Partisan Primary. If two or more candidates from the same party are tied for the same office at a partisan primary election, the Canvassing Board shall determine the winner by lot. (RCW 29.62.010 (3)) Section 2. Non -Partisan or Judicial Primary. If two or more candidates in a non -partisan or judicial primary have received an equal number of votes and are thus tied, and the number of votes is barely sufficient for nomination, but, as a consequence, the number of persons so nominated exceeds twice the number of positions to be filled, the Board shall determine the tie by lot so as to reduce the field of candidates to the proper number. (RCW 29.62.010 (4)) Section 3. Final Elections. Tie votes in final elections shall be publicly decided by lot in the manner authorized by RCW 29.62.080. Section 4. Method. The method for resolving ties by lot shall be by the toss of a coin with the candidate first on the ballot having the privilege to choose either "heads" or "tails." If the candidate first on the ballot is not present, the other candidate shall choose. Section 5. Recount. Ward Nelson, County Council Chair, and Karen Fakes, Prosecuting Attorney were present. Also attending was Terry Hinz, the Auditor's Chief Deputy. Minutes were taken by Joyce Herrin, Election Deputy. For observers attending see attachment. Shirley called the meeting to order at 9:10 am. Auditor's staff reported that the recount of the Nooksack City Mayor was the same count as the November 4, 1997, Official Canvass count. The vote totals were Jess Reeves, 120 votes and James S. Ackerman, 121 votes. Auditor's staff reported that the recount of Ferndale City Council, Position 1 resulted in Lloyd Zimmerman receiving one more vote from the November 4, 1997 Official Canvass count plus an additional vote from the special ballot accepted by the Canvassing Board meeting of November 24. A group of citizens, led by Bill Geyer, brought up the following issues of concern. 1. The difference in the number of ballots counted and accepted as reported to the canvassing board. The count for style 5 (part of Ferndale City) had variances on the November 19 canvass board meeting report. 2. Some absentee ballots for Ferndale City were mailed to voters registered outside of Ferndale City. The Ferndale City poll book had voters voting that wrote their new addresses in the poll book for an address change and these were addresses outside of Ferndale City. One voter had an address in the Ferndale City poll book that appeared to be outside the City Limits and one they thought was a vacant lot. Reference to R.C.W. 29.62.020 and their question to the Auditors Office was about the nature of the found ballot, how did it arrive on the Fifth floor for the recount of November 24, did the canvassing board have any authority to do this, was there any written record of the addition of the found ballot and was it legal to add this ballot after the Official Canvass? The Auditors office reply to the above. 1. The Auditor's office reported that the discrepancies for styles 5 and 8 were reconciled in a report presented to the Canvassing Board on November 24. 2. Voters can vote in the poll where they are registered to vote even if they have moved to another address, in other words they can vote in Ferndale City and sign their name and put their new address in the poll book for transfer to a new precinct after the election. For absentee voters, if a voter moved and did not notify our office the ballot issued is from the precinct where they last were registered to vote and mailed to their current address. 3. At the last canvassing board meeting the Whatcom County Canvassing Board decided that the Auditor's Office should audit all of the absentee ballot envelopes from Ferndale and Nooksack City and it was at this time that a sealed ballot was located in a ballot envelope. That ballot envelope was then placed and sealed in another envelop and locked in the election vault to be presented to the Whatcom County Canvassing board at the November 24 manual recount meeting. Karen stated that the R.C.W. states that we count all timely voted ballots and the Canvassing Board decided that the ballot was a valid ballot. Shirley reported that we have an absentee opening log showing that this ballot was indeed missed during opening. She stressed that the Canvassing Board makes every effort to count the voters ballots. She also stated that procedures will be reviewed and changes made to protect against this happening in the future. Bill Geyer requested that the Auditors office have a written trail detailing the discovery of the extra ballot. He still believes that this ballot should not be counted and wants to have the Canvassing Board withdraw this ballot. Ward Nelson asked Karen if there was indeed a request by the Canvassing Board to verify the envelops from Ferndale City and Nooksack City. Karen verified that yes the board did feel that reviewing the absentee ballot envelopes was proper in this case. The Whatcom County Canvassing board reaffirmed their decision to accept this Ferndale City ballot. The list produced during the last week of November showing Ferndale City Absentee voters with addresses outside of the City was discussed. The Canvassing Board said that it is the voters responsibility to transfer their address for voting and this must be done 30 days before the election because the registration books are closed to voter registration and address changes 30 days prior to any election. 4 It was requested by this citizens group that these absentee voters with addresses outside the Ferndale City limits and also the voters who changed their address in the Ferndale City poll books be checked and a report made. The Canvassing Board agreed that the Auditor's office will be checking this. Joe Elenbaas had two more points, one was that the canvassing board must comply with the R.C.W. 29.62.020 which states the ballots are counted by the 15th day after the election and this found ballot was located after this 15th day period. The other point in question was regarding the other ballot that had a piece of chad still attached to the punch position for Zimmerman. The Canvassing board disagreed with Mr. Elenbaas' interpretation of this statute. Shirley explained the policies regarding the hanging chad. If the chad is connected by two or more corners, it shall not be counted. In handling of the ballots the chad could fall loose and the punch tabulated as if no chad had been present. Shirley reported that a ballot that was marked with X's and had been canvassed on November 19 was referred to the Canvassing Board during the recount. It was noted that this ballot was marked with X's-but no holes were punched. This ballot was a style 16 and not in Ferndale City or Nooksack City. It was decided by the Canvassing Board to accept both the style 5 and style 16 ballots for the County District 3 Position A race. There was one vote for Wiesen and one vote for Imhof. These votes were added to their count and Certified by the canvassing board. Joe Elenbaas requested that the Auditors office contact the voter of the accepted Ferndale City style 5 ballot and ask the voter who he/she voted for. The canvassing board felt that the office should not ask the voter how they voted because of the voter's right to a secret ballot. The official certification of the recounted races for Nooksack Mayor, Ferndale City Council, Position 1, and County Council District 3, Position A was signed by the canvassing board. The letter from Bernardine Rogstad requesting the machine recount for Ferndale City Council Position 1 was discussed. Ward Nelson made a motion that we would conduct a manual recount, motion seconded by Karen Fakes. Karen stated that the R.C.W. states that when a race is this close it is required that the recount be done by the manual method, indicating that this method is the most accurate. Karen reported that she had discussions with Dave McEachran, Prosecuting Attorney and several other Deputy Prosecutors regarding this recount and the consensus was that the manual recount appeared the most fair method. The Canvassing Board was composed of Shirley Forslof, County Auditor, Karen Frakes, Civil Prosecuting Attorney, and L. Ward Nelson, County Council Chair. Also present was Terry Hinz, Chief Deputy Auditor. Observing were Republican Political Party Observers and candidate representatives. Sign in Log attached. Terry Hinz presented the Auditor's staff report on the absentee ballots for Nooksack City and Ferndale City. He reported that during ;the audit of the absentee ballots, an absentee ballot was located in a sealed envelope with the Ferndale City Absentee Ballots. The ballot was brought before the Canvassing Board. After discussion, Karen Frakes moved that the absentee ballot be accepted and counted during the recount of the Ferndale City Council Position 1 mandatory recount between Yvonne Goldsmith and Lloyd Zimmerman. Seconded by Shirley Forslof. Passed unanimously. After discussion, L. Ward Nelson moved that the Canvassing Board accept the Auditor's report on the Ferndale City and Nooksack City Absentee Ballots. Seconded by Karen Frakes, passed unanimously. Shirley Forslof presented to the Board the procedures and documentation to be used during the recount of the positions of Mayor of Nooksack, Ferndale City Council Position 1, and County Council District 3, Position A. The meeting adjourned at 9:00 a.m. with the next meeting scheduled for 9:30 p.m. on Wednesday, November 26. The mandatory recount of ballots cast for the office of Nooksack Mayor and Ferndale City Council Position 1 began after 9:00 a.m. The Canvassing Board comprised of Shirley Forslof, Karen Frakes and L. Ward Nelson opened and verified the seal numbers of the transfer cases containing the ballots to be recounted. The absentee and poll ballots were manually recounted for Nooksack City Mayor and Ferndale Council Position 1 and the Absentee Ballots for County Council District 3, Position A. The Canvassing Board resealed the transfer cases containing the ballots. The resealing was observed by the candidates' observer. The cases were transferred to the secure vault in the Auditor's office. Candidate observers were in the room at all times during the recount of the ballots. The Canvassing Board was composed of Shirley Forslof, County Auditor, Karen Frakes, Civil Prosecuting Attorney, and Alvin Starkenburg, County Council. Also present were Terry Hinz, Chief Deputy Auditor, Larry Olsen, Republican Political Party Observer and Auditor's staff Pete Griffin, Election Supervisor. The Board reviewed and approved the staff report. Pete Griffin, Election Supervisor produced a printout of the Tuesday, November 17 Absentee, Poll and Combined Poll and Absentee Report. Verified by the Canvassing Board. Auditor's staff tabulated one absentee ballot. Pete Griffin produced a printout after tabulation of the absentee ballot of a new Poll, Absentee and combined Poll and Absentee Report. Verified by the Canvassing Board. Bill Geyer entered the room where the Canvassing Board was meeting. He was asked to leave until after tabulation of ballots. Mr. Geyer left the ballot counting room and observed through the window in the Auditor's office Public Service area. He objected to leaving under the Open Public Meeting Act. At 2:05 p.m. Mr. Geyer was invited back into the ballot counting room to observer the remainder of the Canvassing Board Meeting. It was moved by Karen and Seconded by Alvin Starkenburg that the staff report on the Glacier Water District Annexation be accepted. Passed unanimously. Staff reported that Special Ballot #635 which had originally been accepted as a Nooksack Twp. 3 ballot should have been a Nooksack City ballot as the voter had recently been annexed into Nooksack City. It was moved by Shirley Forslof and seconded by Karen Frakes that we investigate ballot #635. Passed unanimously. Ballot # 635 was located and it was determined that the City of Nooksack offices had valid votes that had not been counted. The City of Nooksack offices were duplicated on a ballot and tabulated. A new report dated November 19, 1997 was produced by Pete Griffin. The Canvassing Board Verified the Poll, Absentee and combined Poll and Absentee Reports and accepted the report as official report #2. Canvassing Board Meeting November 19, 1997 Page 2 A Poll Book Summary and Absentee Ballot Summary Report was presented to the Board by Auditor's staff. The Canvassing Board accepted the report. Shirley Forslof pointed out that the difference between the apparent winner and the loser for the offices of City of Nooksack Mayor and City of Ferndale Council Position 1 were decided by one vote. Ms. Forslof further pointed out that the Absentee Ballot Report showed a variance of 2 for Ferndale City Style 5 between the number of ballots counted and the number accepted for counting and for Nooksack City Style 8 a variance of 3 between the number of ballots counted and the number accepted for counting. She recommended her staff further audit the process and report to the Canvassing Board at their next meeting. It was moved by Alvin Starkenburgh that the Auditor's office further investigate the discrepancies in the cities of Ferndale and Nooksack and report back to the Canvassing Board. Passed unanimously. FAXED letter from Bob Wiesen, District #3 Candidate and Bernadine Rogstad, Chairman of the Whatcom County Republican Party, received on November 18, 1997, were read to the Board. A copy of the letters were provided to each Board member and to Larry Olsen and Bill Geyer. Discussion followed on the recount process and procedures. Alvin Starkenburg moved that the Board follow previously established guidelines. Seconded and approved unanimously. The Board members signed the Official Canvass and established the date and time of the recount of the office of Nooksack City Mayor, Ferndale City Council, Position 1 and County Council District 3, Given the closeness in these races, the WCRP would like to cross-reference our current list of registered voters and the list of newly registered voters with the list of those Act voting, in this c1cotion.
