said county and state and of Federated Publications, Inc., a Dela-
ware Corporation (publisher of said newspaper), and authorized to
make this affidavit; that the legal notice entitled in the cause and
court named on the attached copy which is a true and correct copy
of the original (and hereinafter referred to as "Notice") was pub-

emergency executive
session Thursday night
to consider options
Since the passage of Proposition No.1
last Tuesday which will establish an elected
mayor form of government in Ferndale,
many residents and business owners have
been muttering a collective, "what's next?"
A special primary election will be held
on Feb. 2 with a special general election to
follow on March 9, according to Whatcom
County Auditor Shirley Forslof.

sometime around the middle of December,
but has yet to be determined, she said.
All seven city council positions will be
up For grabs. during the election. Some of
the council positions will be two year terms
and the other will befour.year terms allow-
ing alternation so in the future voters will
have an opportunity to elect new council
members every two years.
Since the special election will only in-
volve the City of Ferndale, the city must pay
for the entire cost of the election with its
own funds. Forslof said the special election
in March 1997 cost the city approximately
$6,000. With a special primary and general
election in February and March 1999,
Forslof said the cost should be at least
double the cost of the 1997 election and
probably more when considering inflation.
"Whenever a jurisdiction goes alone there
is a greater cost," she said.

The Ferndale City Council held an
emergency executive session Thursday
night to consider what to do next.
An executive session is a closed door
meeting which is not open to the public. The
topic of the meeting dealt with potential liti-
gation, according to City Manager Stan
Strebel. It was not disclosed whether the
City Council is considering challenging the
election's results through litigation how-
ever.
Another area of concern is that over the
next few months the council was expected
to meet and receive input from the differ-
ent city department heads to discuss the
annual city budget, consider department re-
quests and adopt the budget.
The first public hearing was scheduled
to be held on Nov. 23 at the City Council
meeting. Washington state law requires the
council adopt the 1999 budget on or before
Dec. 31.
City Councilman Mike Reilly, a propo-
nent for the change, is suggesting the city
freeze the 1999 budget at the same levels as
in 1998 to prevent the outgoing government
from spending. the taxpayer's money -
Reilly said the current government
should refrain from making any significant
changes since the new government will
have to live with the outgoing
government's decisions. Reilly also said
some room for inflation for the fire district
and 9-1-1 emergency funds would be ac-
ceptable. Reilly declined comment on
whether he would be running for mayor or
a council position, but said several people
have asked him if he is considering running
and have suggested he do so.
Reilly is also suggesting a committee
be created to help assist the transition from
the council -city manager form of govern -

Punch chip completely out
of Ballot Punchcard with a
paper clip or similar device.
1. Remember to SIGN YOUR NAME on the outside of the
MAILING envelope on the line under the Voter Affidavit. Your
signature is compared to your signature on file with the
County.
2. In the Ballot Guide, to the right of each measure or candidate,
is a number which is assigned to a position on your Ballot
Card.
3. Use a paper clip, tooth pick or sharp pencil to punch out the
pre -scored square located ju3t above the number assigned to
the candidate or measure.
4. Write in candidates may be voted for by using the space
provided on the flap attached to your ballot card. You must list
both the Name and Office of the write-in candidate and the
Political Party in Partisan races. Do not punch out a position
number for any other candidate for that office.
5. After you have finished voting, place your Ballot Card in the
Ballot Security Envelope.
6. Place the Ballot Security Envelope containing your voted
ballot runchcard INSIDE THE PRE -ADDRESSED MAILING
ENVELOPE.
7. Put a first-class stamp on the envelope and mail it so it is
postmarked no later than the day of the election. The ballot
will be counted if it is postmarked not later than election day
and if it is received by the county auditor not later than the
tenth day following any special election or primary, or the
fifteenth day following a general election.
8. If you spoil your ballot or wish to change your vote, use the
BALLOT GUIDE and with a pen make your selections. Return
it in the Ballot Security Envelope instead of the ballot card.

THE CITY OF FERNDALE IS PRESENTLY OPERATING AND TO ADOPT THE
MAYOR -COUNCIL PLAN OF GOVERNMENT
WHEREAS, the City of Ferndale is classified as a non -charter code city operating under the
Council -Manager Plan of Government pursuant to RCW Chapter 35A.13, and
WHEREAS, the Whatcom County Auditor has certified the sufficiency of a petition of registered
voters, pursuant to RCW 35A.06, proposing the abandonment of the present Council -Manager plan
of gove►7uiiew in favor of the Mayor -Council plan of government, and
WHEREAS, pursuant to the petition the City Council is required to order an election on the
proposal, and
WHEREAS, the City Attorney, as required by law, has prepared the ballot title and statement of
the proposition to be decided at said election.
NOW THEREFORE, the City Council of the City of Ferndale Resolves as follows:
Section 1. - The City Council hereby requests that the Whatcom County Auditor schedule and
conduct a special election in the City of Ferndale on September 15, 1998, said date being the day of
the primary election is specified by RCW 29.13.070.
Section 2. - That the proposition to be submitted to the voters shall be as follows:
Shall the City of Ferndale Abandon the Council -Manager Plan
of Government, Under Which the City is Presently Operating,
and Adopt the Mayor -Council Plan of Government?
Section 3. - That in the event the proposition receives approval of a majority of voters at said
election, the first election of required officers (Mayor and seven Councilmenibers) be conducted
according to the following schedule:
Special Primary Election - February 2, 1999 (first Tuesday after first Monday in February)
Special Final Election - March 9, 1999 (second Tuesday in March)

Section 1 asks the Auditor's Office to schedule a special election in the City of Ferndale on
September 15,1998 (the third Tuesday in September). Section 2 gives the title of the proposition.
Section 3 (primary and final elections) would come into play if the September election is approved
by a majority of registered Ferndale voters.

WHEREAS, the undersigned, as the duly elected, qualified and acting Auditor of
Whatcom County, Washington, has jurisdiction of and is required by law to conduct all special
elections for special districts within the County; and
WHEREAS, Ferndale City, Whatcom County, Washington, lies entirely within the
boundaries of Whatcom County; and
WHEREAS, the Council of said city by resolution adopted on April 6, 1998, which has
been delivered to the undersigned, has found that an emergency exists requiring the holding of a

WHEREAS, said district by said resolution has authorized and directed the undersigned
to assume jurisdiction of and conduct said special election within Whatcom County;
NOW, THEREFORE, it is hereby authorized and ordered as follows:
The undersigned concurs in the finding of an emergency and does hereby assume
jurisdiction within Whatcom County of the above -mentioned special election of Ferndale City,
Whatcom County, Washington, authorized and ordered by resolution of its City Council adopted
on April 6, 1998, and will conduct said special election to be held September 15, 1998.

ABANDON THE COUNCIL-MANAGER PLAN OF GOVERNMENT UNDER WHICH
I'll E CITY OF FERNDALE IS PRESENTLY OPERATING AND TO ADOPT THE
MAYOR -COUNCIL PLAN OF GOVERNMENT
WHEREAS, the City of Ferndale is classified as a non -charter code city operating under the
Council -Manager Plan of Government pursuant to RCW Chapter 35A.13, and
WHEREAS, the Whatcom County Auditor has certified the sufficiency of a petition of registered
voters, pursuant to RCW 35A.06, proposing the abandonment of the present Council -Manager plan
of government in favor of the Mayor -Council plan of government, and
WHEREAS, pursuant to the petition the City Council is required to order an election on the
proposal, and
WHEREAS, the City Attorney, as required by law, has prepared the ballot title and statement of
the proposition to be decided at said election.
NOW Ti-I t',REFORE, the City Council of the City of Ferndale Resolves as follows:
Section 1. - The City Council hereby requests that the Whatcom County Auditor schedule and
conduct a special election in the City of Ferndale on September 15, 1998, said date being the day of
the primary election is specified by RCW 29.13.070.
Section 2. - That the proposition to be submitted to the voters shall be as follows:
Shall the City of Ferndale Abandon the Council -Manager Plan
of Government, Under Which the City is Presently Operating,
and Adopt the Mayor -Council Plan of Government?
Section 3. - That in the event the proposition receives approval of a majority of voters at said
election, the first election of required officers (Mayor and seven Councilmembers) be conducted
according to the following schedule:
Special Primary Election - February 2, 1999 (first Tuesday after first Monday in February)
Special Final Election - March 9, 1999 (second Tuesday in March)
PASSED by the City Council of the City of Ferndale, Washington at a regular meeting thereof this
6th day of Aril , 1998.

WEDNESDAY, FEBRUARY LOTH AT — 9:00 AM
FRIDAY, FEBRUARY 12TH AT — 2:00 PM
The official canvass of regular, special and questioned absentee ballots from the special primary
election held on February 2, 1999 will be held on February 10, at 9:00 AM and February 12
at 2:00 PM.
The February 10" meeting will be held in the basement multi purpose room and the February 12th
meeting will be held in the County Council Committee room and both meetings will be continue
in the Whatcom County Auditor's ballot counting room until the counting of ballots is
completed.
Please reserve these days for the canvass meetings and also please reserve February I Vh
beginning at 9:00 AM in the council committee room if an additional meeting is required.

The logic and accuracy test is scheduled for Friday January 29, 1999 at 9:30 AM in the Election
Division of the Whatcom County Auditor's office, 311 Grand Avenue, Suite 103, Bellingham,
Washington.
This test will provide an audit of the ballot tabulating and election programming for the Special
Primary election to be held on February 2, 1999.
All interested persons are invited to attend and observe.
