Hi Stacy,
I did some more digging. I found that Resolution 2016-023 was approved with the same language that appeared on the
petitions. The ordinance file contains a letter from the Assessor's office stating that they reviewed the legal description and
found that "the legal description of the proposed district does not sufficiently describe a geographical area with enough
certainty for the Assessor's Office to administrate" and "there appears to be errors in dimensions stated in the written
description". After that, there is a new map and legal description and a strike version of the legal along with the new legal. I'm
attaching all of those documents here. I did check the minutes as well and it does not look like there was a discussion regarding
the legal description. I wish I had some more detail to offer you, but hopefully that offers a little clarity.

Thank you for sending the Petition packet by email yesterday. I have attached the ordinance establishing the
Columbia Valley Park and Recreation District. We are trying to understand why the legal description in the petition is
different than the legal description in the ordinance. Do you have any minutes or notes explaining how this occurred?
The voters cast their vote based on the legal in the petition not in the ordinance.

I have reviewed Resolution No. 2016-023 accepting a petition to create the
Columbia Valley Park and Recreation District. The Whatcom County Assessor's
Office administrates the levy of property taxes on behalf of taxing jurisdictions.
RCW 36.69.020 states "The formation of a park and recreation district shall be
initiated by a petition designating the boundaries thereof by metes and bounds,
or by describing the land to be included therein by townships, ranges and legal
subdivisions."
Our review of the legal description finds the following items:
The legal description of the proposed district does not sufficiently describe
a geographical area with enough certainty for the Assessor's Office to
administrate.
There appears to be errors in dimensions stated in the written description.

PETITION TO CREATE THE COLUMBIA VALLEY PARK AND RECREATION DISTRICT
Initiative No. 2016-1
Whereas the Columbia Valley and surrounding area is a community of families and individuals who seek to benefit from a park and
dedicated outdoor space, and recreational facilities as described in RCW 36.69.010 to serve to enrich community recreational and leisure
opportunities, children and adult physical well-being, nurture neighborly connection, and
Whereas the Foothills Subarea Plan provides for the creation of a park in the Urban Growth Area; and
Whereas RCIN 36.69,020 provides for creation of a park and recreation district by petition and for boundaries of the district as set forth in
the petition; and
Whereas RCW 36.69.090, provides that five elected commissioner volunteer positions may be designated in the formation of a park district;
and
Whereas a general tax on all property located in said Park and Recreation District shall not exceed sixty cents per thousand of assessed
value each year as outlined in chapter 36.69.145 of Washington State Code, unless otherwise authorize by law, the exact amount to be
determined by the elected board of volunteer commissioners with no more than ten percent of revenue used for administrative purposes.
NOW, THEREFORE
1. The Columbia Valley Park and Recreation District should be hereby created. The district boundaries generally would include Y.
mile north of where South Pass road and Silver Lake Road meet on Hwy 547 (Kendall HWY). It will encompass the properties
east and west of that point about 1 mile each way to the foothills of both Red Mountain to the East and Paradise Mountain to the
west and proceed South it will contain Paradise Lakes Country Club divisions 1 through 8 and Campers Paradise, as well as the
properties surrounding that area up to the foothills to the East and West It will also contain Peaceful Valley and the properties
both East and West of them to the foothills. It will continue South to include the Kendall Elementary School, the Fire Department,
library, and commercial properties around the intersection of Hwy 547 and Hwy 542. Then it will continue down Hwy 542
including the properties both East and West of Hwy 542 up to the Northern most boundary of the Black Mountain Ranch.
Excluding all commercial or rural forestry land contained within these boundaries as now or hereafter established.
2. Pursuant to RCW 36.69,090, the Park and Recreation District's board of commissioners shall be composed as follows: five
elected Volunteer Park and Recreation Commissioners.

ORDERING AN ELECTION TO DETERMINE THE FORMATION OF
THE COLUMBIA VALLEY PARK AND RECREATION DISTRICT
WHEREAS, on June 22, 2016, a petition proposing the creation of a park and
recreation district in the Columbia Valley was delivered to the County Council Office; and
WHEREAS, the petition met the requirements of RCW 36.69-.020; and
WHEREAS, on June 28, 2016, the County Council approved Resolution 2016-023,
officially roc: iving the petition into the record and scheduling a public hearing on the proposal;
and
WHEREAS, the County Council held a public hearing on the petition on July 26, 2016,
as required by RCW 36.69; and
WHEREAS, the next step in the park and recreation district formation process requires
the Council to establish the boundaries of the proposed park and recreation district, establish
its name, and call for an election of the property owners residing within the proposed district
boundaries to determine whether- the district shall be formed.
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that the
proposed district shall be known as the Columbia Valley Park and Recreation District.
BE IT FURTHER ORDAINED that the boundaries of the proposed district, as
submitted by the petitioners, shall be as outlined in Exhibit A to this ordinance.
BE IT FINALLY ORDAINED that the proposal to form the Columbia Valley Park and
Recreation District is hereby forwarded to the County Auditor for inclusion on the November

You have the opportunity to create the Columbia Valley Park & Recreation District (CVPRD). The
District develops the means for our community to provide places to enjoy by collecting property
taxes to be used to create local parks. The cost to taxpayers is minimal, the benefits far reaching.
Parks increase property values. The CVPRD will establish neighborhood parks near our homes.
American Planning Association states that parks decrease violent crimes and increase relationships
between citizens. Parks are places to meet and connect, enjoy being outdoors, and improve health.
Parks may become multi -functional to include dog walking, picnic, playgrounds, BBQ areas or used
for local events. They may be integrated into community trail systems, helping to build healthy
bodies. Parks give youth a safe place to engage in positive play and while getting out from in front of
the screen.
Currently the closest park with playground equipment is Silver Lake Park,a 15 minute drive away.
Local parks will decrease this to a 2-5 minute WALK from home.
CVPRD management will be provided by a board of five(5) volunteer commissioners elected by our
community. District residents will have a voice in operations and management through open public
meetings. Please vote yes!

Bellingham, WA, August 5, 2016: A special three-day filing period will be held at the Whatcom
County Auditor's Office from August 10 — August 12, 2016. The special filing period will be for
five commissioners of the proposed Columbia Valley Park and Recreation District.
The formation of the park district will go before voters on the November 8 General Election
ballot. The election of five commissioners will also be on the ballot. If the park district is
approved, the initial terms of office for three of the commissioner positions will be three-year
terms and two positions will serve a one-year term. If voters do not approve the formation of the
park district, the election of the five commissioners will be voided.
Citizens who qualify to run for these positions are encouraged to apply. Declaration of
Candidacy forms are available at the Whatcom County Auditor's Office or online at:
www.whatComcounty.uslauditor
Declarations may be filed by mail or in person and must be received in the Auditor's Office, 311
Grand Avenue, Suite 103, Bellingham, no later than 4:30 p.m. Friday, August 12, 2016.
Filings received after the deadline are invalid and will be returned to the applicant, irrespective
of postmark.

ORDINANCE NO. 2016-029
ORDERING AN ELECTION TO DETERMINE THE FORMATION OF
THE COLUMBIA VALLEY PARK AND RECREATION DISTRICT
WHEREAS, on June 22, 2016, a petition proposing the creation of a park and
recreation district in the Columbia Valley was delivered to the County Council Office; and
WHEREAS, the petition met the requirements of RCW 36.69.020; and
WHEREAS, on June 28, 2016, the County Council approved Resolution 2016-023,
officially receiving the petition into the record and scheduling a public hearing on the proposal;
and
WHEREAS, the County Council held a public hearing on the petition on July 26, 2016,
as required by RCW 36.69; and
WHEREAS, the next step in the park and recreation district formation process requires
the Council to establish the boundaries of the proposed park and recreation district, establish
its name, and call for an election of the property owners residing within the proposed district
boundaries to determine whether the district shall be formed.
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that the
proposed district shall be known as the Columbia Valley Park and Recreation District.
BE IT FURTHER ORDAINED that the boundaries of the proposed district, as
submitted by the petitioners, shall be as outlined in Exhibit A to this ordinance.
BE IT FINALLY ORDAINED that the proposal to form the Columbia Valley Park and
Recreation District is hereby forwarded to the County Auditor for inclusion on the November
General Election ballot.

Explanatory Statement: Columbia Valley Parks & Recreation District
If successful, this ballot measure will create a Parks & Recreation District to
provide oversight for the development of county parks within the Columbia Valley for
public use.

Hello Debbie and Dana,
I have unfortunate news. After months of making announcements at our Columbia Valley Park meetings,
followed by announcement at the East Whatcom Communitv Council, contacting Kendall Watch chair, posting
on the neighborhood online community, Nextdoor, our Facebook Web page, asldng folks who refused to sign
the petition, and Dana's press release we have no person(s) willing to be on the con committee.
At this time we are at wits end as we have not been able to find anyone to serve in these roles. 1 am personally
baffled as I thought this would not be so difficult even as conversely I am gladdened to have so much
community support.
Sorry for any difficulties this causes and am happy to support in any ways you suggest to address this, as is the
rest of the Columbia Valley Parks Committee.
