Shirley Fo lof Whatcom 0. unty Auditor Xnd Ex-officio Supervisor of Elections Publish: October 31, 1990 Resolutfutt No. A RESOLUTION OF THE BOARD OF COMMISSIONERS OF WHATCOM COUNTY CEMETERY DISTRICT NUMBER 9, FINDING THAT A LEVY IS NECESSARY IN ORDER TO PREVENT IMPAIRMENT OF THE OBLIGATION OF CONTRACTS OF THE DISTRICT AND CALLING FOR AN ELECTION REQUESTING s, THE APPROVAL OF AN EXCESS LEVY PURSUANT TO ARTICLE VII, SECTION 2 (A) OF THE WASHINGTON STATE `e1 CONSTITUTION, AS AMENDED BY AMENDMENT 64. WHEREAS, the certified property tax levy of the District for 1988, collectible in 1989 and for 1989, collectible in 1990, were eliminated pursuant to Section 84.52.010 RCW; WHEREAS, preservation of the assets of the District is dependent upon their maintenance and repair performed by contract; WHEREAS, in order to properly provide for said maintenance and repair, and to prevent the impairment of contracts for the same, the District deems it necessary that a tax of approximately Ten Cents ($.10) per One Thousand Dollars ($1,000.00) of assessed valuation (based on One Hundred Percent (100%) of true and fair value) to provide Eleven Thousand Dollars ($11,000.00) for the District's General Fund be levied upon all of the taxable property within the District in excess of the maximum annual tax levy permitted by law to be levied for the District without a vote of the electors, such levy to be made in 1990, for collection in 1991; and WHEREAS, the Constitution and Laws of the State of Washington require that any such excess tax must be submitted to the qualified electors of the District for their ratification or rejection; now therefore BE IT RESOLVED by the Board of Commissioners of Whatcom County Cemetery District No. 9, Whatcom County, Washington, as follows: Section 1. The Board of Commissioners of Whatcom County Cemetery District No. 9 hereby finds and declares that an excess levy is necessary in order to prevent the impairment of the obligation of contracts of the District, as well as to preserve and protect the public assets of the District. Section 2. In order to provide Eleven Thousand Dollars ($11,000.00) for the General Fund of the District, the District authorizes the Whatcom County Council to levy a tax of approximately Ten Cents ($.10) per One Thousand Dollars Ito. Upon approval by the voters of Proposition No. 1 hereinafter set forth, the District may use the proceeds of such levy during the 1991 calendar year, and may expend the proceeds thereof to pay the general expenses of maintenance and operations of the District as may be authorized or allowed by law for the use of excess levy funds. Section 3. The Board of Commissioners of Whatcom County Cemetery District No. 9 hereby find and declare that an emergency exists requiring a submission to the qualified electors of the District a proposition of whether or not such excess tax should be levied for their ratification or rejection at the general election to be held therein on November 6, 1990. The Whatcom County Auditor, as ex-officio, supervisor of elections in Whatcom County, is hereby requested to also find the existence of such emergency and to call and conduct said excess levy election to be held within the District on said day and to submit to the qualified electors of the District the proposition hereinafter set forth.
