Restrictions on Rental Fees
Initiative 25-01 concerns banning certain rental housing fees. This measure would prohibit excessive,
retaliatory, and unreasonable optional fees as a rental condition, would nullify violating lease terms, and
allow enforcement via civil action or code enforcement authority.

RESOLUTION #25-08-04-B
A RESOLUTION OF THE COUNCIL OF THE CITY OF FERNDALE,
WASHINGTON, PROVIDING FOR INITIATIVE 25-01, REGARDING
CONSUMER PROTECTION FOR HOUSING TENANCY FEES, TO BE SUBMITTED
TO THE QUALIFIED VOTERS OF THE CITY OF FERNDALE ON NOVEMBER 4,
2025
WHEREAS, Ordinance #1222 was adopted on October 18, 1999, granting the City
of Ferndale and its voters the powers of initiative and referendum; and
WHEREAS, Community First Whatcom submitted an initiative application to the
Whatcom County Auditor on March 26, 2025; and
WHEREAS, the City of Ferndale received a Certificate of Sufficiency from the
Whatcom County Auditor on July 8, 2025, confirming that adequate signatures had
been collected to allow the City Council to either adopt the initiative as presented,
or submit the initiative to a vote of the people; and
WHEREAS, City Council declined to adopt the initiative as presented at the July 21,
2025 meeting;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FERNDALE DO
RESOLVE AS FOLLOWS:
Section 1. Pursuant to RCW 29A.04.330, the Ferndale City Council hereby calls for
submission of Initiative 25-01 to the qualified voters of the City. The Whatcom County
Auditor is hereby requested to call the election in the City of Ferndale on November 4,
2025 in conjunction with the general election to be held on that date.
Section 2. The initiative to be submitted to the electorate of the City of Ferndale shall
read substantially as follows:
Initiative Measure No. 25.01 concerns banning certain rental housing fees. This measure
would prohibit excessive, retaliatory, and unreasonable optional fees as a rental condition,
would nullify violating lease terms, and allow enforcement via civil action or code
enforcement authority. Should this measure be enacted into law?

APPROVED AND ADOPTED by the City Council of the City of Ferndale in regular session
