COUNTY OF WHATCOM ) THIS IS TO CERTIFY that we, as the Whatcom County Canvassing Board, have completed the canvass of votes as it pertains to the Special Election held in the precincts within the Whatcom County boundaries of Concrete School District No. 502, Whatcom County, Washington, on the 9th day of February 2010 and the results are as follows: Concrete School District No. 11 Proposition No. 1 Concrete School District Educational Operation and Maintenance Levies The Board of Directors of the Concrete School District No. 11 adopted Resolution No. 972 concerning a proposition for partial financing of the District's educational programs. This proposition would authorize the levy of the following excess taxes forthe District's General Fund upon all taxable property in the District, to address the educational needs of students, to replace the expiring levy, and to pay a portion of the District's operation and maintenance expenses: Approximate Levy Rate Per $1,000 Collection Year Assessed Valuation Levy Amount 2011 $2.380 $1,455.000 2012 $2.445 $1, 525,000 2013 $2.532 $1, 595,00 0 as specified in Resolution No. 972. YES #E ■4 NO 4M N CONCRETE SCHOOL DISTRICT RESOLUTION NO.972 THREE-YEAR EDUCATIONAL OPERATION AND MAINTENANCE LEVIES WHEREAS, the money in and to be paid into the General Fund of Concrete School District No. 11, Skagit and Whatcom Counties, Washington ("the District"), during the 2010-2011, 2011-2012, 2012-2013, and 2013-2014 school years will be insufficient to enable the District to pay for necessary operation and maintenance, and properly meet the educational needs of students attending District schools; and WHEREAS, in order to provide for such operation and maintenance and such educational needs, it is deemed necessary that additional taxes in the amounts set forth herein be levied for the District's General Fund upon all of the taxable property within the District in excess of the maximum annual tax levy permitted by law without a vote of electors; and WHEREAS, the Constitution and laws of the State of Washington require that the questions of whether or not such taxes may be levied must be submitted to the qualified electors of the District for their ratification or rejection; NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Concrete School District No. 11, Skagit and Whatcom Counties, Washington as follows: 1. Declaration of Need. It is hereby found and declared that the welfare of the students and other residents of the District requires the District to carry out the plans described herein to pay part of the general expenses of the operation and maintenance of the District. 2. Lew of Taxes. In order to provide funds for the operation and maintenance of the District as described in Section 3 below, the following taxes for the District's General Fund should be levied upon all taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied for the District without a vote of the electors: Lew Year Collection Year Lew Rate Lew Amount 2010 2011 $2.380 $1,455,000 2011 2012 $2.445 $1,525,000 2012 2013 $2.532 $1,595,000 * Approximate levy rate per $1,000 of assessed valuation (based on 100% of true and fair value). The excess taxes identified above replace the expiring operation and maintenance levies that were previously authorized by the voters of the District. Upon approval by the District's voters of the ballot proposition described in Section 4 below, the District may use the proceeds of the levies to pay such part of the general expenses of the operation and maintenance of the District as may be authorized or allowed by law for the use of excess levy funds, and to repay warrants or other lawful indebtedness incurred to defray such operation and maintenance expenses. 4. Declaration of Emereenev: Election. It is hereby found and declared that an emergency exists requiring the submission of the proposition of whether or not such excess taxes should be levied for ratification or rejection by the qualified electors of the District, at a special election to be held on February 9, 2010. The Skagit County Auditor, as ex officio supervisor of elections in said county, is hereby requested to also find the existence of such emergency and to call and conduct the special election to be held within the District on said date and to submit to the qualified electors of the District the proposition set forth below. The Secretary of the Board of Directors is hereby authorized and directed to certify the proposition in the following form: "PROPOSITION NO. 1" CONCRETE SCHOOL DISTRICT EDUCATIONAL OPERATION AND MAINTENANCE LEVIES The Board of Directors of the Concrete School District No. 11 adopted Resolution No. 972 concerning a proposition for partial financing of the District's educational programs.
