35 A.01.010 Title 35A RC W: Optional Municipal Code such specifically enumerated powers shall be construed as in addition and supplementary to the powers conferred in genera] terms by this title. A noncharter code city is one, regardless of population. which has initially incorporated as a noncharter code city, subject to the provisions of this title, or is an incorporated municipality which has elected, under the procedure prescribed in this title, to be classified as a noncharter code city and to be governed according to the provisions of this title under one of the optional forms of government provided for noncharter code cities. [ 1967 ex.s. c 119 § 35A.01.020.] 35A.01.030 Charter code city. A charter code city is one having at least ten thousand inhabitants at the time of its organization or reorganization which has either initially incorporated as a charter code city and has adopted a charter under the procedure prescribed in this title: or which. as an incorporated municipality, has elected to be classified as a charter code city and to be governed according ro the provisions of this title and of its adopted charter. [1967 ex.s. c 119 § 35A.01,030.1 35A.01.035 Code city. The term "code city'' means any noncharter code city or charter code city. f 1967 exs. c 119 § 35A.01.035.] 35A.01.040 Sufficiency of petitions. Wherever in this title petitions are required to be signed and tiled, the follow- ing rules shall govern the sufficiency thereof: (]) A petition may include any page or group of pages containing an identical text or prayer intended by the circulators, signers or sponsors to be presented and con- sidered as one petition and containing the following essential elements when applicable, except that the elements referred to in (d) and (e) of this subsection are essential for petitions referring or initiating legislative matters to the voters, but are directory as to other petitions: (a) The text or prayer of the petition which shall be a concise statement of the action or relief sought by petitioners and shall include a reference to the applicable state statute of city ordinance, if any; (b) If the petition initiates or refers an ordinance, a true copy thereof; (c) If the petition seeks the annexation, incorporation, withdrawal, or reduction of an area for any purpose, in accurate legal description of the area proposed for such action and if .practical, a map of the area; (d) Numbered lines for signatures with space provided beside each signature for the name and address of the signer and the date of signing; (e) The warning statement prescribed in subsection (2) of this section. (2) Petitions shall be printed or typed on single sheets of white paper of good quality and each sheet of petition paper having a space thereon for signatures shall contain the text or prayer of the petition and the following warning: WARNING - Every person who signs this petition with any other than his or her true name, or who knowingly signs more thin one of these petitions, or signs a petition seeking an election when he or she is not a legal voter, or signs a petition when he or she is other- wise not qualified to sign, or who makes herein any false statement, shall be guilty of a misde- meanor. Each signature shall be executed in ink or indelible pencil and shall be followed by the name and address of the signer and the date of signing. (3) The term "signer" means any person who signs his or her own name to the petition. (4) To be sufficient a petition must contain valid signatures of qualified registered voters or property owners, as the case may be, in the number required by the applicable statute or ordinance. Within three working days after the filing of a petition, the officer with whom the petition is filed shall transmit the petition to the county auditor for petitions signed by registered voters, or to the county assessor for petitions signed by property owners for de- termination of sufficiency. The officer whose duty it is to determine the sufficiency of the petition shall proceed to make such a determination with reasonable promptness and shall file with the officer receiving the petition for filing a certificate stating the date upon which such determination was begun, which date shall be referred to as the terminal date. Additional pages of one or more signatures may be added to the petition by filing the same with the appropriate filing officer prior to such terminal date. Any signer of a tiled petition may withdraw his or her signature by a written request for withdrawal filed with the receiving officer prior to such terminal date. Such written request shall so suffi- ciently describe the petition as to make identification of the person and the petition certain. The'name of any person seeking to withdraw shall be signed exactly the same as contained on the petition and, after the filing of such request for withdrawal, prior to the terminal date, the signature of any person seeking such withdrawal shall be deemed withdrawn. (5) Petitions containing the required number of signa- tures shall be accepted as prima facie valid until their invalidity has been proved. (6) A variation on petitions between the signatures on the petition and that on the voter's permanent registration cause(] by the substitution of initials instead of the first or middle names, or both, shall not invalidate the signature on the petition if the surname and handwriting are the same. (7) Signatures, including the original, of any person who has signed a petition two or more times shall be stricken. (8) Signatures followed by a date of signing which is more than six months prior to the date of filing of the petition shall be stricken. (9) When petitions are required to be signed by the owners of property, the determination shall be made by the county assessor. When a petition which is sufficient under the rules set forth in RCW 35A.01.040 is filed with the legislative body of an incorpo. rated city or town, signed by qualified electors of such mu- nicipality in number equal to not less than ten percent of the votes cast at the last general municipal election. seeking adoption by the city or town of the classification of noncharter code city and the reorganization of the city or town under one of the plans of government authorized in this title, the county auditor shall file with the legislative body thereof a certificate of sufficiency of such petition. Thereup- on, the legislative body shall cause such proposal to be submitted to the voters at the next general municipal election if one is to be held within one hundred eighty days after certification of the sufficiency of the petition, or at a special election to be held for that purpose not less than ninety days nor more than one hundred and eighty days from such certification of sufficiency. Ballot titles for elections under this chapter shall be prepared by the city attorney as provid- ed in *RCW 35A29.120. 11990 c 259 § 3: 1967 ex.s. c 119 § 35A.02.060.) The legislati**'e body of an incorporated city or town may. by resolutin n. submit to the voters in the next general municipal election if one is to be held within one hundred and eighty days after Passage of the resolution, or in a special election to be called for that purpose not less than ninety days nor more than one hundred and eighty days after passage of the resolution.:I proposal that the city or town adopt the classification of noncharter code city and organize under one of the plans of government authorized in this title. naming such plan. 11967 ex.s c 119 § 35A.02.070.1 35A.02.080 Election of officers upon approval of plan of government by voters. If the majority of votes cast at an election for organization under a plan provided in this title favor the plan, the city or town shall elect in accordance with RCW 35A.02.050 the officers for the positions created. The former officers of the municipality shall, upon the election and qualification of the new officers. deliver to the proper officers of the new noncharter code city all books-ol' record. documents and papers in their possession belon-inL! to such municipal corporation before reorganization. 11971 ex.s. c 251 § 2: 1967 cx.s. c 1 19 § 35A.02.080_1 Severahility-1971 ex.s. c 251: Sec RC\V 35A.90.050 35A.02.090 Alternative plan of government: Proposals for each of the plans of government authorized by this title may be placed on the ballots in the sank election by timely petition as provided in this chapter. When the ballot contains alternative proposals for each of the plans of gc vermnent the ballot shall clearly state that voters may vote for only one of the plans of government. 11971 cx.s. c 251 § 3: 1967 cx.s c 119 § 35A.02.090.J Severability-1971 ex.s. c 251: Sec RCW 35A 90.050 issue certificates of election to the successful candidates for the offices under the plan of government for which a majority of the votes were cast, and upon the issuance of such certificates, such city or town shall become a noncharter code city governed under the plan of government chosen by the voters. under the provisions of this title and with the powers conferred by this title. Any incorporated city or town governed under a plan of gov- ernment authorized prior to the time this title takes effect may become a noncharter code city without changing such plan of government by the use of the petition -For -election or resolution-for-elebtion procedures provided in RCW 35A.02.060 and 35A.02.07.0 to submit to the voters a proposal that such municipality adopt the classification of noncharter code city while retaining its existing plan of government, and upon a favorable vote on the proposal, such municipality shall be classified as a noncharter code city and retain its old plan of government, such reclassification to be effective upon the filing of the record of such election with the office of the secretary of state. While proceedings are pending under any petition or resolution relating to reclassification of a municipality or reorganization of the government thereof pursuant to this chapter, no resolution shall be passed for the purpose of initiating other such proceedings or submitting other such proposals to the voters at an election thereunder; and no petition for reclassification or reorganization of such municipality shall be accepted for filing pending such proceedings, except that a timely and sufficient petition seeking to place on the ballot for such election a proposal for an alternative plan of government authorized by this title, as provided in RCW 35A.02.090, may be filed and acted upon. Each of the optional plans of government authorized by chapter 35A.12 RCW and chapter 35A.13 RCW, with any amendments thereto, is declared to be a complete and separate plan of government authorized by the legislature for submission to the voters of a municipality or for adoption by resolution of the legislative body thereof in the manner provided herein, and is additional to the plans of government existing prior to the time this title takes effect. The classifications of municipalities which existed Prior to the time this title goes into effect —first class cities, second class cities, unclassified cities, and towns —and the restrictions, limitations, duties, and obligations specifically imposed by law upon such classes of cities and towns, shall have no application to noncharter code cities, but every noncharter code city, by adopting such classification, has elected W be governed by the provisions of this title, with the Powers granted hereby. However, any code city that retains its old plan of government is subject to the laws 11996 Ed.) applicable to that old plan of government until the city abandons its old plan of government and reorganizes and adopts a plan of government under chapter 35A.12 or 35A.13 RCW. By use of the resolution for election or petition for election methods described in RCW 35A.06.040, any noncharter code city which has operated for more than six consecutive years under one of the optional plans of government authorized by this title, or for more than a combined total of six consecutive years under a particular plan of government both as a code city and under the same general plan under Title 35 RCW immediately prior to becoming a code city, may abandon such organi- zation and may reorganize and adopt another plan of government authorized for noncharter code cities, but only after having been a noncharter code city for more than one year or a city after operating for more than six consecutive years under a particular plan of government as a noncharter code city: PROVIDED, That these limitations shall not apply to a city seeking to adopt a charter. In reorganization under a different general plan of government as a noncharter code city, officers shall all be elected as provided in RCW 35A.02.050. When a noncharter code city adopts a plan of government other than those authorized under Title 35A RCW, such city ceases to be governed under this optional municipal code and shall be classified as a city or town of the class selected in the proceeding for adoption of such new plan, with the powers granted to such class under the general law. Upon the passage of a resolution of the legislative body of a noncharter code city, or upon the filing of a sufficient petition with the county auditor signed by registered voters in number equal to not less than ten percent of the votes cast at the last general municipal election therein, proposing abandonment by the city of the plan of government under which it is then operating and adoption of another plan, naming such plan, the sufficiency of the petition for abandonment shall be determined, an election ordered and conducted, and the results_ declared generally as provided in chapter 35A.02 RCW insofar as such provisions are applicable. If the resolution or petition proposes a plan of government other than those authorized in chapters 35A.12 RCW and 35A.13 RCW of this title, the resolution or petition shall specify the class under which such city will be classified upon adoption of such plan. We voted for this form of government, now let them run the city of Ferndale I was elected to serve on the Ferndale City Council in 1980. It was the first year of the new form of government )council/ manager) that the citizens of Ferndale voted for in the fall of 1979.1 was selected by my fellow council members to serve as the first "Mayor of the Council." As part of that selection process we agreed that a council member would not serve more than one consecutive two-year term. We did not want that position, or individual, to some- how become more important than the citi- zens intended. The "CEO" of the city was to be selected city manager," who would serve at the pleasure of the City Council. We voted for this form of government, have elected the current council members, now let us let them do what we elected them to do. "Run the city." -Are we all go- ing to agree with everything that they do? Do we all agree with our federal and state mandates? Or even with the County? I can remember not agreeing with everything my parents wanted me to do, but I know that they had my best interests at heart. So do the seven Ferndale City Council members. Ferndale, we got a great deal. I'm looking forward to a facility that we can at least take pride in. Have you checked our other local com- munities; including Whatcom County's six other cities and the three urban areas of "Geneva," "Sudden Valley," and "Birch Bay," that are provided with public wa ter and sewer services? The average resi= dentiai cost for water and sewer service using 800 cubic feet of water (60,000 gal-' Ions) over one month's time. in these 10 communities for 1998 is $49.91. Where is' Ferndale? At $43.04. The lowest is Lynden- at $36.91 and the highest is Nooksack at $62. I am sure, just like we have done for - years at Birch Bay, all these communities - have'set rates to cover the cost of service and provide for future maintenance and. operation. Birch Bay is at $40.40 for 1998,; but we haven't upgraded our wastewa- ter treatment plant yet like Ferndale has done. Keep up the good work Ferndale City Council and city staff. Visiting the Whatcom Museum of His- tory and Art a few days ago led me on a nostalgic memory trip back to my child- hood when I saw the Mobil/Tosco exhil it, which was part of "Black Gold: The Oil Refining Industry in Whatcom County," which opened Friday and continues through June 14. Brauner, Box 807 Ferndale WA 98248 on February 4, 1998. One additional page (Page 20) was received from Terry L. Brauner on February 5, 1998. Checking of the petition began on Wednesday, February 18, 1998. As of Friday, February 20, the petition was insufficient as it contained the signatures of 193 City of Ferndale registered voters. The officer whose duty it is to determine the sufficiency of the petition shall proceed to snake such a determination with reasonable promptness and shall file with the officer receiving the petition for filing a certificate stating the date upon which such determination was begun, which date shall be referred to as the terminal date. Additional pages of one or more signatures may be added to the petition by filing the same with the appropriate filing officer prior to such terminal date. Any signer of a filed petition may withdraw his or her signature by a written request for withdrawal filed with the receiving officer prior to such terminal date. Such written request shall so suffi- ciently describe the petition as to make identification of the person and the petition certain. The'name of any person seeking to withdraw shall be signed exactly the same as contained on the petition and, after the filing of such request For withdrawal, prior to the terminal date, the signature of any person seeking such withdrawal shall be deemed withdrawn. (5) Petitions containing the required number of signa- tures shall be accepted as prima facie valid until their invalidity has been proved. (6) A variation on petitions between the signatures on the petition and that on the voter's permanent registration caused by the substitution of initials instead of the first or middle names. or both, shall not invalidate the signature on the petition if the surname and handwriting are the same. (7) Signatures, including the original, of any person who has signed a petition two or more times shall be stricken. (8) Signatures followed by a date of signing which is more than six months prior to the date of filing of the petition shall be stricken. (9) When petitions are required to be signed by the owners of property, the determination shall be made by the county assessor.
