The undersigned, being the officers designated by law as constituting the Whatcom County
Canvassing Board, have completed the canvass of votes as it pertains to the Special Election held
February 10, 2015, within the boundaries of the City of Everson, Whatcom County, State of
Washington.
The proposition concerned the annexation of the City of Everson into Whatcom County Fire Protection
District 1.
Based on the criteria for passage which was supplied by the district, the measure Passed.

Filing Proposed Ballot Measures for Inclusion in
Election
(AUDITOR'S OFFICE — Elections)
This procedure applies to Auditor's Staff, the Prosecuting Attorney, the Assessor's Office, and
representatives of the cities and districts submitting proposed ballot measures.
Actions by Cities and Representative of Districts:
1. Submits proposed ballot measure (considered ballot title) together with an explanatory
statement (if for a primary or general election) prepared by legal counsel to Auditor's Office.
Must be submitted at least 46 days prior to the election date for a special election, no later
than the Friday immediately before the first day of regular candidate filing for the primary
election, or no later than the day of the primary for a general election.
Actions by Election Clerk:
2. If received by mail or courier (e.g., Fourth Corner Network), gives to Office Coordinator to
complete steps 3-7.
If received over the counter, date stamps first page only of the submittal.
Checks that Ballot Measure Cover Sheet (FIRM #AU270090F) is attached and complete,
the resolution contains original signatures by a majority of commissioners or other legislative
body or certified copy by clerk, and explanatory statement is included if for a primary or
general election. Ensures that the date of the election is stated in the resolution.
4A. If packet not complete, returns packet to submitter to obtain missing information.
Process stops here.

gives original to filer. (Note: Fill in ballot measure name only - no references to resolution
number.)
6. If for primary or general election, provides voter pamphlet information packet to submitter.

ANNEXATION OF THE CITY OF EVERSON INTO FIRE DISTRICT #1 ON THE BALLOT AT
THE NEXT SPECIAL ELECTION
WHEREAS, on September 23, 2014, the City of Everson adopted Ordinance No. 742-
14, initiating the process for annexing the City of Everson into Whatcom County Fire Protection
District #1; and
WHEREAS, on October 9, 2014, Whatcom County Fire Protection District #1 approved
Resolution #220, concurring with the City of Everson's annexation proposal; and
WHEREAS, both the City of Everson and Whatcom County Fire Protection District #1
believe the proposed annexation will best serve the public's interest; and
WHEREAS, RCW 52.04 outlines the process for annexation of a city or town into a fire
protection district; and
WHEREAS, the City of Everson has fulfilled all the requirements for the proposed
annexation and the proposal is now ready to be sent to a vote of the people.
NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council hereby
forwards the annexation proposal to the Whatcom County Auditor for inclusion on the ballot at

DISTRICT NO. 1.
WHEREAS, the City Council of the City of Everson (the "City") passed Ordinance No.
742-14 on September 23, 2014 (the "Ordinance") pursuant to RCW 52.04.061, which ordinance
expressed the City's interest in seeking to join and annex into Whatcom County Fire Protection
District NO. 1 (the "District") and found that the public interest would be best served by the
annexation of the City into the District; and
WHEREAS, the District was officially presented with the Ordinance seeking annexation
by the City at the regular Board of Fire Commissioners meeting on October 9, 2014; and
WHEREAS, pursuant to RCW 52.04.061, and after holding a public hearing at 2:00 pm
on October 9, 2014 for the expressed issue of the City's request for annexation into the District
where members of the general public and department members were welcome to attend and
give testimony regarding the annexation request from the City; and
WHEREAS, the Board of Fire Commissioners of the District considered and discussed
the annexation request, staff recommendations, the public's testimony and debate that followed
in the October 9, 2014 regular monthly meeting of the Board of Fire Commissioners; and
WHEREAS, at the October 9, 2014 regular monthly meeting the District's Board of Fire
Commissioners determined that the annexation of the City into the District was in the public
interest and authorized, by motion, the District's staff to prepare a resolution concurring with the
City's Ordinance seeking annexation into the District.
NOW THEREFORE, BE IT RESOLVED, that pursuant to RCW 52.04.061 the Board of
Fire Commissioners of Whatcom County Fire Protection District No. 1, hereby concurs with the
City of Everson's Ordinance No. 742-14 seeking annexation into Whatcom County Fire
Protection District No. 1, which has been determined to be in the public best interest, and be it
further resolved that notification of such concurrence shall be transmitted to the legislative
authority of Whatcom County by Whatcom County Fire Protection District No. 1 and be it further
resolved that the District's Fire Chief is authorized to coordinate with the City to file a Notice of
Intention with the Whatcom County Boundary Review Board regarding the proposed annexation
of the City into the District.
Approved at the regular board meeting of the Board of Fire Commissioners, Whatcom County

WASHINGTON, STATING AN INTENT, PURSUANT TO RCW 52.04.061 ET SEQ.,
TO ANNEX TO AND JOIN WHATCOM COUNTY FIRE DISTRICT NO. 1, AND
MAKING A FINDING THAT THE PUBLIC INTEREST WILL BE SERVED
THEREBY, AUTHORIZING THE MAYOR TO COORDINATE WITH THE FIRE
DISTRICT ON THE FILING OF A NOTICE OF INTENTION WITH THE
BOUNDARY REVIEW BOARD, AND NOTIFYING THE WHATCOM COUNTY
COUNCIL OF THE INTENT TO ANNEX PENDING FAVORABLE DECISION BY
THE BOUNDARY REVIEW BOARD.
WHEREAS, the City of Everson (the "City") and Whatcom County Fire District No. 1 (the
"District") have engaged in discussion concerning the potential annexation of the City to the
District; and
WHEREAS, the City Council of the City desires to initiate the process described in RCW
52.04.061 et seq. for annexation of the City into the District;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EVERSON,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Intent to Annex / Finding of Public Interest. The City Council hereby states its
intent to have the City annex into and join the District, subject to approval by the Whatcom
County Boundary Review Board and subject to approval by the voters of the City and the
District. The City Council finds that annexation of the City into the District will serve the public
interest of the citizens of the City and the greater Everson area. The City Council hereby requests
that the Board of Commissioners of Whatcom County Fire District No. 1 concur in the
annexation and to notify the Whatcom County Council so that an election may be called on the
question, pending a favorable decision by the Whatcom County Boundary Review Board.
Section 2. Notice of Intention. The Mayor or his designee is hereby authorized to coordinate
with the District to file a Notice of Intention with the Whatcom County Boundary Review Board
seeking annexation of the City into the District. The Mayor is further authorized to take all
necessary steps to pursue approval of the annexation by the Whatcom County Boundary Review
Board in coordination with the District.
Section 3. Construction.
(1) If a section, subsection, paragraph, sentence, clause, or phrase of this ordinance is declared
unconstitutional or invalid for any reason by any court of competent jurisdiction, such
decision shall not affect the validity of the remaining portions of this ordinance.
(2) If provisions of this ordinance are found to be inconsistent with other provisions of the
Everson Municipal Code, then this ordinance and the provisions herein are deemed to
control.
Section 4. This Ordinance shall take effect five days following the date of its publication.

FIRE PROTECTION DISTRICT NO. 1 CONCURRING WITH THE CITY COUNCIL OF THE
CITY OF EVERSON, ORDINANCE NO. 742-14 APPROVING INITIATION OF THE
ANNEXATION OF THE CITY OF EVERSON INTO WHATCOM COUNTY FIRE PROTECTION
DISTRICT NO. 1.
WHEREAS, the City Council of the City of Everson (the "City") passed Ordinance No.
742-14 on September 23, 2014 (the "Ordinance") pursuant to RCW 52.04.061, which ordinance
expressed the City's interest in seeking to join and annex into Whatcom County Fire Protection
District NO. 1 (the "District") and found that the public interest would be best served by the
annexation of the City into the District; and
WHEREAS, the District was officially presented with the Ordinance seeking annexation
by the City at the regular Board of Fire Commissioners meeting on October 9, 2014; and
WHEREAS, pursuant to RCW 52.04.061, and after holding a public hearing at 2:00 pm
on October 9, 2014 for the expressed issue of the City's request for annexation into the District
where members of the general public and department members were welcome to attend and
give testimony regarding the annexation request from the City; and
WHEREAS, the Board of Fire Commissioners of the District considered and discussed
the annexation request, staff recommendations, the public's testimony and debate that followed
in the October 9, 2014 regular monthly meeting of the Board of Fire Commissioners; and
WHEREAS, at the October 9, 2014 regular monthly meeting the District's Board of Fire
Commissioners determined that the annexation of the City into the District was in the public
interest and authorized, by motion, the District's staff to prepare a resolution concurring with the
City's Ordinance seeking annexation into the District.
NOW THEREFORE, BE IT RESOLVED, that pursuant to RCW 52.04.061 the Board of
Fire Commissioners of Whatcom County Fire Protection District No. 1, hereby concurs with the
City of Everson's Ordinance No. 742-14 seeking annexation into Whatcom County Fire
Protection District No. 1, which has been determined to be in the public best interest, and be it
further resolved that notification of such concurrence shall be transmitted to the legislative
authority of Whatcom County by Whatcom County Fire Protection District No. 1 and be it further
resolved that the District's Fire Chief is authorized to coordinate with the City to file a Notice of
Intention with the Whatcom County Boundary Review Board regarding the proposed annexation
of the City into the District.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EVERSON,
WASHINGTON, STATING AN INTENT, PURSUANT TO RCW 52.04.061 ET SEQ.,
TO ANNEX TO AND JOIN WHATCOM COUNTY FIRE DISTRICT NO. 1, AND
MAKING A FINDING THAT THE PUBLIC INTEREST WILL BE SERVED
THEREBY, AUTHORIZING THE MAYOR TO COORDINATE WITH THE FIRE
DISTRICT ON THE FILING OF A NOTICE OF INTENTION WITH THE
BOUNDARY REVIEW BOARD, AND NOTIFYING THE WHATCOM COUNTY
COUNCIL OF THE INTENT TO ANNEX PENDING FAVORABLE DECISION BY
THE BOUNDARY REVIEW BOARD.
WHEREAS, the City of Everson (the "City") and Whatcom County Fire District No. 1 (the
"District") have engaged in discussion concerning the potential annexation of the City to the
District; and
WHEREAS, the City Council of the City desires to initiate the process described in RCW
52.04.061 et seq. for annexation of the City into the District;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EVERSON,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Intent to Annex / Finding of Public Interest. The City Council hereby states its
intent to have the City annex into and join the District, subject to approval by the Whatcom
County Boundary Review Board and subject to approval by the voters of the City and the
District. The City Council finds that annexation of the City into the District will serve the public
interest of the citizens of the City and the greater Everson area. The City Council hereby requests
that the Board of Commissioners of Whatcom County Fire District No. 1 concur in the
annexation and to notify the Whatcom County Council so that an election may be called on the
question, pending a favorable decision by the Whatcom County Boundary Review Board.
Section 2. Notice of Intention. The Mayor or his designee is hereby authorized to coordinate
with the District to file a Notice of Intention with the Whatcom County Boundary Review Board
seeking annexation of the City into the District. The Mayor is further authorized to take all
necessary steps to pursue approval of the annexation by the Whatcom County Boundary Review
Board in coordination with the District.
Section 3. Construction.
(1) If a section, subsection, paragraph, sentence, clause, or phrase of this ordinance is declared
unconstitutional or invalid for any reason by any court of competent jurisdiction, such
decision shall not affect the validity of the remaining portions of this ordinance.
(2) If provisions of this ordinance are found to be inconsistent with other provisions of the
Everson Municipal Code, then this ordinance and the provisions herein are deemed to
control.
Section 4. This Ordinance shall take effect five days following the date of its publication.
PASSED by the City Council and approved by the Mayor of the City of Everson,
Washington, this 23rd day of September, 2014.

WHEREAS, on September 23, 2014, the City of Everson adopted Ordinance No. 742-
14, initiating the process for annexing the City of Everson into Whatcom County Fire Protection
District #1; and
WHEREAS, on October 9, 2014, Whatcom County Fire Protection District #1 approved
Resolution #220, concurring with the City of Everson's annexation proposal; and
WHEREAS, both the City of Everson and Whatcom County Fire Protection District #1
believe the proposed annexation will best serve the public's interest; and
WHEREAS, RCW 52.04 outlines the process for annexation of a city or town into a fire
protection district; and
WHEREAS, the City of Everson has fulfilled all the requirements for the proposed
annexation and the proposal is now ready to be sent to a vote of the people.
NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council hereby
forwards the annexation proposal to the Whatcom County Auditor for inclusion on the ballot at
the next special election.

Annexation of adjacent city or town — City or town in two counties
— Procedure.
(1) A city or town lying adjacent to a fire protection district may be annexed to such district if at the time
of the initiation of annexation the population of the city or town is 300,000 or less. The legislative
authority of the city or town may initiate annexation by the adoption of an ordinance stating an intent to
join the fire protection district and finding that the public interest will be served thereby. If the board of
fire commissioners of the fire protection district shall concur in the annexation, notification thereof shall
be transmitted to the le islative authority or authorities of the counties in which the city or town and the
istrict are situated.
(2) When a city or town is located in two counties, and at least eighty percent of the population
resides in one county, all of that portion of the city lying in that county and encompassing eighty percent
of the population may be annexed to a fire protection district if at the time of the initiation of annexation
the proposed area lies adjacent to a fire protection district, and the population of the proposed area is
greater than five thousand but less than ten thousand. The legislative authority of the city or town may
initiate annexation by the adoption of an ordinance stating an intent to join the fire protection district and
finding that the public interest will be served thereby. If the board of fire commissioners of the fire
protection district shall concur in the annexation, notification thereof must be transmitted to the
legislative authority or authorities of the counties in which the city or town and the district are situated.

Annexation of adjacent city, partial city, or town — Election.
The county legislative authority or authorities shall by resolution call a special election to be held in the
city, partial city as set forth in RCW 52.04.061(2), or town and in the ire protection is roc at -the

RCW 29A.52.355.
The election on the annexation of the city, partial city as set forth in RCW 52.04.061(2), or town into
the fire protection district shall be conducted by the auditor of the county or counties in which the city,
partial city as set forth in RCW 52.04.061(2), or town and the fire protection district are located in
accordance with the general election laws of the state. The results thereof shall be canvassed by the
canvassing board of the county or counties_ No person is entitled to vote at the election unless he or
she is a qualified elector in the city, partial city as set forth in 52.04.061(2), or town or unless he
or she is a qualified eiec or wiin a oun aries of the fire protection district. The ballot proposition
shall be in substantially the following form:

Annexation of adjacent city, partial city, or town — Annual tax
levies — Limitations.
The annual tax levies authorized by chapter 52.16 RCW shall be imposed throughout the fire protection
district, including any city, partial city as set forth in RCW 52.04.061(2), or town annexed thereto. Any
city, partial city as set forth in RCW 52.04.061(2), or town annexed to a fire protection district is entitled
to levy up to three dollars and sixty cents per thousand dollars of assessed valuation less any regular
levy made by the fire protection district or by a library district under RCW 27.12.390 in the incorporated
area: PROVIDED, That the limitations upon regular property taxes imposed by chapter 84.55 RCW
apply.

Annexation of territory by election method — Procedure — ; ;y
Indebtedness — Election dispensed with, when.
(1) A territory adjacent to a fire protection district and not within the boundaries of a city, town, or other
fire protection district may be annexed to the fire protection district by petition of fifteen percent of the
qualified registered electors residing within the territory proposed to be annexed. Such territory may be
located in a county or counties other than the county or counties within which the fire protection district
is located. The petition shall be filed with the fire commissioners of the fire protection district and if the
fire commissioners concur in the petition they shall file the petition with the county auditor of the county
within which the territory is located. If this territory is located in more than one county, the original
petition shall be filed with the auditor of the county within which the largest portion of the territory is
located, who shall be designated as the lead auditor, and a copy shall be filed with the auditor of each
other county within which such territory is located. Within thirty days after the date of the filing of the
petition the auditor shall examine the signatures on the petition and certify to the sufficiency or
insufficiency of the signatures. If this territory is located in more than one county, the auditor of each
other county who receives a copy of the petition shall examine the signatures and certify to the lead
auditor the number of valid signatures and the number of registered voters residing in that portion of the
territory that is located within the county. The lead auditor shall certify the sufficiency or insufficiency of
the signatures.
After the county auditor has certified the sufficiency of the petition, the county legislative authority or
authorities, or the boundary review board or boards, of the county or counties in which such territory is
located shall consider the proposal under the same basis that a proposed incorporation of a fire
protection district is considered, with the same authority to act on the proposal as in a proposed
incorporation, as provided under chapter 52.02 RCW. If the proposed annexation is approved by the
county legislative authority or boundary review board, the board of fire commissioners shall adopt a
resolution requesting the county auditor to call a special election, as specified under *RCW 29.13.020,
at which the ballot proposition is to be submitted. No annexation shall occur when the territory proposed
to be annexed is located in more than one county unless the county legislative authority or boundary
review board of each county approves the proposed annexation.
(2) The county legislative authority or authorities of the county or counties within which such territory
is located have the authority and duty to determine on an equitable basis, the amount of any obligation
which the territory to be annexed to the district shall assume to place the property owners of the
existing district on a fair and equitable relationship with the property owners of the territory to be
annexed as a result of the benefits of annexing to a district previously supported by the property owners
of the existing district. If a boundary review board has had its jurisdiction invoked on the proposal and
approves the proposal, the county legislative authority of the county within which such territory is
located may exercise the authority granted in this subsection and require such an assumption of
indebtedness. This obligation may be paid to the district in yearly benefit charge installments to be fixed
by the county legislative authority. This benefit charge shall be collected with the annual tax levies
against the property in the annexed territory until fully paid. The amount of the obligation and the plan of
payment established by the county legislative authority shall be described in general terms in the notice
of election for annexation and shall be described in the ballot proposition on the proposed annexation
that is presented to the voters for their approval or rejection. Such benefit charge shall be limited to an
amount not to exceed a total of fifty cents per thousand dollars of assessed valuation: PROVIDED,
HOWEVER, That the special election on the proposed annexation shall be held only within the
boundaries of the territory proposed to be annexed to the fire protection district.
(3) On the entry of the order of the county legislative authority incorporating the territory into the
existing fire protection district, the territory shall become subject to the indebtedness, bonded or

otherwise, of the existing district. If the petition is signed by sixty percent of the qualified registered
electors residing within the territory proposed to be annexed, and if the board of fire commissioners
concur, an election in the territory and a hearing on the petition shall be dispensed with and the county
legislative authority shall enter its order incorporating the territory into the existing fire protection district.

Boundary review board approval, or modification and approval, of a proposed annexation by a city,
town, or special purpose district shall authorize annexation as approved and shall not authorize any
other annexation action.
