Filing Proposed Ballot Measures for Inclusion in
Election (Cities only)
(AUDITOR'S OFFICE — Elections)
This procedure applies to Auditor's staff, the Assessor's Office, and representatives of the cities
submitting proposed ballot measures.
Actions by Representative of Cities:
1. Submits proposed ballot measure to Auditor's Office at least 46 days prior to the election
date for a special election, no later than the Friday immediately before the first day of regular
candidate filing for the primary election, or no later than the day of the primary for a general
election.
Actions by Election Clerk:
v12. If received by mail or courier (e.g., Fourth Corner Network), gives to Office Coordinator to
complete steps 3-7.
A(,t 4 If received over the counter, date stamps first page only of the submittal.
AC, -"4. Checks that resolution contains original signatures by a majority of commissioners or other
legislative body or certified copy by clerk. Ensures that the date of the election is stated.
4A. If not original signatures, returns paperwork to submitter to obtain appropriate

#5. Prepares Ballot Measure Receipt (See FRM #AU470090A). Makes a copy for file and
gives original to filer. (Note: Fill in ballot measure name only — no references to resolution
number.)

submitter as to what the proposal is (i.e., bond, levy, levy lid lift or sales tax) and what the
passage requirements are and under which RCW they are submitting the measure, if
applicable.

6. Returns file to Office Coordinator.

17. Prepares transmittal letter to Assessor, if any taxing or funding implications, to obtain their
review. (See FRM #AU470090C — Assessor Ballot Title Letter - sends to Janice Judge.)
(No letter to the prosecutor since a city has its own attorney who submits the ballot title and
explanatory statement.) Gets criteria for passage to include in the memo from the
information indicated in file.
18. Makes photocopy of resolution, validation information (if any), and ballot measure receipt.
Attaches to Assessor's transmittal letter. Places inside ballot measure folder.
19. Gives folder to Chief Deputy Auditor for review.
Actions by Chief Deputy Auditor:
20. Reviews ballot title and headings for capitalization and punctuation.

The undersigned, being the officers designated by law as constituting the Whatcom County
Canvassing Board, have completed the canvass of votes as it pertains to the General and Special
Election held November 4, 2014, within the boundaries of the City of Ferndale, Whatcom County,
State of Washington.
The proposition concerned imposing a tax of up to one cent per gallon on motor vehicle fuel to be
used for construction and maintenance of streets.
Requirements for Passage
as Supplied by the City of Ferndale:
Needs Simple Majority (`Yes' vote of 50% + 1)
The proposition received 40.77% and therefore, Failed.

RESOLUTION NO. 14-07-07-A
A RESOLUTION OF THE FERNDALE CITY COUNCIL PROVIDING FOR A
BALLOT PROPOSITION TO BE SUBMITTED TO QUALIFIED VOTERS
AUTHORIZING THE IMPOSITION OF A ONE ($0.01) CENT PER GALLON
EXCISE TAX ON THE RETAIL SALE OF MOTOR VEHICLE FUEL AND SPECIAL
FUEL WITHIN THE CITY LIMITS
WHEREAS, the City of Ferndale, Washington, is a "Border Area Jurisdiction"
being located within ten (10) miles of a U.S./Canada border crossing; and
WHEREAS, the current year-to-year financial support for City street
maintenance and construction has not been sufficient to adequately fund the
City's street maintenance and construction needs; and
WHEREAS, Title 82.47 RCW, authorizes the City to impose an excise tax of
up to one cent ($0.01) per gallon on the retail sale of motor vehicle fuel and
special fuel sold within the Ferndale City Limits, if the tax is approved by the
majority vote of the registered voters within the City, voting on the tax at a
general or special election;
NOW THEREFORE, the City Council of the City of Ferndale do resolve as
follows:
Section 1. The Ferndale City Council shall present to the Whatcom County
Auditor's Office a proposition to be placed on the ballot for the election to be
held on the 4th day of November, 2014; and said proposition shall state as
follows:
FERNDALE STREET CONSTRUCTION AND MAINTENANCE TAX
ON THE RETAIL SALE OF MOTOR VEHICLE FUEL AND MOTOR VEHICLE
SPECIAL FUEL
Shall the City of Ferndale impose a tax of up to one cent ($0.01) per gallon
on the retail sale of motor vehicle fuel and motor vehicle special fuel,
exempting the first 60,000 gallons per month, per fuel station, from
collection of the tax in accordance with RCW 82.47, within city limits to be
used for construction and maintenance of streets as specified in Ferndale
City Council Resolution No. 14-07-07-A?

the article used, in the case of a use tax. A city may not begin imposing a
tax approved by the voters under this subsection prior to January 1, 2011.
(b) If a county adopts an ordinance or resolution to submit a ballot
proposition to the voters to impose the sales and use tax under subsection
(1) of this section prior to a city within the county adopting an ordinance or
resolution to submit a ballot proposition to the voters to impose the tax
under this subsection, the rate of tax by the city under this subsection may
not exceed an amount that would cause the total county and city tax rate
under this section to exceed three -tenths of one percent. This subsection (2)
(b) also applies if the county and city adopt an ordinance or resolution to
impose sales and use taxes under this section on the same date.
(c) If the city adopts an ordinance or resolution to submit a ballot
proposition to the voters to impose the sales and use tax under this
subsection prior to the county in which the city is located, the county must
provide a credit against its tax under subsection (1) of this section for the
city tax under this subsection to the extent the total county and city tax rate
under this section would exceed three -tenths of one percent.
(3) The tax authorized in this section is in addition to any other taxes
authorized by law and must be collected from those persons who are
taxable by the state under chapters 82.08 and 82.12 RCW upon the
occurrence of any taxable event within the county.

(4) The retail sale or use of motor vehicles, and the lease of motor
vehicles for up to the first thirty-six months of the lease, are exempt from tax
imposed under this section.
(5) One-third of all money received under this section must be used
solely for criminal justice purposes, fire protection purposes, or both. For the
purposes of this subsection, "criminal justice purposes" has the same
meaning as provided in RCW 82.14,340.
(6) Money received by a county under subsection (1) of this section must
be shared between the county and the cities as follows: Sixty percent must
be retained by the county and forty percent must be distributed on a per
capita basis to cities in the county.
(7) Tax proceeds received by a city imposing a tax under this section
must be shared between the county and city as follows: Fifteen percent
must be distributed to the county and eighty-five percent is retained by the
city.

Finding -- Intent -- 2003 1st sp.s. c 24: "The legislature finds that
local governments in the state of Washington face enormous challenges
in the area of criminal justice and public health. It is the legislature's intent
to allow general local governments to raise revenues in order to better
protect the health and safety of Washington state and its residents. It is
further the intent of the legislature to provide such local governments
relief from regulatory burdens that do not harm the public health and
safety of the citizens of the state as a means of minimizing the need to
generate new revenues authorized under this act." [2003 1 st sp.s. c 24 §
1.]
Effective date -- 2003 1st sp.s. c 24: "This act is necessary for the
immediate preservation of the public peace, health, or safety, or support
of the state government and its existing public institutions, and takes
effect July 1, 2003." [2003 1st sp.s. c 24 § 6.]
Severability -- 2003 1st sp.s. c 24: "If any provision of this act or its
application to any person or circumstance is held invalid, the remainder of
the act or the application of the provision to other persons or
circumstances is not affected." [2003 1st sp.s. c 24 § 7.]

RIZING THE IMPOSITION OF A ONE ($0.01) CENT PER GALLON

FUEL WITHIN THE CITY LIMITS
WHEREAS, the City of Ferndale, Washington, is a "Border Area Jurisdiction"
being located within ten (10) miles of a U.S./Canada border crossing; and
WHEREAS, the current year-to-year financial support for City street
maintenance and construction has not been sufficient to adequately fund the
City's street maintenance and construction needs; and
WHEREAS, Title 82.47 RCW, authorizes the City to impose an excise tax of
up to one cent ($0.01) per gallon on the retail sale of motor vehicle fuel and
special fuel sold within the Ferndale City Limits, if the tax is approved by the
majority vote of the registered voters within the City, voting on the tax at a
general or special election;
NOW THEREFORE, the City Council of the City of Ferndale do resolve as
follows:
Section 1. The Ferndale City Council shall present to the Whatcom County
Auditor's Office a proposition to be placed on the ballot for the election to be
held on the 4th day of November, 2014; and said proposition shall state as
follows:

ON THE RETAIL SALE OF MOTOR VEHICLE FUEL AND MOTOR VEHICLE
SPECIAL FUEL
Shall the City of Ferndale impose a tax of up to one cent ($0.01) per gallon
on the retail sale of motor vehicle fuel and motor vehicle special fuel,
exempting the first 60,000 gallons per month, per fuel station, from
collection of the tax in accordance with RCW 82.47, within city limits to be
used for construction and maintenance of streets as specified in Ferndale
City Council Resolution No. 14-07-07-A?
