The effort to dissolve
the Chuckanut Communi-
ty Forest Park District and
end the property tax that
went with it has failed.
In July 2014, a few prop-
erty owners in the district
filed a lawsuit, alleging
they were unfairly taxed
and that the park district,
created by voters in Febru-
ary 2013, was'formed
illegally.
Whatcom County Super-
ior Court Judge Deborra
Garrett didn't agree, rul-
ing against them Tuesday,
June 21.
She found the park dis-
trict was validly formed by
voters, was a valid park
district and had the au-
thority to enact the proper-
ty tax.
John and Mary Ferlin of
Ferlin Family Living Trust,
J & M's LLC, Brooks Man-
ufacturing Co: and Roose-
velt Land Co. filed the
lawsuit.
They argued, in part,
that levying a tax for a
public park on a small
segment of the city was
illegal.
They sued the Chucka-
nut Community Forest
Park District, Whatcom
Countyand Bellingham.
Voters in what was
roughly southwest Belling-
ham formed the park dis-
trict to tax property own-
ers.
The money is being
used to repay the $3.2
million loan from the city
Greenways endowment
fund that helped pay the
$8.2 million price tag for
Bellingham's 2011 pur-
chase of the 82-acre
Chuckanut Ridge, also
known as the Hundred
Acre Wood.
The lawsuit also argued
that the district was im-
properly formed to serve
as a financing tool to -repay
the loan and not for parks
purposes.
Many area residents had
long opposed housing
construction on the site
and worked for years to
block development or to
convince city officials that
it should be acquired as
public park or open space.
The property is southeast
of Fairhaven Park and
16th Street and west of
24th Street and the Inter-
urban Trail.
The levy now charges 26
cents per $1,000 of as-
sessed value. That's $78
per year for a home as-
sessed at $300,000.
"I'm pleased with the
result and happy for all the
people on the south side of
Bellingham who've
worked so hard to bring
about the preservation of
this property,," said at-
torney Robert Carmichael,
who along with attorney
Simi Jain represented the
park district.
Park district officials
said they have so far spent
$99,000 defending
against the lawsuit.
It might not end soon.
Pete Dworkin, attorney for
the property owners who
sued, believed his clients
will appeal the judge's
decision.
"We disagree with the
ruling. We think we
should've won," Dworkin
said.

Border crossings
into Whatcom County
continue to decrease

Despite a rally in the
Canadian dollar in late
April and early May, the
number of Canadians
traveling to Whatcom
County continues to
shrink.
The number of people
traveling southbound
across Whatcom County's
five border crossings to-
taled 1,098,470 in May,
down 10.7 percent com-
pared to a year ago and
down 22.4 percent from
May 2014.
Through the first five
months of 2016, border
traffic is down 12.8 per-
cent compared to the
same period a year ago.
In late April the Cana-
dian dollar was near 80
cents compared to the
U.S. dollar, up' from
around 68 cents earlier
this year.
Despite having about
the same purchasing pow-
er as May 2015, when the
Canadian dollar was also
at around 80 cents, the
decline continues.
Canadian border traffic
has a strong influence on
retail sales in Whatcom
County, particularly at the
big -box stores.
Currently the loonie is
around 78 cents.
Some local retailers
have tried to counter the
lower Canadian dollar
with sales to lure visitors
from the north, including
the At Par Sale that took
place last month at Bellis
Fair during Canada's
Victoria Day weekend.
The current traffic level
is probably the new nor-
mal for a while, said Lau-
rie Trautman, associate
director at the Border
Policy Research Institute
at Western Washington
University.

dissolve the Chuckanut
Community Forest
Park District and reIat-
ed property tax has ended now
that the state Supreme Court
won't take up the case.
The state's high court on
Wednesday declined to review a
Court of Appeals decision on
Oct. 30 that ruled against those
who filed the lawsuit.
"We're all really happy be-
cause for the last several years,
while this lawsuit has been
pending, there's been a cloud
over the district and also the
Hundred Acre Wood," said
attorney Robert Carmichael,
who represented the park dis-
trict.
The Hundred Acre Wood is
the community's fond name for
what is now known as the
Chuckanut Community Forest.
"That cloud has been lifted,"
Carmichael said.
Park district officials said they
have spent at least $104,500
defending against the lawsuit.
In July 2014, a few property
owners in the district filed the
lawsuit, alleging they were un-
fairly taxed and that the park
district, created by voters in
February 2013, was formed
illegally.
Voters in what was roughly
southwest Bellingham formed
the park district to tax property
owners.
The money is being used to
repay the $3.2 million loan from
the city Greenways endowment
fund that helped pay the $8.2
million price tag for Belling-
ham's 2011 purchase of the
82-acre property that has been
known as Chuckanut Ridge,
Hundred Acre Wood and Fair-
haven Highlands.
Many area residents had long
opposed efforts to build hun-
dreds of homes on the site and
worked for decades to block
development or to convince city
officials that it should be ac-
quired as public park or open
space.

lawsuit.
They argued, in part, that

1. 1 am the Auditor of Whatcom County and make this declaration of my own
personal knowledge and from the records of the Whatcom County Auditor's Office, of which I
am personally familiar.
2. The Whatcom County Auditor (the "Auditor") received a petition proposing to
create the Chuckanut Community Forest Park District ("Park District") on or about June 18,

2012. The Auditor and the County Prosecutor's office reviewed the petition for sufficiency and
found that the legal description provided required alteration. The Proponents corrected the
legal description and the petition was finalized. A true and correct copy of the final petition
("Petition") is attached hereto as Exhibit "A."
3. The Auditor found that the Petition met the statutory requirements for a
petition as to format. A true and correct copy of a letter from the Auditor's office date July 3,
2012 is attached hereto as Exhibit "B".
4. Based upon the legal description provided in the Petition, the Auditor identified
the voting precints which would vote on the formation of the Park District.
5. A special election was held on February 12, 2013 and the formation of the Park
District was one of the items submitted to the affected Whatcom County voters during said
election.
6. The proponents submitted the Petition contained signatures of at least fifteen
percent (15%) of the registered voters residing in the area sought to be included in the
proposed district. The Whatcom County Auditor issued a Certificate of Sufficiency which
verifies the requisite signature under RCW 35.61.020. A true and correct copy of the
Certificate of Sufficiency and Petition Receipt is attached hereto as Exhibits "Cl and C2".
7. The ballot proposition and explanatory statement for the voters pamphlet was
drafted by the proponents of the Park District. The Auditor's office and the Whatcom County
Prosecutor's office reviewed these for sufficiency. Since the Park District was not yet formed,
the Whatcom County Prosecutor's office entitled the ballot proposition. The statements for
and against the ballot proposition are not reviewed by Whatcom County. A true and correct
copy of the ballot proposition and explanatory statement is attached hereto as Exhibit "D".
8. The Petition described the composition of the initial Board of Commissioners for
the proposed district. See Exhibit "A". The Auditor issued a news release, posted notice on the
Auditor website and also the Bellingham Herald published an article that a special three day
filing period for the proposed commissioner positions would take place between Decebmber

Auditor added the people who ran for each of the positions to the ballot. A true and correct

a report to the Canvassing Board of the election. A true and correct copy of the Auditor's

the five (5) positions for the Board of Commissioners on February 26, 2013. A true and correct

Canvassing Board also completed the canvass of the formation of the Chuckanut Community
Forest Park District and found that the proposition passed. A true and correct copy of the
Offical Canvass of the Special Election for the Formation of the Chuckanut Community Forest
Park District is attached hereto as Exhibit "I".
12. The Auditor filed the election results, posted the election results on the
Auditor's website and informed the proponents of the election certification and also issued an
Oath of Office to each of the five (5) elected Commissioners.
13. Once the Chuckanut Community Forest Park District ("Park District") was
formed, the Auditor sent a bill to the Park District for the costs associated with the election.
