utilize proceeds of the Capital Levies for other lawful capital
purposes if any of the foregoing expenditures is later deemed
not feasible or in the best interests of the District. The
balance of the cost of the capital improvements shall be paid
from moneys which the District may have available for such
purposes, including grants from the state of Washington. If the
funds available are insufficient to make all of the capital
improvements described herein, the District shall use the
available funds for paying the cost of those portions of the
improvements deemed most necessary in the judgment of the Board
of Directors. If any funds from the Capital Levies remain
following the completion of all the capital improvements
described herein, the District may expend such funds for such
other purposes as may be authorized by law.

4. Declaration of Emergency; Election. It is hereby
