HomeMy WebLinkAbout2014 - City of Ferndale Gas Tax 2014-1 Failed44(�--X AU2700906 X PROCEDURE Filing Proposed Ballot Measures for Inclusion in Election (Cities only) (AUDITOR'S OFFICE — Elections) This procedure applies to Auditor's staff, the Assessor's Office, and representatives of the cities submitting proposed ballot measures. Actions by Representative of Cities: 1. Submits proposed ballot measure to Auditor's Office at least 46 days prior to the election date for a special election, no later than the Friday immediately before the first day of regular candidate filing for the primary election, or no later than the day of the primary for a general election. Actions by Election Clerk: v12. If received by mail or courier (e.g., Fourth Corner Network), gives to Office Coordinator to complete steps 3-7. A(,t 4 If received over the counter, date stamps first page only of the submittal. AC, -"4. Checks that resolution contains original signatures by a majority of commissioners or other legislative body or certified copy by clerk. Ensures that the date of the election is stated. 4A. If not original signatures, returns paperwork to submitter to obtain appropriate ✓ signatures before process continues. #5. Prepares Ballot Measure Receipt (See FRM #AU470090A). Makes a copy for file and gives original to filer. (Note: Fill in ballot measure name only — no references to resolution number.) A 46. If for primary or general election, provides voter pamphlet information packet to filer. A6i -7. Gives all materials to Office Coordinator. Actions by Office Coordinator: 8. Gets criteria for passage to include in the memo from the information indicated in file. 18. Makes photocopy of resolution, validation information (if any), and ballot measure receipt. Attaches to Assessor's transmittal letter. Places inside ballot measure folder. 19. Gives folder to Chief Deputy Auditor for review. Actions by Chief Deputy Auditor: 20. RESOLUTION NO. 14-07-07-A A RESOLUTION OF THE FERNDALE CITY COUNCIL PROVIDING FOR A BALLOT PROPOSITION TO BE SUBMITTED TO QUALIFIED VOTERS AUTHORIZING THE IMPOSITION OF A ONE ($0.01) CENT PER GALLON EXCISE TAX ON THE RETAIL SALE OF MOTOR VEHICLE FUEL AND SPECIAL FUEL WITHIN THE CITY LIMITS WHEREAS, the City of Ferndale, Washington, is a "Border Area Jurisdiction" being located within ten (10) miles of a U.S./Canada border crossing; and WHEREAS, the current year-to-year financial support for City street maintenance and construction has not been sufficient to adequately fund the City's street maintenance and construction needs; and WHEREAS, Title 82.47 RCW, authorizes the City to impose an excise tax of up to one cent ($0.01) per gallon on the retail sale of motor vehicle fuel and special fuel sold within the Ferndale City Limits, if the tax is approved by the majority vote of the registered voters within the City, voting on the tax at a general or special election; NOW THEREFORE, the City Council of the City of Ferndale do resolve as follows: Section 1. A city may not begin imposing a tax approved by the voters under this subsection prior to January 1, 2011. (b) If a county adopts an ordinance or resolution to submit a ballot proposition to the voters to impose the sales and use tax under subsection (1) of this section prior to a city within the county adopting an ordinance or resolution to submit a ballot proposition to the voters to impose the tax under this subsection, the rate of tax by the city under this subsection may not exceed an amount that would cause the total county and city tax rate under this section to exceed three -tenths of one percent. This subsection (2) (b) also applies if the county and city adopt an ordinance or resolution to impose sales and use taxes under this section on the same date. (c) If the city adopts an ordinance or resolution to submit a ballot proposition to the voters to impose the sales and use tax under this subsection prior to the county in which the city is located, the county must provide a credit against its tax under subsection (1) of this section for the city tax under this subsection to the extent the total county and city tax rate under this section would exceed three -tenths of one percent. Page 2 of 2 (4) The retail sale or use of motor vehicles, and the lease of motor vehicles for up to the first thirty-six months of the lease, are exempt from tax imposed under this section. (5) One-third of all money received under this section must be used solely for criminal justice purposes, fire protection purposes, or both. For the purposes of this subsection, "criminal justice purposes" has the same meaning as provided in RCW 82.14,340. (6) Money received by a county under subsection (1) of this section must be shared between the county and the cities as follows: Sixty percent must be retained by the county and forty percent must be distributed on a per capita basis to cities in the county. (7) Tax proceeds received by a city imposing a tax under this section must be shared between the county and city as follows: Fifteen percent must be distributed to the county and eighty-five percent is retained by the city.
