WHEREAS, the City of Blaine is classified as a non -charter code city operating under the Council -Manager Plan of Government pursuant to RCW Chapter 35A.13; and WHEREAS, the Whatcom County Auditor has certified the sufficiency of a petition of registered voters, pursuant to RCW 35A.06, proposing the abandonment of the present Council -Manager Plan of Government in favor of the Mayor -Council Plan of Government; and WHEREAS, pursuant to the petition the City Council is required to order an election on the proposal; and WHEREAS, the City Attorney, as required by law, has prepared the ballot title and statement of the proposition to be decided at said election, NOW, THEREFORE, the City Council of the City of Blaine Resolves as follows: SECTION 1: The City Council hereby requests that the Whatcom County Auditor submit the proposition to a vote at the next General Election, on November 2, 1999, pursuant to RCW 35A.06.050. SECTION 2: That the proposition to be submitted to the voters shall be as fol l es: Shall the City of Blaine Abandon the Council -Manager Plan of Government, Under Which the City is Presently Operating, and Adopt the Mayor -Council Plan of Government? SECTION 3: That in the event the proposition receives approval of a majority of voters at said election, the filing dates for candidates shall be between December 6, 1999 and December 10, 1999. All grants of municipal power to municipalities electing to be governed under the provisions of this title, whether the grant is in specific terms or in general terms, shall be liberally construed in favor of the municipality. [ 1967 ex.s. c 119 § 35A.01.030.1 35A.01.035 Code city. The term"code city" means any noncharter code city or charter code city. [ 1967 ex.s. c 119 § 35A.01.035.] 35A.01.040 Sufficiency of petitions. Wherever in this tide petitions are required to be signed and filed, the follow- ing rules shall govern the sufficiency thereof: (1) A petition may include any page or group Of pages containing an identical text or prayer intended by the circulators, signers or sponsors to be presented and con- sidered as one petition and containing the following essential elements when applicable, except that the elements referred to in (d) and (e) of this subsection are essential for petitions referring or initiating legislative matters to the voters, but are directory as to other petitions: (a) The text or prayer of the petition which shall be a concise statement of the action or relief sought by petitioners and shall.include a reference to the applicable state statute of city ordinance, if any: (b) If the petition initiates or refers an ordinance, a true copy thereof; (c) If the petition seeks the annexation. incorporation. withdrawal, or reduction of an area for any purpose, an accurate legal description of the area proposed for such action and if .practical, a map of the area- (d) Numbered lines for signatures with space provided beside each signature for the name and address of the signer and the date of signing; (e) The warning staiernent prescribed in subsection (2) of this section. (2) Petitions shall be printed or typed on single sheets of white paper of good quality and each sheet of petition paper having a space thereon for signatures shall contain the text or prayer of tiie petition and the following warming: WARNING Every person who signs this petition with any other than his or her true name, or who knowingly signs more than one of these petitions, or signs a petition seeking an election when he or she is not a legal voter, or signs a petition when be or she is other- wise not qualified to sign, or who makes herein any false statement, shall be guilty of a misde- meanor. Each signature shall be executed in ink or indelible pencil and shall be followed by the name and address of the signer and the date of signing. (3) The term "signer" means any person who signs his or her own name to the petition. (4) To be sufficient a petition must contain valid signatures of qualified registered voters or property owners, as the case may be, in the number required by the applicable statute or ordinance. Within three working days after the filing of a petition, the officer with whom the petition is filed shall transmit the petition to the county auditor for petitions signed by registered voters, or to the county assessor for petitions signed by property owners for de- termination of sufficiency. The officer whose duty it is to determine the sufficiency of the petition shall proceed to [Hake such a determination with reasonable promptness and shall file with the officer receiving the petition for filing a certificate stating the date upon which such determination was begun, which date shall be referred to as the terminal date. Additional pages of one or more signatures may be added to the petition by filing the same with the appropriate tiling officer prior to such terminal date. Any signer of a tiled petition may withdraw his or her signature by a written request for withdrawal filed with the receiving officer prior to such terminal date. Such written request shall so suffi- ciently describe the petition as to make identification of the person and the petition certain. The'name of any person seeking to withdraw shall be signed exactly the same as contained on the petition and, after the filing of such request For withdrawal, prior to the terminal date, the signature of any person seeking such withdrawal shall be deemed withdrawn, (5) Petitions containing the required number of signa- tures shall be accepted as prima facie valid until their invalidity has been proved. (6) A variation on petitions between the signatures on the petition and that on the voter's permanent registration caused by the substitution of initials instead of the first or middle names. or both, shall not invalidate the signature on the petition if the surname and handwriting are the same- (7) Signatures, including the original, of any person who has signed a petition two or more times shall be stricken- (8) Signatures followed 'by a date of signing which is more than six months prior to the date of filing of the petition shall be stricken. %9) When petitions are required to be signed by the owners of property, the determination shall be trade by the County assessor. Where validation of signatures to the petition is required, the following shall apply: (Title 35A RM—page 21 (1996 rd,) 35A.02.060 4- Title 3SA RCW: Optional Municipal Code 35A.02.060 Petition for election. When a petition which is sufficient under the rules set forth in RCW 35A.01.040 is filed with the legislative body of an incorpo- rated city or town, signed by qualified electors of such mu- nicipality in number equal to not less than ten percent of the votes cast at the last general municipal election, seeking adoption by the city or town of the classification of- noncharter code city and the reorganization of the city or town under one of the plans of government authorized in this title, the county auditor shall file with the legislative body thereof a certificate of sufficiency of such petition. Thereup- on, the legislative body shall cause such proposal to he submitted to the voters at the next general municipal election if one is to be held within one hundred eighty days after certification of the sufficiency of the petition, or at a special election to be held for that purpose not less than ninety days nor more than one hundred and eighty days from such certification of sufficiency. Ballot titles for elections under this chapter shall be prepared by the city attorney as provid- ed in *RCW 35A-29.120. If the majority of votes cast at an election for organization under a plan provided in this title favor the plan, the city or town shall elect in accordance with RCW 35A-02.050 the officers for the positions created. Proposals for each of the plans of government authorized by this title may be placed on the ballots in the same election by timely petition as provided in this chapter. Any incorporated city or town governed under a plan of gov- ernment authorized prior to the time this title takes effect may become a noncharter code city without changing such plan of government by the use of the petition -for -election pr resolution-for-clection procedures provided in RCW 35A.02.060 and 35A.02.070 to submit to the voters a proposal that such municipality adopt the classification of noncharter code city while retaining its existing plan of government, and upon a favorable vote on the proposal, such municipality shall be classified as a nonchaner code city and retain its old plan of,government, such reclassification to be effective upon the filing of the record of such election with the office of the secretary of state. The classifications of municipalities which existed prior to the time this title goes into effect --first class cities, second class cities, unclassified cities; and towns —and the restrictions, limitations, duties, and obligations specifically imposed by law upon such classes of cities and towns, shall have no application to noncharter code cities, but every noncharter code city, by adopting such classification, has elccled to be governed by the provisions of this title, with the powers granted hereby. However, any code city that retains its old plan of government is subject to the laws (1996 Ed.) applicable to that old plan of government until the city abandons its old plan of government and reorganizes and adopts a plan of government under chapter 35A.12 or 35A.13 RCW. By use of the resolution for election or petition for election methods described in RCW 35A.06.040, any noncharter code city which has operated for more than six consecutive years under one of the optional plans of government authorized by this title, or for more than a combined total of six consecutive years under a particular plan of government both as a code city and under the same general plan under Title 35 RCW immediately prior to becoming a code city, may abandon such organi- zation and may reorganize and adopt another plan of government authorized for noncharter code cities, but only after having been a noncharter code city for more than one year or a city after operating for more than six consecutive years under a particular plan of government as a noncharter code city: PROVIDED, That these limitations shall not apply to a city seeking to adopt a charter. In reorganization under a different general plan of government as a noncharter code city, officers shall all be elected as provided in RCW 35A.02.050. When a noncharter code city adopts a plan of government other than those authorized under Title 35A RCW, such city ceases to be governed under this optional municipal code and shall be classified as a city or town of the class selected in the proceeding for adoption of such new plan, with the powers granted to such class under the general law.
