amendment:
Shall Section 5.03 of the Bellingham City Charter be amended to
allow negotiation of professional services contracts as allowed by
State law?
Enclosed is a copy of duly -executed Resolution No. 39-1987, authorizing
the Charter amendment and setting out its text. Please call me if you

RESOLUTION NO. 39-1987
A RESOLUTION RELATING TO THE CHARTER OF THE CITY OF BELLINGHAM AND
PROPOSING AN AMENDMENT THERETO TO BE SUBMITTED TO THE ELECTORATE AT THE
1987 GENERAL ELECTION.
WHEREAS, the Bellingham City Charter requires the City Council to
regulate the manner of making bids and letting contracts; and
WHEREAS, state law recognizes that some contracts, such as those
for professional services, do not require public bidding by first-class
cities; and
WHEREAS, it is in the best interest of the City to be consistent
with state law in this respect;
NOW, THEREFORE, BE IT RESOLVED BY THE BELLINGHAM CITY COUNCIL that,
in accordance with Section 13.01 of the Charter, the City Attorney is
hereby directed to prepare an appropriate ballot title for the following
proposed Charter amendment, and to submit the same to the Whatcom County
Auditor for submission to the electorate at the November 3, 1987 General
Election:
Section 5.03 of the Bellingham City Charter, relating to
advertising for bids, is amended to read as follows:
Section 5.03 Advertising for bids
In all cases of work to be done by contract, or the purchase of
property of any kind, the Council shall advertise for bids in the City
official newspaper, unless the cost thereof shall not exceed $2,000.00,
or such greater amount as the Council by ordinance may designate, or
unless the Council by resolution shall declare an emergency to exist.
When such probable expenditure shall exceed the aforementioned limit, and
no emergency shall be declared to exist, the Council shall publish notice
in one (1) issue of the City official newspaper. The Council, however,

may reject any and all bids; and nothing contained herein shall prevent
the City from contracting through negotiation for professional services
or for the doing of work with patented processes or from purchasing
patented appliances. The Council shall regulate the matter of making
bids and letting contracts by ordinance not in conflict with the other
provisions of this Charter.
