Debbie, With all due respect, I believe the statute is quite clear that there are two different ways to pass this levy, one in those instances where total turnout exceeds 40% from the last general election and one instance where the total turnout does not exceed 40%. Two key portions of the statute point that out (excerpted below). First, the language in yellow below states what is required to pass the levy "when the number of voters voting on the proposition does not exceed forty per centum of the number of voters voting in such taxing district in the last preceding general election." I am not sure how this language could be interpreted any way other than to provide a path to passage where you have less than 40% of the last general election turning out. Next, following this language, is the word OR which can only mean there is a second way to pass the levy, and the wording following "or" establishes the required threshold in those instances where more than 40% of the last general election participates in the levy vote. See below: by a majority of at least three -fifths of the voters thereof approving a proposition authorizing the levies submitted at a special election or at the regular election of the district, at which election the number of voters voting "yes" on the proposition must constitute three -fifths of a number equal to forty per centum of the number of voters voting in such district at the last preceding general election when the number of voters voting on the proposition does not exceed forty per centum of the number of voters voting in such taxing district in the last preceding general election; or by a majority of at least three -fifths of the voters thereof voting on the proposition if the number of voters voting on the proposition exceeds forty per centum of the number of voters voting in such taxing district in the last preceding general election Given this drafting, I do not see how the statute could possibly be interpreted to always require at least 40% of the last general election. That would render the whole first part of the statute meaningless up to and including "OR". Sincerely, Seth Seth A. Woolson Chmelik Sitkin & Davis P.S. In reviewing over these emails again, and the statute as well, I think this is a standard "super -majority" passage, which is the 40% from the last general election must turn out and then 60% of those voting in this election must say "Yes." I really don't think it goes into another option if the 40% isn't met. I have a call in to the Department of Revenue to clarify this. While the RCW language seems to be stating it twice, it is really saying the same thing both times. I will let you know as soon as I hear from Revenue but this standard supermajority passage is the only way I have seen it done. Royce and Debbie, Yes, I believe we are reading the statute the same way. Given the voter information from Debbie (attached), the Voter Threshold as defined in my explanation would be 420.8 votes (i.e. 60% of the total 1052 votes cast from the district boundaries in the last election). Thus, if there are 421 total votes on the levy, it will pass so long as 60% of the votes approve. YES If there are 420 or fewer total votes on the levy, the levy will only pass if it receives a MINIMUM of 253 yes votes (60% of 420.8 = 252.48, rounded up to 253) AND no at least 60% of votes cast were in support of the levy. Seth, Yes. The rule is tough to articulate (I've tried), so I had to read your (good) explanation a couple times with the highlighted statute in my hand. But I think I get it. Essentially: 1. The proposition requires a pure 60% of the vote if the total number of voters is above the 40% threshold. 2. Royce, Here is my analysis of the voting requirements under 36.69.145 for the levy. I'm going to discuss them in the reverse order that they are listed, because I think they are easier to understand that way. First, as a definitional explanation, each time the statute says "by a majority of at least three -fifths of the voters" I am reading that to mean "by a three -fifth's majority' or, alternatively, 60% of the voters. The statute sets up two different voting threshold requirements: i) one which applies if the total number of votes (i.e. "yes" plus "no" votes) on the levy proposition (the "Proposition") is greater than the number of votes determined by this formula: 40% X Total Votes in District in Last General Election (the "Vote Baseline") and ii) the other which applies if the total number of votes on the Proposition is less th-an, the Vote Baseline. Each thresholds are discussed below. Total Votes on Proposition are Greater Than Vote Baseline. In this scenario, the threshold to pass the Proposition is a simple 60% majority of the actual votes cast. So, in a real world example, let's assume that there were a total of 1,500 votes cast within the District boundaries during the last General Election. In that scenario, the Vote Baseline would be 600 votes. If the total number of votes (i.e. yes plus no) on the Proposition is 635 (i.e. more than the Vote Baseline), then the levy passes so long as 381 people vote Yes (i.e. 60% of 635 votes = 381 votes required to pass the Proposition). Total Votes on Proposition are Less Than Votes Baseline (i.e. the confusing one). In this scenario, the threshold to pass the Proposition is two -fold: first, at least 60% of the votes cast on the Proposition must be Yes and the number of Yes votes must be at least 60% of the Vote Baseline. In our real world example where the total votes cast within the District boundaries during the last General equal 1,500, our Vote Baseline is 600. So assume that the total number of votes (yes plus no votes) on the Proposition equals only 350. In order for the Proposition to pass, two things have to be true. First, at least 60% of the 350 must vote Yes. Second, a minimum threshold of voters, which can actually be more than 60% of the votes cast, must also vote Yes. The minimum threshold of votes is calculated by calculating 40% of the Vote Baseline, which in this case is a minimum threshold of 240 yes votes (40% X 600 = 240). So in a world where only 350 people vote on the Proposition (and where 1,500 voted in the last General), then the Proposition requires at least 240/350 votes to pass, i.e. 68.5%. Let me know if you concur with my analysis. I'd like to try running this with the actual vote numbers from the last general election of the District's boundaries so we can establish the real -life Vote Baseline, at a minimum. That's definitely in the top five most confusing statute's I've had to pick apart in recent memory. Seth Seth A. Our community will benefit greatly from local parks near our homes. To do this work the CVPRD will need the support of the residents in the form of a levy tax. This tax will allow equipment and land to be purchased for the formation of 3-4 local parks. These community gathering spaces will be planted in different neighborhoods so that no one need walk more than a half mile to visit a park! A vote of Yes will also allow continued maintenance of these spaces. We encourage each citizen to envision our community with parks for the young and old of our community and vote once again, resoundingly Yes to parks. Six -year regular property tax levies--Limitations--Election Effective: July 1, 2010 Currentness (1) A park and recreation district may impose regular property tax levies in an amount equal to sixty cents or less per thousand dollars of assessed value of property in the district in each year for six consecutive years when specifically authorized so to do by a majority of at least three -fifths of the voters thereof approving a proposition authorizing the levies submitted at a special election or at the regular election of the district, at which election the number of voters voting "yes" on the proposition must constitute three -fifths of a number equal to forty per centum of the number of voters voting in such district at the last preceding general election when the number of voters voting on the proposition does not exceed forty per centum of the number of voters voting in such taxing district in the last preceding general election; or by a majority of at least three -fifths of the voters thereof voting on the proposition if the number of voters voting on the proposition exceeds forty per centum of the number of voters voting in such taxing district in the last preceding general election. A proposition authorizing the tax levies may not be submitted by a park and recreation district more than twice in any twelve-month period. Ballot propositions must conform with RCW 29A.36.210. In the event a park and recreation district is levying property taxes, which in combination with property taxes levied by other taxing districts subject to the one percent limitation provided for in Article 7, section 2, of our state Constitution result in taxes in excess of the limitation provided for in RCW 84.52.043(2), the park and recreation district property tax levy must be reduced or eliminated as provided in RCW 84.52.010. (2) The limitation in RCW 84.55.010 does not apply to the first levy imposed under this section following the approval of the levies by the voters under subsection (1) of this section. This proposition would authorize the District to set and maintain a regular property tax levy of $0.60 or less per $1,000.00 of assessed valuation for 2017 to be collected in each year succeeding the year of the levy for six (6) consecutive years pursuant to RCW 36.69.145 and subject to any otherwise applicable statutory dollar rate limitations, all as more particularly set forth herein. WHEREAS, the District was formed in 2016 pursuant to a vote submitted to the voters within the District boundaries under Chapter 36.69 RCW for purposes of constructing and maintaining public parks within the District's boundaries, and; WHEREAS, the District has no regular property tax levy authority unless the voters of the District vote to approve a six (6) year regular property tax levy pursuant to RCW 36.69.145, and; WHEREAS, without the voters' approval for a regular property tax levy, the District has no funds with which to permit the District to begin constructing and/or maintaining public parks within its boundaries, thereby rendering the District unable to provide new sources of recreation within the District, and that it is, therefore, necessary that the regular property tax levy of the District be set at $0.60 or less per $1,000.00 for a six (6) year period on taxable property within the District (such assessed value representing 100% of true and fair value unless specifically provided otherwise by law), in order for the District to have funds to begin undertaking the purposes for which it was created, and; WHEREAS, the Constitution and the laws of the State of Washington require that the question of whether such taxes may be levied must be submitted to the qualified electors of the District for their ratification or rejection. NOW, THEREFORE be it resolved by the Board of Commissioners of the Columbia Valley Parks and Recreation District as follows: Section 1. The Auditor of Whatcom County, Washington, as ex officio Supervisor of Elections (the "Auditor"), in conjunction with the State general election to be held on November 7, 2017, to submit to the voters of the District, for their approval or rejection, a proposition of whether the regular property tax levy of the District shall be set at and maintained at $0.60 or less per $1,000.00 of assessed value for six (6) consecutive years; such levy to be for collection in 2018 and thereafter in each of the allowed six (6) years, on all the taxable property within the District (such assessed value representing 100% of true and fair value unless specifically provided otherwise by law), and the dollar amount of this levy would be used for the purpose of computing the limitations for subsequent levies under RCW 36.69.145, subject to otherwise applicable statutory limitations. Passage of Proposition No.1 will allow the District to establish the levy rate to $0.60 or less per $1,000.00 of assessed valuation for a six (6) year period as otherwise authorized by law.
