A RESOLUTION SETTING A SPECIAL ELECTION
WITHIN THE CITY OF EVERSON TO DETERMINE
IF THE CITY OF EVERSON SHALL BE ANNEXED
INTO THE WHATCOM COUNTY RURAL LIBRARY DISTRICT
WHEREAS, R.C.W. 27.12.360 permits the legislative body of a city with a population of
one hundred thousand (100,000) or less to initiate an annexation procedure by ordinance declaring
its finding that the public interest of the residents of the city would be served by annexation into
the rural library district of the county;
WHEREAS, the City of Everson, a city with a population less than one hundred ,thousand
(100,000), has enacted such an ordinance, Ordinance No. 442, on June 23, 1992;
WHEREAS, there being no library board within Everson, the Everson Ordinance No. 442
has been duly submitted to the State Librarian for review as provided by law, and has further
received the concurrence of Whatcom County Rural Library District, as appears by the
e�e Aurmnt re iiibrxrV Annnattnn attached hereto;
WHEREAS, upon receipt of notification of the enactment of the above -referenced city
ordinance, the opportunity for review by the State Librarian, and the concurrence of the rural
library district, R.C.W. 27.12.370 provides that the County legislative authority shall by_
Resolution call a special election to be held in such city on the next date provided in R.C.W:
29.13.010; and
WHEREAS, the next available special election date provided in R.C.W. 29.13.010 is the
2d day of February, 1993; NOW THEREFORE -
BE IT RESOLVED by the Whatcom County Council that a special election conducted by
the Whatcom County Auditor's Office shall be set on the annexation ballot proposition within the
City of Everson for the 2d day of February, 1993.
BE IT FURTHER. RESOLVED that the Whatcom County Auditor's Office shall cause
notice of said special election to be given pursuant: to R.C.W. 29.27.080.
BE IT FURTHER RESOLVED that said election shall be conducted, voter eligibility be
established and the voting majority determined in accordance with R.C.W. 27.12.370 and the
other general laws of the State of Washington as applied by the Whatcom County Auditor.
BE IT FURTHER RESOLVED that the ballot proposition shall be stated in substantially

between the WHATCOM COUNTY [Washington] RURAL LIBRARY DISTRICT,
hereinafter referred to as the "DISTRICT", and the CITY OF EVERSON,
WASHINGTON, a Washington municipal corporation hereinafter referred to as
"EVERSON", as follows:

County, excluding only the incorporated property lying within the boundaries of the
Cities of Bellingham, Lynden and EVERSON;

EVERSON pursuant to the terms of a contract by which EVERSON supplies a branch
library facility, including a portion of annual operating utilities, as well as providing for
compensation approximately equivalent to the revenue the DISTRICT would receive if
EVERSON were annexed into the DISTRICT;

Paragraph 3, EVERSON may contract with the DISTRICT for the uninterrupted
provision of library services at a rate of compensation approximately equivalent to the
revenue the DISTRICT would receive if EVERSON remained in the DISTRICT,
without regard for the otherwise threatened levy reduction.
5. Upon withdrawal of EVERSON from the DISTRICT pursuant to
Paragraph 3 and in the event that the aggregate levies within EVERSON no longer
would require a reduction of the DISTRICT's levy rate under the provisions of RCW
84.52.010, EVERSON agrees, following a written request therefore and adoption of a
resolution by the Board of Directors of the DISTRICT pursuant to RCW
27.12.355(3)(a) to that effect, to adopt by the end of the calendar year of the request a
resolution pursuant to RCW 27.12.355(3)(b) approving the reannexation of EVERSON
to the DISTRICT; all subject to a possible referendum as described in said statute.

Thank you for consenting to consideration of Everson's
proposal for annexation to the library district despite the
closure of the agenda for the Council meeting of December

A RESOLUTION SETTING A SPECIAL ELECTION
WITHIN THE CITY OF EVERSON TO DETERMINE
IF THE CITY OF EVERSON SHALL BE ANNEXED
INTO THE WHATCOM COUNTY RURAL LIBRARY DISTRICT
WHEREAS, R.C.W. 27.12.360 permits the legislative body of a city with a population of
one hundred thousand (100,000) or less to initiate an annexation procedure by ordinance declaring
its finding that the public interest of the residents of the city would be served by annexation into
the rural library district of the county;
WHEREAS, the City of Everson, a city with a population less than one hundred thousand
(100,000), has enacted such an ordinance, Ordinance No. 442, on dune 23, 1992;
WHEREAS, there being no library board within Everson, the Everson Ordinance No. 442
has been duly submitted to the State Librarian for review as provided by law, and has further
received the concurrence of Whatcom County Rural Library District, as appears by the
Agrumnit rye Eibrarg Annexatlan attached hereto;
WHEREAS, upon receipt of notification of the enactment of the above -referenced city
ordinance, the opportunity for review by the State Librarian, and the concurrence of the rural
library district, R.C.W. 27.12.370 provides that the County legislative authority shall by
Resolution call a special election to be held in such city on the next date provided in R.C.W.
29.13.010; and
WHEREAS, the next available special election date provided in R.C.W. 29.13.010 is the
2d day of February, 1993; NOW THEREFORE
BE IT RESOLVED by the Whatcom County Council that a special election conducted by
the Whatcom County Auditor's Office shall be set on the annexation ballot proposition within the
City of Everson for the 2d day of February, 1993.
BE IT FURTHER RESOLVED that the Whatcom County Auditor's Office shall cause
notice of said special election to be given pursuant to R.C.W. 29.27.080.
BE IT FURTHER RESOLVED that said election shall be conducted, voter eligibility be
established and the voting majority determined in accordance with R.C.W. 27.12.370 and the
other general laws of the State of Washington as applied by the Whatcom County Auditor.
BE IT FURTHER RESOLVED that the ballot proposition shall be stated in substantially

Paragraph 3, EVERSON may contract with the DISTRICT for the uninterrupted
Provision of library services at a rate of compensation approximately equivalent to the
revenue the DISTRICT would receive if EVERSON remained in the DISTRICT,
without regard for the otherwise threatened levy reduction.
5. Upon withdrawal of EVERSON from the DISTRICT pursuant to
Paragraph 3 and in the event that the aggregate levies within EVERSON no longer
would require a reduction of the DISTRICT's levy rate under the provisions of RCW
84.52.010, EVERSON agrees, following a written request therefore and adoption of a
resolution by the Board of Directors of the DISTRICT pursuant to RCW

resolution pursuant to RCW 27.12.355(3)(b) approving the reannexation of EVERSON
to the DISTRICT, all subject to a possible referendum as described in said statute.
